Regular Meeting of the Board
of Commissioners
December 16, 1974
The Regular Meeting of the Board of Commissioners met in the
Commissioners' Room, City -County Building, on Monday, December 16, 1974, at
four o'clock P.M.
The Mayor asked everyone to stand for the pledge of allegiance to the
Flag and a moment of silent prayer.
There were present:

The Minutes of the Regular Meeting of December 9, 1974 were approved
as printed.

STAFF AGENDA
BIDS WERE RECEIVED for the elevator in the Police Administration
Montgonery Elevator Company, Wichita, Kansas $26,602.00
Otis Elevator Company, Kansas City, Missouri 27,880.00
Engineer's Estimate 30,000.00
A motion was made by Commissioner Losik, seconded by Commissioner Caldwell to
accept the bid of Montgomery Elevator Company, in the amount of $26,602.00,
providing it meets the specifications. Ayes: (4). Nays: (0). Motion carried.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE
prescribing the corporate limits of the City of Salina, Kansas, including land
described in Ordinance Numbers 8336, 8340, 8372, and repealing Ordinance Number
8324." A motion was made by Commissioner Weisgerber, seconded by Commissioner
Losik to adopt the ordinance as read and the following vote was had: Ayes:
Caldwell, Losik, Weisgerber, Usher (4). Nays: (0). Commissioner Cooper absent.
Carried. The Mayor approved the ordinance and it is numbered 8404. The ordinan
was introduced for first reading December 9, 1974.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE
providing for the amendment of Zoning Ordinance Number 6613 and the Zoning
District Map therein and thereby adopted and providing for the rezoning of
certain property within the City and prescribing the proper uses thereof."
(For the rezoning of the East 362.69 feet of Lot 7, Block 2, and all of Blocks
4, 5, 7, 8, and 10, Georgetown Addition from District "A" (Second Dwelling House
District) to District "C" (Apartment District). A motion was made by Commissione
Caldwell, seconded by Commissioner Losik to adopt the ordinance as read and the
following vote was had: Ayes: Caldwell, Losik, Weisgerber, Usher (4). Nays: (0)
Commissioner Cooper absent. Carried. The Mayor approved the ordinance and it is
numbered 8405. The ordinance was introduced for first reading March 11, 1974.

A LIST OF SEVENTY-TWO cereal malt beverage license applications for
1975 was considered by the Board of Commissioners. There were 70 renewals and
2 new applications, all of which have been approved by the Zoning Officer, Health
Department and the Police Department, with the exception of Twin Oaks, which is
a new application and requests approval subject to the final approval of the
Health Department.
The City Clerk reported all restaurants in District "D" have filed the
necessary statement regarding the percentages of their business which is from the
1 11 sale of beer.
A motion was made by Commissioner Caldwell, seconded by Commissioner
Losik to approve the cereal malt beverage license applications and authorize the
City Clerk to issue the licenses, with the exception of Twin Oaks which is
approved subject to the final approval of the Health Department, and the City
Clerk be authorized to issue that license at that time. Ayes: (4). Nays: (0).
Motion carried.
A LETTER was received from the Building Code Advisory Board recommendin
the adoption of the 1975 National Electrical Code. A motion was made by
Commissioner Weisgerber, seconded by Commissioner Caldwell to accept the
recommendation of the Building Code Advisory Board and introduce an ordinance for
first reading adopting the 1975 Edition of the National Electrical Code.
Ayes: (4). Nays: (0). Motion carried.

A LETTER was received from the Building Code Advisory Board recommendin
the increase in permit fees.
Mr. Harris commented, "The staff does concur with the Building Code
Advisory Board's recommendation for the increase of the permit fees. The Food
Handlers Permit was not considered by the Building Code Advisory Board, but the
staff recommends this permit be increased from $7.50 to $10.00."
A motion was made by Commissioner Caldwell, seconded by Commissioner
Losik to accept the recommendation of the Building Code Advisory Board to increas
the permit fees, including the Food Handlers Permit. Ayes: (4). Nays: (0).
Motion carried.
Ordinances Passed: Numbers:
A MOTION was made by Commissioner Losik, seconded by Commissioner
Weisgerber to introduce an ordinance for first reading appropriating money from
the various funds to pay payrolls and claims against the City of Salina, Saline
County, Kansas, for the calendar year of 1975, as provided in Kansas Statutes
Annotated 13-2601. Ayes: (4). Nays: (0). Motion carried.

COMMISSION AGENDA
"APPROVAL of the Woods and Durham Audit Contract". (Sponsored by
Mayor Usher).
Mayor Usher explained there are two contracts involved, one of the
City accounts and records in the amount of $7,200.00, and the second of Revenue
Sharing at an estimated cost of $600.00.
A motion was made by Commissioner Losik, seconded by Commissioner
Caldwell to approve the audit contracts and authorize the Mayor to sign.
Ayes: (4). Nays: (0). Motion carried.

A MOTION was made by Commissioner Losik, seconded by Commissioner
Weisgerber to place a letter of intent to extend the term of the Memorandum of
Agreement and to issue Industrial Revenue Bonds in the amount of $9,000,000 for
General Battery Corporation on the agenda for consideration. Ayes: (4).
Nays: (0). Motion carried.
A RESOLUTION was introduced and passed entitled: "WHEREAS, General
Battery Corporation, a Pennsylvania Corporation, (the "Company") and the City of
Salina, Kansas, (the "City") entered into a Memorandum of agreement dated
January 7, 1974, under which the City has agreed to issue and sell its Industrial
Revenue Bonds in the amount not to exceed $9,000,000 (the "Bonds") to pay the
cost of an industrial project as defined in that Agreement,..." A motion was
made by Commissioner Losik, seconded by Commissioner Weisgerber to adopt the
Resolution as read and the following vote was had: Ayes: Caldwell, Losik,
Weisgerber, Usher (4). Nays: (0). Commissioner Cooper absent. The Mayor
approved the Resolution and it is numbered 3218.
A MOTION was made by Commissioner Losik, seconded by Commissioner
Caldwell to place a resolution of intent to issue $1,250,000 of Industrial
Revenue Bonds for G and K, Inc., d/b/a Shalimar Plaza Nursing Home, on the agenda
for consideration. Ayes: (4). Nays: (0). Motion carried.
A RESOLUTION was introduced and passed entitled: "WHEREAS, the City of
Salina, Kansas, hereinafter sometimes referred to as the "City", desires to
promote, stimulate and develop the general economic welfare and prosperity of
the State of Kansas; and ..." A motion was made by Commissioner Losik, seconded
by Commissioner Weisgerber to adopt the Resolution as read and the following vote
was had: Ayes: Caldwell, Losik, Weisgerber, Usher (4). Nays: (0). Commissioner
Cooper absent. Carried. The Mayor approved the Resolution and it is numbered
3219.
PUBLIC AGENDA
PETITION NUMBER 3462 was filed by Jerry Knowles for the approval of
the preliminary plat of Loyd Addition. A motion was made by Commissioner
Weisgerber, seconded by Commissioner Losik to refer the petition to the City
Planning Commission. Ayes: (4). Nays: (0). Motion carried.
PETITION NUMBER 3463 was filed by Grace Igo for the installation of
water main on VanHorne Street from Ohio Street to the east line of Block 15,
Fairway Addition to serve Lots 1 through 15. A motion was made by Commissioner
Caldwell, seconded by Commissioner Losik to refer the petition to the City
Engineer for a report. Ayes: (4). Nays: (0). Motion carried.
A LETTER was received from the North Salina Businessmen's Association
regarding water supply to North Salina.
Mr. Ben Vidricksen was present and commented, "We of the North Salina
Businessmen's Association feel, and it has been brought to our attention on
numerous occasions by insurance companies that the water pressure in North
Salina is not adequate for fighting fires, and so forth. We don't know at the
present time what progress is being made on this or if the city has studied it
or if the city is aware that this problem exists. The other members here might
want to express their feelings about this also, but we feel as though we don't
have the proper water pressure to say for instance fight the fire. About a year
and a half ago we had a study for a new fire station in North Salina and we find
it wouldn't do any good if you did have a new fire station in North Salina
because of the fact that you wouldn't have the pressure to fight the fire anyway,
so it wouldn't do any good. This was the controversy of the railroad tracks
stopping the fire trucks, but at this particular time we feel like we are not
properly represented by the water pressure, so this is our complaint, and we
would like some kind of action by the City."

Mr. R. J. Meier, Salina White Trucks said, "Salina White Trucks is
putting up a new building at 2552 North 9th and I am concerned with the insurance
amount for fire protection when I get this new facility. The problem is, we have
a 9 class rating which will make my premium $10,815.00 a year, whereas in a
class 5 it would be $4,384.00. There is a difference of six thousand dollars a
year in premium for fire insurance. I contacted Mr. Boyer on October 10th to
find what could be done so I could get a 5 or 6 class rating, but as yet I
haven't heard for him, but I am very concerned this is costing a lot more money.
What could be done to get more pressure up there, so I can get the premium reduce
Mr. Harry Steele said, "I am not sure what has been said prior to this
but I think between Thomas Park and 2 miles north there and on Diamond Drive is
some eight to ten million dollars of insurable property in that area, and I know
a new loop on Fifth Street out there would decrease our rates considerably on
insurance and give us fire protection. I am wondering, and I know you have looke
at it before, if it now couldn't be put in under a grant on Fifth Street and then
as the people wanted or needed water and wanted to hook on, then they pay their
share rather than being assessed against the Fifth Street property now? I would
certainly appreciate you looking into this, and I think we need this additional
water."
Mr. Bill Wise, Mid America Inn Motel was present and commented, "We
are rated in the 7th class zone up there, with a new water loop we would
automatically go to a 5th class zone which would decrease our insurance premium
$1.75 per thousand."
Col. Keith Duckers, St. John's Military School, said, "I am concerned
about the reduction in insurance rates, but I am even more concerned about lives
because I have close to 200 boys that I am concerned with their welfare. We have
some fairly old buildings and they are not as fireproof as I would like for them
to be. I am very interested that a study be made to see that there is adequate
pressure to fight a fire."
Commissioner Weisgerber said, "I am aware of your problem. I think the
severe problem probably does lie further out that the old city limits of Salina.
I think out where White is and in that intersection and just immediately south
of that, but there have been studies made of this and they have been somewhat
updated. I would like to make a motion that we refer this to both the City
Engineer and the Water Department to get a map that would somewhat show this and
give both us and the people involved in this, kind of an idea what the situation
is in general."
After some discussion a four week time was established for a report
and the North Salina Businessmen's Association was asked to provide all the input
it could from the owners in the area where the insurance companies have given
them information about the water pressure and insurance classes.
Commissioner Caldwell seconded the motion. Ayes: (4). Nays: (0).
Motion carried.
A MOTION was made by Commissioner Caldwell, seconded by Commissioner
Losik that the Regular Meeting of the Board of Commissioners be adjourned.
