Harrison, City Clerk i Absent: None ENGINEERING JOB 508 The meeting was held for the purpose of acting on the appraisers report for Engineering Job 508, for Lateral Sanitary Sewer 511 to serve Lots 1, 2, 3, 4, and the North 64 feet of Lot 5, and Lots 8, 10, 11, 12, 13, 14, 15, 16, 17, 18, Block 5, Replat of Blocks 4 and 5 and part of Block 3, Schippel Addition to the City of Salina, Saline County, Kansas. No protests, written or oral, were filed. A motion was made by Commissioner Yost, seconded by Commissioner Rundquist to approve the appraisers report as read, and to introduce the assessment ordinance for first reading. Ayes: (5). Nays: (0). Harrison, City Clerk City of Salina, Kansas _ Commissioners' Meeting October 19, 1970 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City -County Building, on Monday, October 19, 1970, at four o'clock p.m. The Mayor asked everyone to stand for the Pledge of Allegiance to the Flag and a Moment of Silent Prayer. There were present: Mayor Robert C. Caldwell, Chairman presiding Commissioner Leon L. Ashton Commissioner Donald D. Millikan Commissioner Carl R. Rundquist Commissioner William W. Harrison, City Clerk Absent: None The Minutes of the Regular Meeting of October 12, 1970, were approved as mailed. THE MAYOR proclaimed October 24, 1970 - "UNITED NATIONS DAY". The proclamation was read by Dr. Emerald Dechant, President of Marymount College and Chairman of United Nations Day. THE MAYOR proclaimed October 23, 1970 - "CANDY DAY FOR THE BLIND". The proclamation was read by Art Williams, President of the Lions Club. BIDS were received for Job 525 - Upper Mill Heights Addition Number 2 sanitary sewer, water mains, storm sewers and street improvements: (Improvements were requested in Petition Number 3113, which was filed by Upper Mill Development Company, Inc., by Aubrey G. Linville on May 8, 1970) Brown and Brown, Inc. $95,660.35 Stevens Contractors 96,935.95 Rhoades Construction Company 99,086.01 Engineer's Estimate 97,267.75 A motion was made by Commissioner Millikan, seconded by Commissioner Yost to award the contract to Brown and Brown, Inc. for $95,660.35, subject to the verification of the bid by the Engineering Department, and to introduce the contract ordinance for first reading. ORDINANCE PASSED: (' o�,.,�, ,�` i9u Number: Q113 A RESOLUTION was introduced for second reading entitled: "A RESOLUTION relating to the paving and grading of Barney Street, with concrete (Forty-one (41) feet wide from back of curb to back of curb) with a 4 inch lay back curb, from the north line of North j Street to the south line of Lincoln Avenue." A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to adopt the Resolution as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5). Nays: (0). Mayor approved the Resolution and it is numbered 3076. Carried. (The improvements were requested in Petition Number 3133, which was filed by Mr. 0. K. Webster on October 5, 1970) THE CITY MANAGER reported on Petition Number 3132, which was filed by Virginia i Frese, Safety Chairman of the Franklin P.T.A., for Walk -Don't Walk Traffic Signals at Ninth and Crawford, and tabled at the meeting of October 12, 1970. The City Manager reported that an investigation had been made by the Traffic Engineer, Sgt. Clark of the f Salina Police Department, Inspectors of the Building Department and KINA Radio Station. I i i 9 i The Traffic Engineer suggested signs be installed on the mass arms showing ''Walk on Green Straight and Right Turn Arrows''. All reports indicated that most children crossed the intersection without problems. The children alone, or in pairs, had the most trouble in crossing. One boy, probably a 4th grader, crossed the intersection on a red light three or four times. The City has the boy's name, and the City Manager stated that he will call the parents to see if the child is color blind or just horsing around. Mrs. Virginia Frese reported that there are several children living north and east of Ninth and Crawford, and feels a Walk -Don't Walk Traffic Signal is the answer to the problems at this f intersection. Commissioner Millikan stated that a sign, suggested by the Traffic Engineer, would be better understood by the children crossing the intersection. Mr. Leo Clanton said that the Crossing Guard at Ninth and Crawford last year remarked to him that he had problems getting across the intersection at times. Mr. Clanton also said the Crossing Guard at Tenth and Franklin should be moved to Ninth and Crawford, because all he does is hold the children off the school grounds until school takes up. Mr. Clanton remarked that the intersection at Ninth and Republic has a Crossing Guard, 20 MPH Speed Signs, Stop and Go Traffic Signal, and the Ninth and Crawford intersection has no Crossing Guard and no speed signs. Mr. Clanton mentioned that he had talked to the School Board and they said that they have no control over where the crossing guards would be located. The City Manager stated that the School Board worked very closely with the City Staff in the placing of the School Crossing Guards and would get together to check the possibility of moving a guard to Ninth and Crawford from some other crossing. A motion was made by Commissioner Millikan, seconded by Commissioner Yost to accept the City Manager's Report to have the signs installed. Ayes: (5). Nays: (0). Motion carried. A LETTER was received from the Salina City Planning Commission recommending the approval of the Final Plat of the Replat of the East Half of Block 10, Riker Addition. (Requested in Petition Number 3118, which was filed by Ralph E. Reitz, Co -Trustee of the A. A. Riker Trust, on June 9, 1970) Commissioner Millikan asked the City Engineer if anything had been done about the water drainage in the area. The City Engineer said nothing had been done, that he had talked with the interested parties about a storm sewer or having the area filled, and suggested the City Commission table the matter for one week to see if he could get a solution to the problem. A motion was made by Commissioner Millikan, seconded by Commissioner Yost to table the matter for one week. Ayes: (5). Nays: (0). Motion carried. A MOTION was made by Commissioner Rundquist, seconded by Commissioner Ashton to introduce an ordinance for first reading relating to adultery; amending Section 23-68 of The Salina Code and repealing the existing section. Greenwood, Jr. for sanitary sewer and water main to serve Lots 6 and 7, Mt. Barbara Park Addition. A motion was made by Commissioner Millikan, seconded by Commissioner Yost to refer the petition to the City Engineer for a report. Ayes: (5). Nays: (0). Motion carried. THE CITY ATTORNEY reported that he had been instructed by the City Commission to check the validity of a resolution passed by the Kansas State Council Council of Fire Fighters at their 25th Annual Conference in Wichita, Kansas on September 17, 18, 19, 1970. The City Attorney read from the letter from W. R. McCarter, President and Harold E. Huggins Secretary of the Kansas State Council of Fire Fighters: "We can only answer this challenge with the following statement of fact: The Fire Fighters of Salina Local No. 782, IAFF, submitted Resolution No. 4 to the delegates assembled, representing 13 Kansas Locals, and some 1500 fire fighters, for there (sic) consideration. Before any vote was taken, a complete report on the charges, as outlined in the Resolution, was given by the Salina delegates, and after a very lengthy discussion by the delegates, the Resolution was passed unanimously. "Also, in regard to your challenge that we prove these charges, we can only state, that this Resolution was considered by the delegates in attendance in accordance with the same procedure that we have followed for the passed (sic) 25 years, and we certainly feel that the Salina delegates had no reason whatever, to lie to there (sic) Brother Fire Fighters." The City Attorney stated that the resolution is identical to the one received by the City Commissioners except that "Resolution Number 4" had been typed at the top, and at the bottom: "Submitted by Executive Board of Local 782, IAFF, Salina, Kansas". Commissioner Millikan challenged Local 782 of IAFF to prove the statements made in the Resolution or retract the accusations in a public statement. The other Commissioner concurred with Commissioner Millikan. Commissioner Rundquist suggested that the staff consider putting the Fire Department back on the 2 platoon system by the first of the year. Commissioner Millikan again stated that, in his opinion, the Inspectors of the Fire Department should be on a 40 hour workweek, because he feels they could make more inspections and do a better job during the daylight hours. A MOTION was made by Commissioner Millikan, seconded by Commissioner Ashton to introduce and pass a Resolution entitled: "A RESOLUTION suggesting the City Manager and his staff re-evaluate the present organization and work schedule within the Fire Department, The following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5)• Nays: (0). Mayor approved the Resolution and it is numbered 3077. Carried. AN ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an appropriation for the payment of certain claims." (bills - $256,235.37) A motion was made by Commissioner Ashton, seconded by Commissioner Rundquist to adopt the ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5).
