Commissioners' Meeting
September 21, 1970
The Regular Meeting of the Board of Commissioners met in the Commissioners' Room
City -County Building, on Monday, September 21, 1970, at four o'clock p.m.
The Mayor asked everyone to stand for the Pledge of Allegiance to the Flag and
a Moment of Silent Prayer.
There were present:
Mayor Robert C. Caldwell, Chairman presiding
Commissioner Leon L. Ashton
Commissioner Donald D. Millikan
Commissioner Carl R. Rundquist
Commissioner William W. Yost
comprising a quorum of the Board, also:
L. 0. Bengtson, City Attorney
William E. Harris, Director of Administration
D. L. Harrison, City Clerk
Absent:
Norris D. Olson, City Manager
The Minutes of the Regular Meeting of September 14, 1970, were approved as
mailed.
A HEARING was held on Resolution Number 3068 for the curbing, guttering, paving,
water main and sanitary sewer improvements on Stimmel Road. (Engineering Job 528). (The
improvements were requested in Petition Number 3119, filed by Mrs. Lois Herrington on
June 12, 1970). Virgil Gross, Stephen Madden, Leslie Sloan, Vernon Hicks were all present'
to protest the cost of the improvements on Stimmel Road. They felt the cost of the
improvements is higher than the property is worth. They were not particularly against
the water and sewer improvements, but felt the curbing, guttering, and paving improvements'
would create a high tax burden. A written protest was also filed by CL's Inc., Steele, InGI
James P. and Dorothy Mize, Leslie and Belva Sloan, Merle T. and Winona J. Nelson, and
Economic Enterprises. A motion was made by Commissioner Yost, seconded by Commissioner
Rundquist to stop any further action on Petition Number 3119. Because of the protests,
the Commission felt the improvements are not feasible. Ayes: (5). Nays: (0). Motion
carried.
A MOTION was made by Commissioner Yost, seconded by Commissioner Rundquist to
have the City Engineer prepare a Feasibility Study for Water and Sanitary Sewer
Improvements on Stimmel Road and North Fifth Street. Ayes: (5). Nays: (0). Motion
Carried.
A RESOLUTION was introduced and passed entitled: ''A RESOLUTION authorizing and
ordering certain sanitary sewer, water mains, storm sewers, and pavement improvements,
ordering preparation of plans and specifications, the estimate of costs.'' (Improvements
were requested in Petition Number 3113, which was filed by the Upper Mill Development
Company, Inc., by Aubrey G. Linville on May 8, 1970) (Engineering Job 525) A motion
was made by Commissioner Rundquist, seconded by Commissioner Millikan to adopt the
Resolution as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist,
Yost, Caldwell (5). Nays: (0). Mayor approved the Resolution and it is numbered 3072.
Carried.
AN ORDINANCE was introduced for second reading entitled: ''AN ORDINANCE
enacting Section 23-114 of The Salina Code, providing that it shall be unlawful to loiter
or trespass on certain property.'' A motion was made by Commissioner Yost, seconded by
Commissioner Ashton to adopt the Ordinance as read and the following vote was had:
Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5). Nays: (0). Mayor approved the
ordinance and it is numbered 8105. Carried. Ordinance was introduced for first
reading September 14, 1970.
THE CITY ENGINEER reported on Petition Number 3128, which was filed by
0. K. Webster for the curbing, guttering, and paving of Barney Street, from North Street
to Lincoln Street, on September 4, 1970. He reported that Mrs. Nellie Parry had requested
that her name be withdrawn from the petition. The City Attorney said she has the right to
do this, and in this case the petition is found to be insufficient. A motion was made by
Commissioner Rundquist, seconded by Commissioner Ashton to return the petition to the
petitioner, and take it under advisement. Ayes: (5). Nays: (0). Motion carried.

I THE DIRECTOR OF ADMINISTRATION reported on Petition Number 3129, which was filed
by Mrs. Les Wenger for a street light on an existing pole between 445 and 436 Queens Road.
on September 9, 1970. The Director of Administration reported that the requested street
light would be too close to the existing street light on Queens Road. Mr. Wenger is
checking to see if it would be favorable to have a street light farther south in the block.
(Mr. Wenger said he is willing to do this.) A motion was made by Commissioner Rundquist,
seconded by Commissioner Millikan to table the petition. Ayes: (5). Nays: (0). Motion
carried.
AN ORDINANCE was introduced entitled: "AN ORDINANCE providing for a levy of taxes
for General Revenue and other purposes of the City of Salina, Kansas, for 1970 and repealin
Ordinance Number 8101." The Mayor requested, in writing, that the Governing Body determine
than an emergency exists in the adoption of this ordinance. A motion was made by
Commissioner Millikan, seconded by Commissioner Yost to adopt the ordinance as read and
j the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5).
Nays: (0). Mayor approved the ordinance and it is numbered 8106. Carried.
A GRANT OF TEMPORARY EASEMENT for street construction in Upper Mill Heights
Addition Number 2, was filed by Aubrey G. Linville for the Upper Mill Development Company,
Inc. The City Engineer explained that the temporary easement is for street construction
and is needed for the sloping of the ditches. A motion was made by Commissioner Yost,
seconded by Commissioner Ashton to authorize the easement to be signed by the Commissioners
Ayes: (5). Nays: (0). Motion carried.
PETITION NUMBER 3130 was filed by Claude Freeman for the installation of a street
light on the corner of Brown & Tenlawns Streets. A motion was made by Commissioner Yost,
seconded by Commissioner Millikan to refer the petition to the City Manager to be checked.
Ayes: (5). Nays: (0). Motion carried.
A LETTER was received from the Building Code Advisory Board, recommending the
City Commissioners adopt and create, by ordinance, certain Fire Zones. A motion was made
by Commissioner Yost, seconded by Commissioner Millikan to accept the recommendation of
the Building Code Advisory Board, and introduce an ordinance for first reading setting out
the Fire Zones and amending Sections 9-(2), 9-(3), and 9-(4), of The Salina Code.
Ayes: (5). Nays: (0). Motion carried.

LETTER from the Building Code Advisory Board, recommending the adoption of the
1970 Edition of the Uniform Building Code, was considered. (Letter was taken under
advisement at the meeting of September 14, 1970) A motion was made by Commissioner
Millikan, seconded by Commissioner Ashton to accept the recommendation of the Building
Code Advisory Board and introduce an ordinance for first reading to adopt the 1970 Edition
of the Uniform Building Code. Ayes: (5). Nays: (0). Motion carried.
ORDINANCE Passed: 17&A4A- 5, 1990 Number: q10%
AN ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an
appropriation for the payment of certain claims." (Payroll - ($85,519.39) A motion was
made by Commissioner Millikan, seconded by Commissioner Ashton to adopt the ordinance as
read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5)
Nays: (0). Mayor approved the ordinance and it is numbered A-1550. Carried.
COMMISSIONER Rundquist mentioned that 3 or 4 months ago, when the meters were
changed from 2 to 6 hours in the west part of Parking Lot # 8, he thought the meters on
the 100 Block of South Eighth Street were designated for all day parking for permit users.
A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to adopt a
Resolution authorizing Parking Permits to be honored at the 2 hour meters in the 100 Block
of South Eighth Street; and also to allow 15 minute parking on the west side of Eighth
Street, north of the mail drop to Iron Avenue, and the following vote was had: Ayes:
Ashton, Millikan, Rundquist, Yost, Caldwell (5). Nays: (0). Mayor approved the Resolution
and it is numbered 3073. Carried.
THE MAYOR, with the approval of the City Commission, reappointed Cecil Beverly
to the Housing Authority for a 4 year term to September 11, 1974.
THE MAYOR said he will be appointing an Arbor Day Committee at the next meeting
On a motion by Commissioner Yost, the Board of Commissioners adjourned.
