RESOLUTION NUMBER 98-5262
A RESOLUTION AUTHORIZING AND ORDERING CERTAIN WATER
MAIN SERVICE IMPROVEMENTS ON STATE STREET BETWEEN BROADWAY
BOULEVARD AND THE VACATED ORANGE STREET; ORDERING PREPARATION
OF PLANS AND SPECIFICATIONS AND THE ESTIMATE OF COSTS;
AUTHORIZING THE TEMPORARY FINANCING OF SUCH IMPROVEMENTS BY
THE ISSUANCE OF TEMPORARY NOTES; AND STATING THAT THE CITY
INTENDS TO REIMBURSE ITSELF FOR CAPITAL EXPENDITURES INCURRED IN
CONNECTION WITH THE IMPROVEMENTS.
WHEREAS, a petition was filed with the City Clerk on the 23rd day
of February, 1998, proposing certain water main and service improvements on
State Street between Broadway Boulevard and the vacated Orange Street; and
WHEREAS, the Board of Commissioners did on the 16th day of March,
1998, find such petition to be sufficient; and
WHEREAS, the Board of Commissioners did on the 16th day of
March, 1998, duly adopt a resolution finding it advisable to make the
aforementioned improvements under the provisions of Chapter 12, Article 6a of
the Kansas Statutes Annotated.
NOW, THEREFORE, be it resolved by the Governing Body of the
City of Salina, Kansas:
Section 1. That subject to the provisions of Resolution Number
89-4066 establishing a development policy for the financing of public
improvements within the City of Salina, the following improvements are hereby
authorized and ordered to be made in accordance with the findings of the
Board of Commissioners:
The installation of water main on State Street between Broadway
Boulevard and the vacated Orange Street to benefit Blocks 1, 2, 3,
4 and the east 1/2 of Blocks 5 and 7, Elm Grove Addition; Block 1 and
the north 1/2 of Block 10, Leavenworth Addition; and also an unplatte<
tract on the south side of State Street located in the N.W. 1/4,
Section 14, Township 24 South, Range 3 West all in the City of Salina,
Saline County, Kansas.
Section 2. The estimated and probable cost of such improvement
is $36,040.00.
Section 3. The improvement district is:
Benefit District A: Lots 1 through 9, Block 1; Lots 1 through 9,
Block 2; Lots 1 through 18, Block 3; Lots 1 through 18, Block 4;
Lots 1 through 10, Block 5; and Lots 1 through 9, Block 6, all in
Elm Grove Addition to the City of Salina, and
Benefit District B: Lots 1 through 7, Block 1 and the N 1/2 of Block
10, Leavenworth Addition to the City of Salina and the following
described unplatted tract located in the N.W. 1/4 of Section 14,
Township 14 South, Range 3 West: Beginning ata point on the south
right-of-way line of State Street that is 35 feet west of the N.W.
corner of Lot 1, Leavenworth Addition to the City of Salina; thence
492 feet west along said south right-of-way line; thence south 602.5
feet; thence east 492 feet to a point 35 feet west of the west line of
Block 10, said Leavenworth Addition; thence north 602.5 feet to the
point of beginning. Said unplatted tract contains 6.805 acres, more
or less.
Section 4. The method of assessment shall be that 100% of the
total cost assessed against the property for water main improvements shall be
based on adjusted front footage for each lot in Benefit District A and based
upon area of each lot and unplatted tract in Benefit District B, without regard
to buildings or improvements of the land for each lot.
Section 5. The proposed apportionment of cost between the
improvement district and the city -at -large is:

1. The costs assessed against the improvement district shall be:
100% of the total cost of 6" water mains, fittings, hydrants,
valves and any incidentals thereto to complete the water system;
2. The costs chargeable to the City are: 100% of the cost for the
over sizing of the pipeline from a 6" to 10" line to enhance the
City's future water distribution system.
Section 8. That the City Engineer be and is hereby directed and
ordered to prepare plans and specifications, and estimates of the cost of said
improvements.
Section 9. That for the purpose of providing funds to pay the
cost of such improvements until bonds can be issued therefore, the Mayor and
City Clerk be and they are hereby authorized to execute temporary notes for
the City of Salina, Kansas, as provided by K.S.A. 10-123 and 12-6a04, not to
exceed the aggregate provided by law. Such temporary notes may be issued by
Resolution from time to time as required during the progress of the work on the
improvements herein recited. Such temporary notes shall be in the form and
executed as provided by law.
Section 10. That the City Clerk is hereby authorized and directed
to make progress payments to the contractors for materials furnished and for
labor performed under the contract when estimates therefore are presented to
him which have been properly certified by the City Engineer, so long as the
aggregate payments do not exceed the total contract price.
Section 11. That the City expects to incur capital expenditures
on and after the date of adoption of this Resolution (the "Expenditures") in
connection with such improvements, and intends to reimburse itself for such
Expenditures with the proceeds of said bonds or temporary notes in an amount
which, depending on the date of issuance of said bonds or temporary notes,
may aggregate a maximum of $36,040.00, the anticipated cost of such
improvements.
Section 12. This resolution shall take effect after its passage and
publication once in the official city newspaper.
Adopted and passed this 6th day of April, 1998.

Section 6.
The assessment with
accrued interest shall be levied as
a special
tax upon the property included within the benefit district concurrent
with the
general property taxes and shall be
payable in ten (10) equal annual
installments.
Section 7.
That the governing
body expresses its intent to
authorize
a delay in
the payment of special
assessments pursuant to K.S.A.
12-6,110
for those
qualifying properties
within the improvement district
described
above.
Section 8. That the City Engineer be and is hereby directed and
