08-25-1969 MinutesCity of Salina, Kansas Commissioners' Meeting August 25, 1969 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City Hall, on Monday, August 25, 1969, at four o'clock p.m. _ There were present: Mayor Donald D. Millikan, Chairman presiding. Commissioner Leon L. Ashton Commissioner Robert C. Caldwell Commissioner Carl R. Rurdquist Commissioner William W. Yost rising a quorum of the Board, also: Ronald Barta, Assistant City Attorney Norris Olson, City Manager D. L. Harrison, City Clerk Absent: L. 0. Bengtson, City Attorney The Minutes of the Regular Meeting of August 18, 1969, were approved as mailed. An ordinance was introduced for second reading entitled: "AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of constructing Lateral Sanitary Sewer District Numbers 507 & 508, and relating to and providing for the collection and payment of such assessments." (Job 467 - Laterals on Prospect and North Fifth Streets). A motion was made by Commissioner Yost, seconded by Commissioner Rundquist to adopt the ordinance as read and the following vote was had: Ayes: Millikan, Ashton, Caldwell, Rundquist, Yost (5). Nays: (0i. Mayor approved the ordinance and it is numbered 8039. Carried. Ordinance was introduced for first reading August 18, 1969. i An ordinance was introduced for second reading entitled: "AN ORDINANCE relating to the curbing, guttering, paving and grading of Anderson Avenue (Thirty-three (33) feet wide from back of curb to back of curb) from a point 25 feet east of the west line of Lot ll, Block 5, College View Addition to the east line of Third Street, and the paving with concretes (T enty-eight (28) feet wide from toe of gutter to toe of gutter) from the east line of Fourth Street to a point which is 25 feet east of the west line of Lot 11, Block 5, College View Addition; the resurfacing of Country Club Road with hot mixed asphalt (Twenty-nine (29) feet wide from face of curb to edge of pavement from the west line of Marymount Road 1,908 j feet, more or less, to the west line of Overhill Road; the curbing, guttering, paving and grading of North Thirteenth Street with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the south line of Pacific Avenue north 335 feet, and relating to and providing for the collection and payment of such assessments." (Job 495 - Miscellaneous Streets). A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to adopt the ordinance as read and the following vote was had: Ayes: Millikan, Ashton, Caldwell, Rundquist, Yost (5). An ordinance was introduced for second reading entitled: "AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and pieces of ground in tha City of Salina, Kansas, to pay the cost of constructing Lateral Sanitary Sewer District 50), and relating to and providing for the collection and payment of such assessment." (Job 50(p Lateral Sanitary Sewer on Wayne Avenue). A motion was made by Commissioner Ru dquist, seconded by Commissioner Yost, to adopt the ordinance as read and the following vo e was had: Ayes: Millikan, Ashton, Caldwell, Rundquist, Yost (5). An ordinance was introduced for second reading entitled: "AN ORDINANCE levying as essments on lots, pieces and parcels of ground in the City of Salina, Kansas, for the purpose of paying a portion of the cost of: A Sanitary Sewer to serve the comfort station in Thomas Park and extended to Euclid Avenue where a sewer will be constructed to serve Tucker Park Addition. (Job 467)! (establishing rules and regulations for construction, alteration, etc.) A motion was made by Commissioner e Caldwell, seconded by Commissioner Yost to adopt the ordinance as read and the following vote was had: Ayes: Millikan, Ashton, Caldwell, Rundquist, Yost (5). Nays: (0). Mayor approved the ordinance and it is numbered 8043. Carried. Ordinance was introduced for first reading August 18, 1969• An ordinance was introduced for second reading entitled: "AN ORDINANCE amending Section 9-25 of The Salina Code, and repealing the original section." (establishing a minimum fee of $3.00 for building permit). A motion was made by Commissioner Ashton, seconded by Commissioner Rundquist to adopt the ordinance as read and the following vote was had: Ayes: Millikan, Ashton, Caldwell, Rundquist, Yost (5). Nays: (0). Mayor approved the ordinance and it is numbered 8044. Carried. Ordinance was introduced for first reading August 18, 1969. An ordinance was introduced for second reading entitled: "AN ORDINANCE amending Section 9-27 of The Salina Code, and repealing the original section." (design calculations) A motion was made by Commissioner Caldwell, seconded by Commissioner Yost to adopt the ordinance as read and the following vote was had: Ayes: Millikan, Ashton, Caldwell, Rundquist, Yost (5). Nays: (0). Mayor approved the ordinance and it is numbered 8045. Carried. Ordinance was introduced for first reading August 18, 1969. City Engineer reported on Petition 3057, filed by Robert H. Teske on August 12, 1969, for installation of a sidewalk on the north side of the 600 block of Ralph Street. The City Engineer reported that 770 of the property owners signed the petition. A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to approve the petition and to introduce a Resolution for first reading determining the necessity of the sidewalk. Resolution Passed: ,� $�19(oi Number: 3035 A letter was received from the Salina City Planning Commission recommending the approval of the rezoni.ng of Lot 1, and the West 1/2 of Lot 2, Block 1, Tucker Park Addition, requested in Petition Number 3052, filed by Foster McBride on July 8, 1969. A motion was made by Commissioner Yost, seconded by Commissioner Rundquist to accept the recommendation of the Salina City Planning Commission and approve the rezoning and to introduce the rezoning ordinance for first reading. Ayes: (5)• Nays: (0). Motion carried. Ordinance Passed: 1. 19109 Number: qCA A letter was received from the Salina City Planning Commission recommending the denial of the rezoning of Lots 1, 2, 3, 4, 5, 6, Block 6, Meadowlark Acres Addition, requested in Petition Number 3055, filed by Raymond E. Haggart, Trustee of Jack Leslie Gebhart and Gary Charles Gebhart Trust # 2, on July 25, 1969. A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to accept the recommendation of the Salina City Planning Commission and deny the petition. Ayes: (5). Nays: (0). Motion carried. A letter was received from the Salina City Planning Commission recommending the approval of the Final Plat of Interstate District South of 1-70, filed by C. L. Clark. A motion was made by Commissioner Ashton, seconded by Commissioner Yost to accept the Salina City Planning Commission recommendation and approve the final plat. Ayes: (5)• Nays: (0). Motion carried. A letter was received from the Salina City Planning Commission regarding YMCA Parking Lot. A motion was made by Commissioner Yost, seconded by Commissioner Rundquist, to adopt the recommendations of the Salina City Planning Commission. Ayes: (5). Nays: (0) Motion carried. A letter was received from the Salina City Planning Commission recommending that a new Future Land Use Plan for the City be developed by a professional consultant, in conjunction with the Community Renewal program. A motion was made by Commissioner Rundquis seconded by Commissioner Yost to instruct the City Planner to prepare more information as t cost, time involved and specific area involved. Ayes: (5). Nays: (0). Motion carried. A Resolution was introduced and passed entitled: "WHEREAS, UNION PACIFIC RAILROAD COMPANY has tendered to the City of Salina, State of Kansas, an agreement extending to and including October 19, 1974, the term of contract dated October 20, 1959, covering a drainag ditch and a flood control levee on right of way of the Railroad Company's Plainville Branch near Salina, Kansas; said agreement being identified as Railroad Company's C.D.No.43132-7-" A motion was made by Commissioner Yost, seconded by Commissioner Ashton to adopt the Resolution as read and the following vote was had: Ayes: Millikan, Ashton, Caldwell, Rundquist, Yost (5)• Nays: (0). Mayor approved the Resolution and it is numbered 3034. Carried. Z Petition Number 3061 was filed by King Food Host for the approval of the Preliminary Plat of a tract of land at the junction of U. S. 81 and South Ninth Street. A motion was made by Commissioner Rundquist, seconded by Commissioner Yost to refer the Preliminary Plat to the Salina City Planning Commission. Ayes: (5). Nays: (0). Motion carried. The Mayor, with the approval of the Commissioners, made the following appointment Electricians Examining Board John Snedker, Master, reappointed for a 2 year term to July 24, 1971. Duane Chapman, Mechanical Engineer, reappointed for a 2 year term to July 24, 1971. John Wickersham, Journeyman, reappointed for a 2 year term to July 24, 1971 Kline Whitaker, Electrical Inspector, reappointed for a 2 year term to July 24, 1971. Jack Gill, Master, appointed to succeed Robert F. Johnson for a 2 year term to July 24, 1971. Lawrence Hammond, Journeyman, appointed to succeed Stanley Swander for a 2 year term to July 24, 1971. The Mayor, with the approval of the Commissioners, has designated the Plumbers Examining Board as the Plumbers and Gas Fitters Examining Board, with the appointment of Robert Lange, Building Official, to replace Laverne Turner until May 1, 1971. The Mayor recognized the other two members of the Board, who are, Clifford Johnson, Master plumber whose term expires May 1, 1971, and Robert Parker, Journeyman plumber, whose term expires May 1, 1970. The City Manager reported on Lighting in City Parking Lots. Kansas Power S Light Company has recommended the installation of 49 lights in the lots. It is recommended to install 18 lights on existing poles and to see if this might be adequate. A motion was made by Commissioner Caldwell, seconded by Commissioner Rundquist to authorize the City Manager to have the lights installed as proposed. Ayes: (5). Nays: (0). Motion carried. Estimate # 1 for Fire Station # 4 at Marymount and Crawford, was filed by Presley Builders, Inc., in the amount of $14,894.00. A motion was made by Commissioner Ashton, seconded by Commissioner Rundquist to approve the estimate. Ayes: (5). Nays: (0). Motion carried.
