09-08-1969 Minutes1 1 1 1 I City of Salina, Kansas Commissioners' Meeting September 8, 1969 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City Hall, on Monday, September 8, 1969, at four o'clock p.m. There were present: Mayor Donald D. Millikan, Chairman presiding Commissioner Leon L. Ashton Commissioner Robert C. Caldwell Commissioner Carl R. Rundquist Commissioner William W. Yost comprising a quorum of the Board, also L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None The Minutes of the Regular Meeting of August 25, 1969, were approved as mailed. The Mayor proclaimed the week of September 17 - 23, 1969 - "CONSTITUTION WEEK". A Resolution was introduced for second reading entitled: "A RESOLUTION determining the necessity of and directing that the owner or owners of certain lots construct, in compliance with plans and specifications of the City Engineer, a sidewalk, abutting said lots within 45 days of the adoption and publication hereof and providing that in the event the owner or owners fail to do so, that the City of Salina, shall proceed to construct or cause to be constructed said sidewalk and that the total cost thereof shall be assessed against such lot or lots on which such sidewalk shall abut as other special assessments." (North side of the 600 block of Ralph - requested in Petition # 3057) A motion was made by Commissioner Yost, seconded by Commissioner Caldwell to adopt the Resolution as read and the following vote was had: Ayes: Millikan, Ashton, Caldwell, Rundquist, Yost (5). Nays:(0) Mayor approved the Resolution and it is numbered 3035• Carried. Resolution was introduced` for first reading August 25, 1969 An ordinance was introduced for second reading entitled: "AN ORDINANCE providing for the amendment of Zoning Ordinance Number 6613 and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof." (Lot 1 and the West 1/2 of Lot 2, Block 1, Tucker Park Addition - requested in Petition 3052 filed by Foster McBride on July 8, 1969) A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to adopt the ordinance as read and the following vote was had: Ayes: Millikan, Ashton, Caldwell, Rundquist, Yost (5)• Nays: (0). Mayor approved the Ordinance and it is numbered 8046. Carried. Ordinance was introduced for first reading August 25, 1969. The City Planner reported the estimated cost of preparing a Future Land Use Study I for the C. R. P., is $510.00. A motion was made by Commissioner Yost, seconded by Commissioner Ashton to authorize the study be completed for the estimated cost of $510.00. Ayes: (5)• Nays: (0). Motion carried. i A request was received from Bob and Joyce Frisbie, 801 South Ninth Street, to withdraw their petition # 3059 for rezoning. A motion was made by Commissioner Ashton, seconded by Commissioner Rundquist to accept the letter of withdrawal and notify the Salina City Planning Commission. Ayes: (5). Nays: (0). Motion carried. A Merchant Police License Application was filed by Malcolm G. White, 521 Beechwood d/b/a White's Armored Car Service. A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to approve the application. Ayes: (5). Nays: (0). Motion carried. Petition Number 3062 was filed by August Rehberg for a suitable fence around the roque court in Oakdale Park. A motion was made by Commissioner Caldwell, seconded by Commissioner Yost to refer the petition to the City Manager for checking and a report back at a later date. Ayes: (5). Nays: (0). Motion carried. x-06 Petition Number 3063 was filed by Harriett Shank for the Rezoning of Lots 1, 2, 3, 4, Block 17, Pacific Addition, from District "B" Second Dwelling House District to District "F" Light Industrial District. A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to refer the petition to the Salina City Planning Commission. Ayes: (5)• Nays: (0). Motion carried. A Tree Trimming License Application was filed by Marvin Reinert, 2042 Wesley, d/b/a Reinert Tree Service. A motion was made by Commissioner Yost, seconded by Commissioner Caldwell to approve the license. Ayes: (5). Nays: (0). Motion carried. A motion was made by Commissioner Rundquist, seconded by Commissioner Yost to introduce an ordinance for first reading adopting the 1967 Edition of the Uniform Plumbing Code and all appendices, except as modified by Chapter 9 of The Salina Code, and repealing the original section. Ayes: Millikan, Caldwell, Rundquist, Yost (4). Nays: Ashton (1) Motion carried. Commissioner Ashton questioned whether or not plastic pipe will withstand 15 - 20 years of use. He feels this will be used in lower prices housing and after this length of time will cause trouble in these houses. Ordinance Passed: 1 I5 i9 b9 Number: 90HI Petition Number 3064 was filed by Wallerius, Inc. and Kenneth Nordboe, for the repeal of Section 21-29 of The Salina Code. (Proximity of trailer court to park, public building, hospital, school, college) A motion was made by Commissioner Yost, seconded by Commissioner Caldwell to refer the petition to the Salina City Planning Commission. Ayes: (5). Nays: (0). Motion carried. A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to approve the Workable Program as submitted to the Department of Housing and Urban Development, and to authorize the Mayor to sign. Ayes: (5). Nays: (0). Motion carried. A Resolution was introduced and passed entitled: "WHEREAS, the City of Salina, Kansas, (herein called the "Local Authority") has undertaken the development and administrati of a low rent housing project designated Project No. KANS-38-1 with financial assistance from the United States of America (herein called the "Government") pursuant to a contract between the parties dated as of July 16, 1968 (herein called the "Annual Contributions Contract"); an WHEREAS, it is found necessary to amend the Annual Contributions Contract." A motion was made by Commissioner Yost, seconded by Commissioner Caldwell to adopt the Resolution as read and the following vote was had: Ayes: Millikan, Ashton, Caldwell, Rundquist, Yost (5)• Nays: (0). Mayor approved the Resolution and it is numbered 3036. Carried. A motion was made by Commissioner Yost, seconded by Commissioner Caldwell to authorize the Mayor to sign Contract No. FW -1114 Amendment Number 1 for the Housing Authority with the following changes: The Government's obligation, in the amount of $172,152.00, will remain the same with the above changes. A letter was received from Dan Bolen, Agent for Mildred H. Johnson, Trust, requesting the City release the easement involving part of Block 11 and part of Park # 3, in Leavenworth Addition. (West of US 81 By-pass). A motion was made by Commissioner Caldwell, seconded by Commissioner Rundquist to release the easement as requested. Ayes: (5). Nays: (0). Motion carried. A letter was received from Mrs. Eloise French, d/b/a Radio Cab Company, requesting an additional taxi cab license. A motion was made by Commissioner Caldwell, seconded by Commissioner Yost to grant the request for an additional taxi cab license. Ayes: (5). Nays: (0). Motion carried. A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to refer for one week to ask some members to be present to answer questions pertaining to the finances of the band. The City Manager reported that the City water supply is being fluoridated at the rate of .8 parts per million and will be increased to not to exceed 1 part per million. Samples are being taken from Wilson & Company faucet and tested in their laboratory and are compared with the tests made at the Water Plant Laboratory. These two tests are compari ig very accurately. Statement # 6 was received from Ronald R. Richmond for Architectural contract and inspection services in the amount of $200.00 for Fire Station # 4 at Marymount Road and Crawford Street. A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to approve the statement. Ayes: (5)• Nays: (0). Motion carried. Change Order # 2 was received from Presley Builders, Inc. providing for a wash a rack pit to replace bucket type mud traps, in the amount of $144.00 for Fire Station # 4 at Marymount Road and Crawford Street. A motion was made by Commissioner Ashton, seconded by Commissioner Rundquist to approve the change order. Ayes: (5). Nays: (0). Motion Carried. i i An ordinance was introduced and passed entitled: "AN ORDINANCE making an appropriation for the payment of certain claims." (bills - $1,147,149.33) A motion was made by Commissioner Yost, seconded by Commissioner Ashton to adopt the ordinance as read and the following vote was had: Ayes: Millikan, Ashton, Caldwell, Rundquist, Yost (5)• k Nays: (0).
