Commissioners' Meeting
October 26, 1970
The Regular Meeting of the Board of Commissioners met in the Commissioners' Room,
City -County Building, on Monday, October 19, 1970, at four o'clock p.m.
The Mayor asked everyone to stand for the Pledge of Allegiance to the Flag and a
Moment of Silent Prayer.
There were present:

comprising a quorum of the Board, also:

The Minutes of the Regular Meeting of October 19, 1970, were approved as mailed.
BIDS were received on Bond Series P-213 for $147,101.81 for 10 years:
The bids were opened and tabulated by the City Clerk. A motion was made by
Commissioner Rundquist, seconded by Commissioner Ashton to award the bid to City National
Bank, Kansas City, Missouri, for a total interest cost to the City of $44,300.41, with
an average interest rate of 4.57080%, and to introduce an ordinance for first reading
authorizing the issuance of General Obligation Bond Series P-213. Ayes: (5). Nays: (0).
Motion carried.

AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing
for the amendment of Zoning Ordinance Number 6613 and the Zoning District Map therein and
thereby acopted and providing for the rezoning of certain property within the City and
prescribing the proper uses thereof." [Rezoning of Lots 4, 5, 6, Block 6, Shalimar Plaza
Addition, from District "B" to District "C" (Apartment District) which was requested in
Petition Number 3126, filed by Clyde E. Smith on August 21, 19701 A motion was made by
Commissioner Yost, seconded by Commissioner Rundquist to adopt the ordinance as read and
the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5).
Nays: (0). Mayor approved the Ordinance and it is numbered 8110. Carried. The ordinance
was introduced for first reading October 12, 1970.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing
for the amendment of Zoning Ordinance Number 6613 and the Zoning District Map therein and
thereby adopted and providing for the rezoning of certain property within the City and
prescribing the proper uses thereof." [Rezoning the West 415 feet of Block 6, Schilling
Sub -division from District "C" to District "PIP" (Planned Industrial Park) which was
requested in Petition Number 3127, filed by the Salina Airport Authority on August 25, 19701
A motion was made by Commissioner Millikan, seconded by Commissioner Yost to adopt the
ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost,'
Caldwell (5)• Nays: (0). Mayor approved the Ordinance and it is numbered 8111. Carried.
The Ordinance was introduced for first reading October 12, 1970.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE relating
to and apportioning and levying special assessments on certain lots and pieces of ground
in the City of Salina, Kansas, to pay the cost of constructing Lateral Sanitary Sewer
District Number 511, and relating to and providing for the collection and payment of such
assessments." (Engineering Job 508) A motion was made by Commissioner Rundquist, seconded
by Commissioner Ashton to adopt the ordinance as read and the following vote was had:
Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5). Nays: (0). Mayor approved the
ordinance and it is numbered 8112. Carried. The Ordinance was introduced for first
reading October 19, 1970.
AN ORDINANCE was introduced for second reading entitled: "Aid ORDINANCE ratifying
and confirming a contract with Brown & Brown, Inc., for the construction of certain
improvements in the City of Salina, Kansas, and providing for the issuance of temporary
notes to pay the cost thereof, pending the issuance and sale of bonds." [Engineering
Job 525 - Improvements were requested in Petition Number 3113, which was filed by Upper
Mill Development Company, Inc., by Aubrey G. Linville on May 8, 19701 A motion was made
by Commissioner Yost, seconded by Commissioner Millikan to adopt the ordinance as read and
the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5).
Nays: (0). Mayor approved the ordinance and it is numbered 8113. Carried. The ordinance
was introduced for first reading October 19, 1970.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE relating
to adultery; amending Section 23-68 of The Salina Code and repealing the existing section."
A motion was made by Commissioner Ashton, seconded by Commissioner Rundquist to adopt the
ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost,
Caldwell (5). Nays: (0). Mayor approved the ordinance and it is numbered 8114. Carried.
The ordinance was introduced for first reading October 19, 1970.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE relating
to unlawful cohabitation; enacting Section 23768.1 of The Salina Code." A motion was made
by Commissioner Millikan, seconded by Commissioner Yost to adopt the ordinance as read and
the following mote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5).
Nays: (0). Mayor approved the ordinance and it is numbered 8115. Carried. The ordinance
was introduced for first reading October 19, 1970.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE relating
to lewd and lascivious behavior; enacting Section 23-68.2 of The Salina Code." A motion
was made by Commissioner Yost, seconded by Commissioner Rundquist to adopt the ordinance
as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell
(5)• Nays: (0). Mayor approved the ordinance and it is numbered 8116. Carried. The
ordinance was introduced for first reading October 19, 1970.

to assault; amending Section 23-147 of The Salina Code and repealing the existing section."

to battery; enacting Section 23-147.1 of The Salina Code." A motion was made by Commissionei
Ashton, seconded by Commissioner Rundquist to adopt the ordinance as read and the following
vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5). Nays: (0). Mayor i
approved the ordinance and it is numbered 8118. Carried. The ordinance was introduced

THE CITY COMMISSIONERS considered the approval of the Final Plat of the East 1/2
of Block 10, Riker Addition to the City of Salina, (requested in Petition Number 3118, which
was filed by Ralph Reitz, Co -trustee of the A. A. Riker Trust, on June 9, 1970) recommended
in a letter from the Salina City Planning Commission dated October 13, 1970, and tabled at
the Commissioners Meeting of October 19, 1970. The City Engineer feels the drainage
problem has been worked out with the owners. A motion was made by Commissioner Yost,
seconded by Commissioner Rundquist to approve the Final Plat of the East 1/2 of Block 10,
Riker Addition to the City of Salina, Kansas. Ayes: (5). Nays: (0). Motion carried.
THE CITY ENGINEER reported on Petition Number 3137 for Sanitary Sewer and Water
Mains to serve Lots b and 7, Mt. Barbara Park Addition; which was filed by James A. Greenw000, Jr.
on October 16, 1970. The City Engineer recommended the water and sewer mains be installed. l
A motion was made by Commissioner Millikan, seconded by Commissioner Yost to accept the
recommendation of the City Engineer and approve the petition. Ayes: (5)• Nays: (0).
Motion carried.
A CEREAL MALT BEVERAGE LICENSE APPLICATION was filed by Ray Behner, Manager of
the Cozy Inn, 108 North Seventh Street. A motion was made by Commissioner Yost, seconded
by Commissioner Millikan to approve the license. Ayes: (5). Nays: (0). Motion carried.
A LETTER was received from the Radio Cab Company for two additional parking stands€ _
on the north side of the 100 Block of East Walnut. A motion was made by Commissioner Yost,
seconded by Commissioner Millikan to refer the petition to the Traffic engineer for a
report. Ayes: (5). Nays: (0). Motion carried.

THE MAYOR, with the approval of the City Commissioners appointed Frank Langshaw
to the Board of Zoning Appeals to fill the unexpired term of J. D. Patterson to
May 8, 1973•
MR. JACK GRAY, Ex -Captain of the Salina Fire Department, was present asking
that the City Manager, Director of Administration, Director of safety, Fire Chief, and
Assistant Fire Chief be fired. Mr. Gray stated Mr. Olson always wants to be fair and
honest, but he had in a letter which would prove otherwise, also Mr. Gray read from a
letter stating that H. J. McCabe did not want to be Fire Chief because he wanted to be
the Director of Safety. Mr. Gray would not reveal who signed the letter at this time.
He said he has a letter with a list of names of 15 men who would be fired and that his
name was at the top of the list, and that he was forced to retire because of incompatibility+.
Mr. Gray asked the City Commissioners to make a fair and impartial investigation of the
Fire Department. He claims he has had numerous offers to circulate petitions, by
organizations and individuals, to have the City Manager fired.
Commissioner Rundquist asked Mr. Gray if he had any knowledge of problems in
any other department of the City. Mr. Gray replied, ''Yes, but employees of the other
departments were scared to open their mouths because they would be fired.''
Mayor Caldwell thanked Mr. Gray for his years of service to the Fire Department.
MRS. VIRGINIA FRESE, Safety Chairman of the Franklin PTA, was present and read a
letter written to the Director of Safety concerning the intersection of Ninth and
Crawford, which mentioned a survey mailed to families of Franklin School containing 3
different proposals:
#1. Add ''Walk on Green Light Only'' sign.
#2. Move a School Crossing Guard from Tenth and Franklin to
Ninth and Crawford.
#3. Move the School Crossing Guard from in front of Franklin
School to the intersection of Ninth and Crawford.

63 families felt none of these proposals were acceptable.
After considerable discussion, again, about the intersection, a motion was made
by Commissioner Yost, seconded by Commissioner Rundquist to add a School Crossing Guard
at the intersection of Ninth and Crawford for the remainder of the school year. Ayes: (5).
Nays: (0). Motion carried.
A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton
to have the City Engineer prepare a report for widening Ninth Street, between Charles and
Bond Streets, and Crawford Street between Tenth and Santa Fe, so a right turn lane for
the intersection of Ninth and Crawford could be installed. Ayes: (5). Nays: (0).
Motion carried.
On a motion by Commissioner Millikan, seconded by Commissioner Yost, the
Regular Meeting of the Board of Commissioners adjourned.
