08-05-1974 Minutes217 City of Salina, Kansas Regular Meeting of the Board of Commissioners August 5, 1974 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City -County Building, on Monday, August 5, 1974, at four o'clock P.M. The Mayor asked everyone to stand for the pledge of allegiance to the Flag and a moment of silent prayer. There were present: Mayor W. M. Usher, Chairman presiding Commissioner Robert C. Caldwell Commissioner Norma G. Cooper Commissioner Mike Losik, Jr. Commissioner Jack Weisgerber comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None Mayor Usher called for the approval of the Minutes of the Regular Meeting of July 29, 1974. Commissioner Cooper said, "I'd like to have an addition to the minutes. First page, last paragraph, concerning the East Crawford Study. I believe the City Engineer stated during that discussion that if the City should ever decide, in the future to widen that to four lanes that there would be sufficient right- of-way and additional property would not have to be acquired. Is that correct, Dean?" Mr. Boyer replied, "That is correct." Commissioner Cooper said, "I don't know if those were his words, but it was certainly that kind of a fact he was giving us and I would like to have that included in the minutes." The Minutes of the Regular Meeting of July 29, 1974 were approved as amended. THE MAYOR read a proclamation welcoming the 58th Bomb Wing Association to Salina for their 30th Anniversary Reunion. STAFF AGENDA A PUBLIC HEARING was held on the 1975 proposed budget for the City of Salina, Kansas. Mayor Usher asked for comments, inquiries, or questions from the people in the audience. There were none. Mayor Usher asked for comments from the bench. There were none. A motion was made by Commissioner Weisgerber, seconded by Commissioner Caldwell to approve the 1975 Budget. 218 The City Manager explained the necessity of holding a special public hearing for the 5th Entitlement Revenue Sharing Funds, and suggested August 19, 1974 as the date for a public hearing. A MOTION was made by Commissioner Losik, seconded by Commissioner Weisgerber to add the item to the agenda for consideration and to set August 19, 1974 as the date for a public hearing for Revenue Sharing Funds, and to instruct the City Clerk to publish a legal advertisement in the official city newspaper. Ayes: (5). Nays: (0). Motion carried. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE ratifying and confirming a contract with Smoky Hill, Inc. for the construction of certain improvements in the City of Salina, Kansas, and providing for the issuance of temporary notes to pay the cost thereof, pending the issuance and sale of bonds." (Engineering Project 74-571 for improvements in Key Acres Addition Number 2 and Upper Mill Heights Addition Number 2). A motion was made by Commissioner Caldwell, seconded by Commissioner Losik to adopt the ordinance as read and the following vote was had: Ayes: Caldwell, Cooper, Losik, Weisgerber, Usher (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered 8360. The ordinance was introduced for first reading July 29, 1974. A MOTION was made by Commissioner Weisgerber, seconded by Commissioner Cooper to introduce an ordinance for first reading providing for the construction of certain sidewalks, for the payment of the cost thereof, and how the same shall be assessed and the manner of the payment therefor. (Sidewalks on Wayne, Key, Hartland, Kirwin, Edward) Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: A MOTION was made by Commissioner Cooper, seconded by Commissioner Losik to introduce an ordinance for first reading levying special assessments against certain lots and pieces of property to pay the cost of cutting weeds on certain lots and parts of lots and parkways abutting thereon in the City of Salina, Kansas. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: A MOTION was made by Commissioner Losik, seconded by Commissioner Caldwell to introduce an ordinance for first reading levying special assessments against certain lots and pieces of property to pay the cost of abatement of nuisances, located on certain lots and parts of lots in the City of Salina, Kansas. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: Commissioner Cooper said, "If no one else has any comments, I do. A public hearing without much public can be likened to our proposed budget. It was never just a proposal, it was always a finished product. Words are something you can't believe, nor should you always believe what you are told. Ask any elected official and they will gladly tell you. Your golden rule is effeciency and economy for your tax dollars, and the current guilty party for increasing cost is not them, but inflation. Well, I submit one of the prime causes of inflation is government spending. Any taxing unit of government will never voluntarily reduce spending, regardless of the words, regardless of what you are told. The only effective way of reducing budget is through public opinion. You need not ask government to spend. We will; but you must speak loudly and clearly when you have had enough. Maybe that is how we get the expression, say 'Uncle'. In the mean time, until someone says something, you can believe one simple fact, you do get the bill." Mayor Usher called for a vote on the motion. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: THE CITY ENGINEER reported on Petition Number 3429 which was filed by Presley Builders, Inc., for water, sanitary sewer, and street improvements in Country Club Estates Addition Number 2, that Presley Builders, Inc. owns 100% of the property in the Country Club Estates Addition Number 2, and therefore the petition is valid and recommended the Engineering Department proceed with a feasibility report on the improvements as requested; and that Resolution 3113 would apply to any improvements installed or constructed under this petition. A motion was made by Commissioner Cooper, seconded by Commissioner Losik to accept the City Engineer's report as filed. Ayes: (5). Nays: (0). Motion carried. THE CITY ENGINEER reported on Petition Number 3434 which was filed by W. E. Enlow for the APCO Oil Corporation requesting the construction of a sanitary sewer line to serve their property at 1900 South Ninth Street, that the nearest sanitary sewer line available to this property is in the Charlotte Street right-of-way which is approximately 240 feet east of the center line of South Ninth Street. It would cost approximately $7,200.00 to bring a public sanitary sewer line to this property. APCO would be expected to pay this assessment plus the cost of their service line from the Ninth Street right-of-way to their building. "We will inform the APCO Oil Corporation of the above mentioned costs by mailing them a copy of this report. If the cost involved is favorable for their purposes, we would recommend this installation." A motion was made by Commissioner Losik, seconded by Commissioner Caldwell to accept the City Engineer's report as filed. Ayes: (5). Nays: (0). Motion carried. None 1 COMMISSION AGENDA PUBLIC AGENDA PETITION NUMBER 3442 was filed by Norman R. Harris, M. D. for the rezoning of the South 2 of Lot 6 on 7th Street, the North 38-3/4 feet of Lot 8 on 7th Street, and the South 38-3/4 feet of the North z of Lot 8 on 7th Street, Hollands Addition from District "C" (Apartment District) to District "DD" (Office District). A motion was made by Commissioner Weisgerber, seconded by Commissione Losik to refer the petition to the City Planning Commission. Ayes: (5). Nays: Motion carried.
