10-05-1970 Minutes1 1 I- City of Salina, Kansas Commissioners' Meeting October 5, 1970 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City -County Building, on Monday October 5, 1970, at four o'clock p.m. The Mayor asked everyone to stand for the Pledge of Allegiance to the Flag and a Moment of Silent Prayer. There were present: Mayor Robert C. Caldwell, Chairman presiding Commissioner Leon L. Ashton Commissioner Donald D. Millikan Commissioner Carl R. Rundquist Commissioner William W. Yost comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None The Minutes of the Regular Meeting of September 21, 1970, were approved as mailed. THE MAYOR proclaimed the Month of October, 1970 - "SALINA UNITED WAY MONTH". The proclamation was read by Mr. Gib Wenger. THE MAYOR proclaimed the Month of October, 1970 - "PTA ENROLLMENT MONTH". The proclamation was read by Mrs. Elaine Adkins, Saline County Council Chairman. THE MAYOR proclaimed the Month of October, 1970 - "OCTOBER, 1970 IS RESTAURANT MONTH". The proclamation was read by Mr. Ben E. Vidricksen. THE MAYOR proclaimed October 4 through 10, 1970 - "FIRE PREVENTION WEEK". The proclamation was read by Fire Chief, Jim Lacy. MAYOR CALDWELL presented City Service Awards to City Employees for 10 and 25 years; of service to the City. j MR. JOHN ORTEGA, of the Traffic Safety Department of the Kansas Highway Commission' presented a Pedestrian Safety Award for 1969. The award was received by Sgt. Herb Clark of the Salina Police Department. THE CITY ENGINEER Filed Plans and Specifications for Upper Mill Heights Addition Number 2 Improvements (Engineering Job 525). The improvements were requested in Petition Number 3113 which was filed by the Upper Mill Development Company, Inc., by Aubrey G. Linville on May 8, 1970 A motion was made by Commissioner Yost, seconded by Commissioner Rundquist to accept the Plans and Specifications as filed and instruct the City Clerk to advertise for bids to be received October 19, 1970. Ayes: (5). Nays: (0). Motion carried.! AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE establishin Fire Zones within the City of Salina, Kansas, determining the boundaries thereof; amending Sections 9-2, 9-3, and 9-4 of The Salina Code." A motion was made by Commissioner Rundquist seconded by Commissioner Ashton to adopt the ordinance as read and the following vote was ha Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5). Nays: (0). Mayor approved the ordinance and it is numbered 8107. Carried. The ordinance was introduced for first reading] September 21, 1970. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE adopting by reference the 1970 Edition of the Uniform Building Code and all appendices and repealing Section 9-18 of The Salina Code." A motion was made by Commissioner Millikan, seconded by Commissioner Yost to adopt the ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5). Nays: (0). Mayor approved the ordinance and it is numbered 8108. Carried. The ordinance was introduced for first reading September 21, 1970. APPRAISERS filed their report for Job 508 - Lateral Sanitary Sewer 511 for Schippel Addition. A motion was made by Commissioner Millikan, seconded by Commissioner Rundquist to accept the appraisers report as filed, and instruct the City Clerk to publish a "Notice of Special Hearing" to be held October 19, 1970. Ayes: (5). Nays: (0). Motion carried. A MOTION was made by Commissioner Yost, seconded by Commissioner Rundquist to introduce an ordinance for first reading levying special assessments against certain property to pay the cost of constructing certain sidewalks in the parking on the east and i west sides of the 1900 Block of Highland Avenue. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: o&AA�, 1g, i47o Number: $lo° i A MOTION Was made by Commissioner Rundquist, seconded by Commissioner Ashton to instruct the City Clerk to publish "Notice of Bond Sale" for bids to be received October 26 1970 for Series P-213 for $147,101.81 for 10 years, for street and sewer improvements. Ayes: (5). Nays: (0). Motion carried. E A RESOLUTION was introduced and passed entitled: "A RESOLUTION approving an agreement between the City of Salina, Kansas, and the United States Government relating to fire protection for the Schilling Manor Sub -post. A motion was made by Commissioner Millikan, seconded by Commissioner Yost to adopt the Resolution as read and the following I vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5). Nays: (0). Mayor approved the Resolution and it is numbered 3074. Carried. A RESOLUTION was introduced and passed entitled: "A RESOLUTION designating the official depositories for all moneys of the City of Salina, Kansas, and directing the City Treasurer to deposit all moneys received by him therein." A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to adopt the Resolution as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5). Nays: (0). Mayor approved the Resolution and it is numbered 3075. Carried. PETITION NUMBER 3131 was filed by Prudential Savings Association, 600 South Santa Avenue for the rezoning of Lot 6, Santa Fe Avenue, Prescott Addition, from District "C" (Apartment District) to District "DD" (Office District). A motion was made by Commissioner Rundquist, seconded by Commissioner Millikan to refer the petition to the Salina City Planning Commission. Ayes: (5). Nays: (0). Motion carried. PETITION NUMBER 3132 was filed by Mrs. Virginia Frese, Safety Chairman of the Franklin PTA for the installation of "WALK -DON'T WALK" traffic light at the corner of Ninth and Crawford to insure the safety of school children crossing this intersection. A motion was made by Commissioner Millikan, seconded by Commissioner Yost to refer the petition to the Traffic Department for a report as soon as possible. Ayes: (5). Nays: (0). Motion carried. PETITION NUMBER 3133 was filed by Mr. 0. K. Webster for the paving of Barney Street (500 Block) paved 40 feet wide with lay back curb. A motion was made by Commissioners Yost, seconded by Commissioner Ashton to refer the petition to the City Engineer to be checked. Ayes: (5). Nays: (0). Motion Carried. Mr. Webster was present asking the City Commissioners to vote in favor of the paving of Barney Street. He felt there are sufficient signers, and that the streets at both ends are paved. He feels that paving this street will clean up a bad situation in the area. A LETTER was received from J. D. Patterson resigning from the Salina City Planning Commission. A motion was made by Commissioner Millikan, seconded by Commissioner Rundquist to accept his resignation, and thank him for his service. Ayes: (5). Nays: (0). Motion carried. MAYOR CALDWELL appointed Dr. Emerald Dechant, President of Marymount College, Chairman of United Nation Day, which will be held on October 24, 1970. COMMISSIONER Millikan commented on the Resolution recently passed by the Kansas State Council of Firefighters at their annual meeting in Wichita, Kansas, in September, condemning the Salina City Commission. This resolution condemns the City Commission for the suspension of a firefighter, not allowing merit pay increases, and taking their vacation away. Commissioner Millikan replied that the City Commission did not suspend a firefighter,l and that the City Commission has absolutely nothing to do with merit pay increases. Commissioner Millikan read the firemen's own proposal, which was presented by them, recommended by the Fire Chief and approved by the City Commission in 1967. The Kansas State Council of Firefighters' Resolution also accused the City Commissioners of violating the firefighters Constitutional Rights and Civil Rights. Commissioner Millikan said, "We challenge the accusers to offer specific proof of these charges or publicly retract the accusation." "The foregoing comments have been made on behalf of, and with the full knowledge and approval of the entire Salina City Commission." Commissioner Millikan then made a few other personal comments. If there are legitimate areas for discussion, they should be brought to us through the proper channels, rather than through the news media. By taking such steps e 1 1 1 1 n I` S as this resolution of condemnation, the representatives of the local firefighters show, to me at least, an immaturity and a lack of responsibility not conducive to good labor relation ; and therefore, are doing a poor job of representing their colleagues, their department, and their city." "It also seems to me that we have spent an undue amount of time and thought and energy in dealing with the Fire Department. Why do we have to pump up the morale of the Fire Department every 2 or 3 years? Especially in view of the fact that morale in other departments seems to be high." Commissioners Yost and Ashton agreed with Commissioner Millikan's Statements, saying it was undue restitution against the City Commissioners. Commissioner Rundquist also agrees with Commissioner Millikan's statements and asked the City Attorney if it is possible to check into the validity of the resolution passed by the Kansas State Council of Fire Fighters. The City Attorney said he would attempt to get the official action of the Union. AN ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an appropriation for the payment of certain claims." (bills -$193,098.23) A motion was made by Commissioner Ashton, seconded by Commissioner Yost to adopt the ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5). Nays: (0). Mayor approved the ordinance and it is numbered A-1551. Carried. AN ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an appropriation for the payment of certain claims." (payroll- $91,378.82). A motion was made by Commissioner Ashton, seconded by Commissioner Yost to adopt the ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5).
