06-08-1970 MinutesCity of Salina, Kansas Commissioners' Meeting June 8, 1970 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City -County Building, on Monday, June 8, 1970, at four o'clock p.m. The Mayor asked everyone to stand for the Pledge of Allegiance to the Flag, and a Moment of Silent Prayer. There were present: Mayor Robert C. Caldwell, Chairman presiding Commissioner Leon L. Ashton Commissioner Donald D. Millikan Commissioner Carl R. Rundquist Commissioner William W. Yost comprising a quorum of the Board, also CITY." L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None The Minutes of the Regular Meeting of June 1, 1970, were approved as mailed. The Mayor proclaimed the Month of June, 1970 - "YOUTH EMPLOYMENT MONTH FOR THE BIDS were received for Job 524 - Resurfacing Streets for 1970. Part I - Slurry Seal Ballou Construction $36,500.00 Aube] Asphalt, Inc., Hays, Ks. 39,700.00 Engineer's Estimate 37,500.00 Part II - Machine Laid Seal Brown & Brown, Inc. $61,800.00 Rhoads Construction 75,950.00 Aube] Asphalt, Inc., Hays, Ks. 69,335.00 Engineer's Estimate 66,700.00 A motion was made by Commissioner Yost, seconded by Commissioner Rundquist to award the bid to Ballou Construction Company for Part I - Slurry Seal for $36,500.00; and Brown & Brown, Inc., for Part II - Machine Laid Seal for $61,800.00, subject to the approval of the Engineering Department. Ayes: (5). Nays: (0). Motion Carried. The City Engineer filed Plans and Specifications for Job 520 - Pump Station & Force Main Improvements for the Phil Martin Apartment Project and Upper Mill Heights Addition # 2. A motion_was made by Commissioner Millikan, seconded by Commissioner Yost to accept the Plans and Specifications as filed, and instruct the City Clerk to advertise for bids to be received on June 22, 1970. Ayes: (5). Nays: (0). Motion carried. The City Commissioners considered the Appeal made by Harold Chase for Franklin Parks for permission to have a Mobile Home Court in the 600 Block of West Antrim. Commissioner Rundquist said he viewed the property and noticed that there are some nice homes in the area. He felt if the City could be assured that the owner of the Mobile Home Court would keep the appearance of the court up, it may be satisfactory for the area. Commissioner Yost suggested action be delayed until a Mobile Home Court Ordinance is approved. Mr. Chase felt this was unnecessary and that a decision could be made at this time. A motion was made by Commissioner Millikan, seconded by Commissioner Yost that the City Commission uphold the decision of the Board of Zoning Appeals and deny the appeal. Ayes: (2). Millikan, Yost. Nays: (3). Rundquist, Ashton, Caldwell. The Mayor asked if anyone present wanted to speak for or against the Mobile Home Court Appeal. A lady living in the area was against the Mobile Home Court unless restrictions are enacted. The Mayor suggested restrictions be put on the court and voted No. 1 1 Rundquist A Motion was made by Commissioner Y00f, seconded by Commissioner Ashton, that the Mobile Home Court be approved pursuant to the plans as filed, with the approval of the Building Official with restrictions as submitted on the plans, such as: underground I utilities, paved streets, fencing, etc. Ayes: (3). Ashton, Rundquist, Caldwell. Nays: (2). Millikan, Yost. Motion carried. i Mr. John Kippley was present and stated that he read in the newspaper the Salina Municipal Employees' Association was voted down and wondered what action the City Commission would take now. Commissioner Ashton asked Mr. Kippley what his interest # is in the matter. Mr. Kippley replied that he is interested only as a citizen. Commissioner Ashton stated the decision was made by the employees and for the best interest of the City Employees, it should be left as it is, and dropped. Mr. Kippley made suggestions and proposals concerning the Employees' Council, where were to numerous to mention. Mr. Kippley mentioned they (The Firemen) were promised two such proposals. The City Manager stated that at no time did he promise anyone two proposals, and is willing to take a lie detector test, if Mr. Kippley and his group would agree to the same. Mr. Kippley stated he would be free to take a lie detector test concerning the council, but could not speak for the group. Mr. Kippley added that he had visited with Keith Armstrong about the Council and other matters. Chief of Police,John Woody; Fire Chief, James Lacy; and H. J. McCabe, Director of Safety stated that Mr. Kippley does not represent any of the employees in their departments. A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton that no further action be considered in this particular proposal. (Referring to the Salina Municipal Employees' Association). Ayes: (5). Nays: (0). Motion carried. Petition Number 3117 was filed by Aubrey G. Linville, Vice President of the Upper Mill Development Company, Inc., for the vacation of certain easements. A motion was made by Commissioner Millikan, seconded by Commissioner Yost to refer the petition to the Engineering Department for a report back next week. Ayes: (5). Nays: (0). Motion carried. A Merchant Police License Application was filed by Malcolm G. White, d/b/a White's Armored Car Service, 521 Beechwood Road. (Renewal) A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to approve the license. Ayes: (5). Nays: (0). Motion carried. A Merchant Police License Application was filed by Clarence M. Smith, 1120 North Fourth Street. (Renewal) A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to approve the license. Ayes: (5). Nays: (0). Motion carried. The Mayor, with the approval of the City Commissioners, made the following appointments to the Citizens' Advisory Commission: 1. Mr. John Heline 2. Mr. Murray Kizer 3. Mr. Cecil Scroggins The City Attorney mentioned that for a Surety on Bail Bonds License, real estate had to be pledged, and that maybe the ordinance should be amended to include other securiti4s. He stated that he had been asked about pledging a savings account, but it is not permitted under the present ordinance. A motion was made by Commissioner Yost, seconded by Commissioner Millikan to instruct the City Attorney to draft an ordinance with these amendments. Ayes: (5). Nays: (0). Motion carried.
