01-12-1970 MinutesCity of Salina, Kansas Commissioners' Meeting i January 12, 1970 Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City -County Building, on Monday, January 12, 1970, at four o'clock p.m. There were present: Mayor Donald D. Millikan, Chairman presiding Commissioner Leon L. Ashton Commissioner Robert C. Caldwell Commissioner Carl R. Rundquist Commissioner William W. Yost comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None The Minutes of the Regular Meeting of January 5, 1970, were approved as mailed. A letter was received from the Salina City Planning Commission recommending the denial of the rezoning of 122 South Ninth Street, from District "A" (Second Dwelling House District) to District "DD", "D", or "E", requested in Petition. Number 3076, filed by James L Geisendorf on November 19, 1969. Petition Number 3089 was filed in protest of the rezoning by Carl A. Weberg. A motion was made by Commissioner Rundquist, seconded by Commissioner Yost to accept the recommendation of the Salina City Planning Commission and deny the rezoning. Ayes: (5). Nays: (0). Motion carried. A letter was received from the Salina City Planning Commission recommending the approval of the rezoning of the 500 block of South Broadway, from District "A" (Second Dwelling House District) to District "D" (Local Business District), requested in Petition 3079 filed by Laughlins, Inc., W. C. Chaffee, Agent, on November 26, 1969. A motion was made by Commissioner Yost, seconded by Commissioner Ashton to accept the recommendation of the Salina City Planning Commission and approve the petition for rezoning and to introduce an ordinance for first reading. A letter was received from the Salina City Planning Commission recommending the approval of the rezoning of 530 - 536 South Broadway (rear half), from District "A" (Second Dwelling House District) to District "D" (Local Business District), requested in Petition 3080 filed by Melvin Trailer Sales, Inc., W. C. Chaffee Agent, on November 26, 1969. A motion was made by Commissioner Ashton, seconded by Commissioner Rundquist to accept the recommendation of the Salina City Planning Commission and approve the petition for rezoning and to introduce an ordinance for first reading. M. Siler, Siler Agency, on December 3, 1969. A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to accept the recommendation of the Salina City Planning Commission and approve the petition for rezoning and to introduce an ordinance for first reading. Ordinance Passed:,2�Y iso Number: Qo�S A letter was received from the Salina City Planning Commission recommending the approval of the annexation of a tract of land South of Crawford Street, West of Roselawn Memorial Park, and East of the Smoky Hill River, requested in Petition 3085, filed by Max Bishop, Agent for Phil Martin, owner, on December 15, 1969. A motion was made by Commissioner Ashton, seconded by Commissioner Yost to accept the recommendation of the Salina City Planning Commission and approve the petition for annexation and to introduce an ordinance for first reading. W. Saurr and Sons for the construction of sidewalks on the north side of the 600 block of Ralph. (Job 519). Bids were received January 5, 1970. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: � ,�,,� 17 197o Number: %060 A Resolution was introduced and passed entitled: "A RESOLUTION restricting the length of time vehicles may be parked in certain designated areas, in accordance with Ordinance Number 8058." (Central Business District) A motion was made by Commissioner Rundquist, seconded by Commissioner Yost to adopt the Resolution as read and the following vote was had: Ayes: Millikan, Caldwell, Rundquist, Yost (4). Nays: Ashton (1). Mayor approved the Resolution and it is numbered 3045. Carried. I A motion was made by Commissioner Caldwell, seconded by Commissioner Yost to instruct the City Clerk to advertise for bids for the demolition or removal of 19 houses in Edgemere Addition, near Centennial Park, to be received January 26, 1970. Ayes: (5). Nays: (0). Motion carried. A 1970 Cereal Malt Beverage License Application (renewal) was filed by James Norman Martin, d/b/a One Spot Cafe, 316 South Broadway. A motion was made by Commissioner Yost, seconded by Commissioner Ashton to approve the license. Ayes: (5). Nays: (0) Motion carried. A 1970 Cereal Malt Beverage License Application (new) was filed by Mary M. Koberstein, d/b/a Rendezvous, 249 North Santa Fe Avenue. A motion was made by Commissioner - Ashton, seconded by Commissioner Rundquist to approve the license. Ayes: (5). Nays: (0). Motion carried. A 1970 Cereal Malt Beverage License Application (new) was filed by Joseph C. Karc d/b/a The Village Gate Restaurant, 1329 E.Iron. A motion was made by Commissioner Rundquist seconded by Commissioner Ashton to approve the license, subject to the final approval by the Health Department after all facilities have been completed. Ayes: (5). Nays: (0). Motion carried. A 1970 Cereal Malt Beverage License Application (renewal) was filed by Lum's Salina 270 Corporation, Inc., d/b/a Lum's, 1333 West Crawford. A motion was made by Commissioner Yost, seconded by Commissioner Caldwell to approve the license. Ayes: (5). Nays: (0). Motion carried. r, A 1970 Cereal Malt Beverage License Application (new) was filed by Benjamin W. Pegb, for the Hide -a -way, 540 Willis. The City Attorney asked Mr. Pegg if he has been a resident of Salina for the past five years. He said, "Yes". Mr. Pegg is aware of the past problems that have occurred at the Hide -away. A motion was made by Commissioner Rundquist, seconded by Commissioner Caldwell to approve the license. Ayes: Millikan, Caldwell, Rundquist, Yost (4). Nays: Ashton (1). Motion carried. The City Commissioners considered a proposed agreement between the Salina Community Theatre Association and the City of Salina concerning construction of a theatre facility upon City owned property, the operation and maintenance of same, thereafter. A motion was made by Commissioner Yost, seconded by Commissioner Caldwell to approve the agreement and to introduce an ordinance for first reading. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: � O 1 1 A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to introduce an ordinance for first reading pertaining to the procedures for the billing and collection for water service; providing for the discontinuance of service for non payment of bills (pertaining to monthly bills for the irrigation of yards and lawns). Ayes: (5). Nays: (0). Motion carried. (bills - $172,553.13) A motion was made by Commissioner Caldwell, seconded by Commissioner Ashton to adopt the ordinance as read and the following vote was had: Ayes: Millikan, Ashton, Caldwell, Rundquist, Yost (5)1 Nays: (0).
