Commissioners' Meeting
June 22, 1970
The Regular Meeting of the Board of Commissioners met in the Commissioners'
Room, City -County Building, on Monday, June 22, 1970, at four o'clock p.m.
The Mayor asked everyone to stand for the Pledge of Allegiance to the Flag,
and a Moment of Silent Prayer.
There were present:

Commissioner Leon L. Ashton
Commissioner Donald D. Millikan
Commissioner Carl R. Rundquist
Commissioner William W. Yost
comprising a quorum of the Board, also:

Absent:

The Minutes of the Regular Meeting of June 15, 1970, were approved as mailed.
The Mayor proclaimed the next ten days as "Circle of Safety Days", and June 27,
1970 as Vehicle Safety Check Day, read by Sgt. Herb Clark of the Salina Police Department.
I BIDS were received for Job 520 - for a Sewage Pump Station and Force Main to

serve Upper Mill Heights Addition # 2 and the Phil Martin Apartment Project.

A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to award the
contract to Brown 6 Brown, Inc., subject to the checking of the bids by the Engineering
Department, and to introduce the contract ordinance for first reading. Ayes: (5). Nays:(0)
Motion carried.

HEARING was held, as required by Resolution Number 3061, on Job 522 for a water
main improvement. (To serve Brown & Brown Addition Number 1) There were no protests
filed, written or oral. A motion was made by Commissioner Yost, seconded by Commissioner
Millikan, that the hearings be adjourned. Ayes: (5). Nays: (0). Motion carried.
A RESOLUTION was introduced and passed entitled: "A RESOLUTION determining the
advisability of a water main improvement, estimating the cost thereof, defining the
boundaries of the assessment, and apportioning the cost between the improvement district,
and the City -at -large." A motion was made by Commissioner Yost, seconded by Commissioner
Millikan to adopt the Resolution as read and the following vote was had: Ayes: Caldwell,
Ashton, Millikan, Rundquist, Yost (5). Nays: (0). Mayor approved the Resolution and it
is numbered 3062. Carried. (Job 522)
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing
for the vacation of certain easements in a tract of land located in the Southeast Quarter
of Section 18, Township 14 South, Range 2 West of the 6th Principal Meridian, Saline County,!
Kansas." (Requested in Petition Number 3117 which was filed by Aubrey G. Linville on
June 5, 1970) A motion was made by Commissioner Rundquist, seconded by Commissioner
Ashton to adopt the ordinance as read and the following vote was had: Ayes: Caldwell,
Ashton, Millikan, Rundquist, Yost (5). Nays: (0). Mayor approved the ordinance and it
is numbered 8088. Carried. Ordinance was introduced for first reading June 15, 1970.
A LETTER was received from the Salina City Planning Commission recommending the
approval of the Final Plat of the Replat of Part of Block 2, Westport Exchange Addition.
(Requested in Petition Number 3105 which was filed by Charles W. Walker on April 6, 1970)
A motion was made by Commissioner Rundquist, seconded by Commissioner Millikan to accept
the Salina City Planning Commission recommendation and approve the Final Plat. Ayes: (5).
Nays: (0). Motion carried.

lA LETTER was received from the Salina City Planning Commission recommending the
denial of the renaming of that portion of Shalimar Drive, south of Wayne Avenue, in
Mayfair Addition. (Requested in Petition Number 3116, which was filed by E. W. Yockers
on May 27, 1970) A motion was made by Commissioner Yost, seconded by Commissioner Millikan
to accept the recommendation of the Salina City Planning Commission and deny the petition.
Ayes: (5). Nays: (0). Motion carried.
A LETTER was received from the Salina City Planning Commission recommending the
approval of the request of the petitioner (Mr. Jeff Dahl) to withdraw petition Number 3114
for the rezoning of 501 West Cloud Street to District "D" (Local Business District) which
was filed on May 22, 1970. A motion was made by Commissioner Yost, seconded by Commissione
Millikan to accept the recommendation of the Salina City Planning Commission. Ayes: (5).
Nays: (0). Motion carried.
A REPORT was made by the Ci.ty Engineering Department on Petition Number 3119,
which was filed by Mrs. Lois Herrington on June 12, 1970, for water and sewer mains, and
curbing, guttering, paving and grading of Stimmel Road, from U. S. 81 Highway to Fifth
Street Road. Assistant City Engineer reported that the petition has an insufficient number
of signers. A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton
to refer the petition back to the petitioner. Ayes: (5). Nays: (0). Motion carried.
A MOTION was made by Commissioner Millikan, seconded by Commissioner Yost to
introduce an ordinance for first reading "providing for an application to be filed by all
persons desiring a license to act as a bondsman; amending Section 29-23 of The Salina Code
and repealing the said original section." (providing that an applicant may pledge
Certificates of Deposit, Savings Accounts, and Government Bonds for security) Ayes: (5)
Nays: (0). Motion carried.

A MOTION was made by Commissioner Yost, seconded by Commissioner Millikan to
introduce an ordinance for first reading "providing for the qualifications and amount of
security which must be provided by any applicant for a bond license; amending subsection
of Section 29-25 of The Salina Code and repealing said original section." Ayes: (5).
Nays: (0). Motion carried.

A MOTION was made by Commissioner Ashton, seconded by Commissioner Rundquist
to introduce an ordinance for first reading "limiting the outstanding bail bonds of any
person holding a bondsman license under the provision of Article 2 of Chapter 29 of the
Salina Code." (Limit bonding to the actual value of Certificates of Deposit, Savings
Accounts or Government Bonds, and to 75% of the value of Real Estate) Ayes: (5). Nays:
Motion carried.

PETITION,Number 3121 was filed by Charles R. Frank, protesting the rezoning of
501 West Cloud to District "D" (Local Business District). The City Clerk was instructed
to file the petition.
A CEREAL MALT Beverage License Application was filed by Larry W. Martin, d/b/a
Ritz Lounge, 101 North Broadway. (New). A motion was made by Commissioner Ashton,
seconded by Commissioner Rundquist to approve the license. Ayes: (5). Nays: (0).
Motion carried.
A MOTION was made by Commissioner Millikan, seconded by Commissioner Yost to
instruct the City Attorney to prepare a Resolution regarding special improvements for
undeveloped land, providing that the developer is to pay to the City 50% of the cost of
the improvements in cash, prior to the awarding of the Construction Contract.

A MOTION was made by Commissioner Yost, seconded by Commissioner Millikan to
instruct the City Attorney to prepare an ordinance providing that the Railroads repair
certain crossings within the City Limits, and the Engineering Department to file a report
on the condition of all railroad crossings.
AN ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an
appropriation for the payment of certain claims." (payroll - $88,977.33) A motion was
made by Commissioner Yost, seconded by Commissioner Millikan to adopt the ordinance as read
and the following vote was had: Ayes: Caldwell, Ashton, Millikan, Rundquist, Yost (5).
Nays: (0). Mayor approved the ordinance and it is numbered A-1538. Carried.
On a motion by Commissioner Rundquist, the Board of Commissioners adjourned.
