Commissioners' Meeting
June 29, 1970
The Regular Meeting of the Board of Commissioners met in the Commissioners'
Room, City -County Building, on Monday, June 29, 1970, at four o'clock p.m.
The Acting Mayor asked everyone to stand for the Pledge of Allegiance to the
Flag, and a Moment of Silent Prayer.
There were present:
Acting Mayor Leon L. Ashton, Chairman presiding
Commissioner Donald D. Millikan
Commissioner Carl R. Rundquist
Commissioner William W. Yost
comprising a quorum of the Board, also:
Ron Barta, Assistant City Attorney
Norris D. Olson, City Manager
D. L. Harrison, City Clerk
Absent:
Mayor Robert C. Caldwell
The Minutes of the Regular Meeting of June 22, 1970, were approved as mailed.
BIDS were received for Job 523 - for sidewalks on the east and west sides of
the 1900 Block of Highland Avenue. (Requested in Petition Numbers 3102 and 3103, which
were filed by Chester A. Beineke on March 12, 1970)

A MOTION was made by Commissioner Rundquist, seconded by Commissioner Millikan to award
the bid to the J. S. Frank Construction Company, subject to the checking of the bids by
the Engineering Department, and to introduce the contract ordinance for first reading.
Ayes: (4). Nays: (0). Motion carried.
Ordinance Passed: Number: 4091
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE ratifying
and confirming a contract with Brown & Brown, Inc., for the construction of certain
improvements in the City of Salina, Kansas, and providing for the issuance of Temporary
Notes to pay the cost thereof, pending the issuance and sale of bonds." (For the
construction of a Sewage Pump Station and Force Main - Job 520 - to serve Upper Mill
Heights Addition Number 2 and the Phil Martin Apartment Project) A motion was made by
Commissioner Millikan, seconded by Commissioner Yost to adopt the ordinance as read and
the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost (4). Nays: (0).
Mayor Caldwell absent. Acting Mayor approved the ordinance and it is numbered 8089.
Carried. Ordinance was introduced for first reading June 22, 1970.
A RESOLUTION was introduced and passed entitled: "A RESOLUTION authorizing
and ordering certain water main improvements, ordering preparation of plans and
specifications, and the estimate of costs." (For the construction of a water main -
Job 522 - to serve Brown & Brown Addition Number 1, which was requested in Petition
Number 3097, filed by Research Products Company and Bromac, Inc., on February 18, 1970)
A motion was made by Commissioner Rundquist, seconded by Commissioner Yost to adopt the
Resolution as read and the following vote was had: Ayes: Ashton, Millikan,Rundquist,
Yost (4). Nays: (0). Acting Mayor approved the Resolution and it is numbered 3063.

AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE
providing for an application to be filed by all persons desiring a license to act as a
bondsman; amending Section 29-23 of The Salina Code and repealing the said original
section." (Providing that an applicant may pledge certificates of deposit, savings
accounts, and Government Bonds for security) A motion was made by Commissioner
Millikan, seconded by Commissioner Yost to amend Section 29-23, subsection (e) to read
as follows: The applicant shall file with this application a current abstract opinion
by a duly qualified attorney at law or an Owner's Policy of Title Insurance, in addition
to a security instrument to the City of Salina, Kansas, on the real property which is to
be pledged by the applicant, which instrument shall be recorded in the Office of the
Register of Deeds of Saline County, Kansas, and certified to the City Clerk." Ayes: (4).
Nays: (0). Motion carried. A motion was made by Commissioner Rundquist, seconded by
Commissioner Millikan to adopt the ordinance as amended, and the following vote was had:
Ayes: Ashton, Millikan, Rundquist, Yost (4). Nays: (0). Mayor Caldwell absent. Acting
Mayor approved the ordinance as amended and it is numbered 8090. Carried. Ordinance
was introduced for first reading June 22, 1970.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE
providing for the qualifications and amount of security which must be provided by any
applicant for a bond license; amending subsection (f) of Section 29-25 of The Salina
Code and repealing said original section." A motion was made by Commissioner Millikan,
seconded by Commissioner Yost to adopt the ordinance as read and the following vote was
had: Ayes: Ashton, Millikan, Rundquist, Yost (4). Nays: (0). Mayor Caldwell absent.
Acting Mayor approved the ordinance and it is numbered 8091. Carried. Ordinance was
introduced for first reading June 22, 1970.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE
limiting the outstanding bail bonds of any person holding a bondsman license under the
providion of Article 2 of Chapter 29 of The Salina Code." (Limit bonding to the actual
value of certificates of deposit, savings accounts, or Government Bonds, and to 75% of
the value of real estate.) A motion was made by Commissioner Rundquist, seconded by
Commissioner Yost to adopt the ordinance as read and the following vote was had: Ayes:
Ashton, Millikan, Rundquist, Yost (4). Nays: (0). Mayor Caldwell absent. Acting Mayor
approved the ordinance and it is numbered 8092. Carried. Ordinance was introduced for
first reading June 22, 1970.
A RESOLUTION was introduced and passed entitled: "A RESOLUTION determining
the policy of the Board of Commissioners of the City of Salina, Kansas, in regards to the
installation of general improvements for undeveloped property within the City." A motion
was made by Commissioner Millikan, seconded by Commissioner Yost to adopt the Resolution
as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost (4).
Nays: (0). Mayor Caldwell absent. Acting Mayor approved the Resolution and it is
numbered 3064. Carried.
The ASSISTANT CITY ENGINEER made a report on the condition of the railroad
crossings, and presented a list and a map of the railroad crossings to the City Commissioners.
A MOTION was made by Commissioner Yost, seconded by Commissioner Millikan to
introduce an ordinance for first reading providing that the railroads repair certain
railroad crossings, and that the repairs be commenced within 30 days, and completed
within 6 months. Ayes: (4). Nays: (0). Motion carried.

A LETTER was received from the Salina -Saline County Health Department concerning
the abatement of the nuisance at 504 South Twelfth Street. The City Manager reported that
there was a fire there some time ago, and the property could be restored by the owners,
if they would. The Health Department wants the City to clean up and spray for bugs, etc.
The Salina Code, Section 15-5, gives authority to clean up & spray and the costs to be
assessed against the property on the tax roll. A motion was made by Commissioner Yost,
seconded by Commissioner Millikan to instruct the City Clerk to advertise for bids to be
received for the general clean-up of the property on July 6, 1970. Ayes: (4). Nays: (0)
Motion carried.
A MOTION was made by Commissioner Millikan, seconded by Commissioner Rundquist
to instruct the City Clerk to advertise for bids for the demolition of 351 East Antrim,
917 North Santa Fe Avenue, and 206 North 2nd Street, to be received on July 13, 1970•
(These structures have been declared uninhabitable under the Minimum Housing Code)
Ayes: (4). Nays: (0). Motion carried.
Estimate # 6 was filed by Floyd Farley for Steven J. Lyon, Golf Course
Contractor, in the amount of $13,337.70. A motion was made by Commissioner Millikan,
seconded by Commissioner Rundquist to approve the estimate. Ayes: (4). Nays: (0).
Motion carried. The City Manager feels the $1,500.00 balance still due Mr. Lyon is
sufficient to cover the cost of repairs to water line breaks, etc.
On a motion by Commissioner Millikan, the Board of Commissioners adjourned.
