06-03-1974 MinutesCity of Salina, Kansas Regular Meeting of the Board of Commissioners June 3, 1974 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City -County Building, on Monday, June 3, 1974, at four o'clock P.M. The Mayor asked everyone to stand for the pledge of allegiance to the Flag and a moment of silent prayer. There were present: Mayor W. M. Usher, Chairman presiding Commissioner Robert C. Caldwell Commissioner Norma G. Cooper Commissioner Mike Losik, Jr. Commissioner Jack Weisgerber comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None mailed. The Minutes of the Regular Meeting of May 20, 1974 were approved as STAFF AGENDA BIDS were received for 9 police vehicles: Long -McArthur, Inc. $33,976.00 A motion was made by Commissioner Caldwell, seconded by Commissioner Losik to accept the bid of Long -McArthur, Inc., in the amount of $33,976.00 for 9 police vehicles. Ayes: (5). Nays: (0). ,lotion carried. AN ORDINANCE was introduced for second reading entitled: 11AN ORDINANCE ratifying and confirming a contract with J. S. Frank Construction Company for the construction of certain improvements in the City of Salina, Kansas, and providing for the issuance of temporary notes to pay the cost thereof, pending the issuance and sale of bonds." (Engineering Project 74-569 Part I for Water and Sanitary Sewer Improvements in Bonnie Ridge Addition) A motion was made by Commissioner Weisgerber, seconded by Commissioner Caldwell to adopt the ordinance as read and the following vote was had: Ayes: Caldwell, Cooper, Losik, Weisgerbe , Usher (5). Nays: (0). Carried. The Mayor approved the Ordinance and it is numbered 8352. The ordinance was introduced for first reading May 20, 1974. (Engineering Project 74-569 Part II for storm sewer and pavement improvements in Bonnie Ridge Addition) A motion was made by Commissioner Weisgerber, seconded by Commissioner Caldwell to adopt the ordinance as read and the following vote was had: Ayes: Caldwell, Cooper, Losik, Weisgerber, Usher (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered 8353. The ordinance was introduced for first reading May 20, 1974. 1.58 A LETTER was received from the City Planning Commission recommending the approval of the Final Development Plan for the Lee Hardware Company's propose new warehouse facility at the northeast corner of Centennial Road and West Magnolia Road. A motion was made by Commissioner Caldwell, seconded by Commissioner Losik to accept the recommendation of the City Planning Commission and approve the Final Development Plan for the Lee Hardware Company. Ayes: (5). Nays: (0) Motion carried. A LETTER was received from the City Planning Commission recommending the approval of the rezoning of Lots 10, 11, 12, Block 1; Lots 20 and 21, Block 5; Lots 52 and 53, Block 6, Replat of Edgemere Addition to District "D" (Local Business District) and Lots 1 through 9, Block 1, Replat of Edgeme re Addition to District "DD" (Office District). (Rezoning was requested in Petition Number 3413 which was filed by Mrs. Roberta S. Kaufman). A motion was made by Commissioner Cooper, seconded by Commissioner Losik to accept the recommendation of the City Planning Commission and introduce the rezoning ordinance for first reading. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: A LETTER was received from the City Planning Commission recommending the approval of the Final Plat of the Northeast Industrial Park, Block 1, as requested in Petition Number 3414 which was filed by the Urban Renewal Agency. A motion was made by Commissioner Losik, seconded by Commissioner Caldwell to accept the recommendation of the City Planning Commission and approve the final plat of the Northeast Industrial Park, Block 1. Ayes: (5). Nays: (0). Motion carried. A RESOLUTION was introduced and passed entitled: 11A RESOLUTION recognizing the need for and desirability of obtaining insurance to partially offset losses due to flooding; vesting the City Manager with the authority to implement several commitments to provide information and assistance to the Federal Insurance Administrator and designating the City Engineer with the responsibility of maintaining accurate elevation information." Keith Rawlings explained, "This resolution and the one to follow are both required resolutions prior to Salina entering into, or filing a request in the flood insurance program. This particular resolution merely indicates to the Federal Insurance Administration that the City will cooperate with them in providing information that is available at the present time and will work with them in obtaining information that they will need as they begin their engineering study." A motion was made by Commissioner Losik, seconded by Commissioner Caldwell to adopt the Resolution as read and the following vote was had: Ayes: Caldwell, Cooper, Losik, Weisgerber, Usher (5). Nays: (0). Carried. The Mayor approved the Resolution and it is numbered 3185. A RESOLUTION was introduced and passed entitled: "A RESOLUTION providing for the review of building permits and sub -division applications in order to minimize or eliminate flood damage." A motion was made by Commissioner Losik, seconded by Commissioner Weisgerber to adopt the Resolution as read and the following vote was had: Ayes: Caldwell, Cooper, Losik, Weisgerber, Usher (5) Nays: (0). Carried. The Mayor approved the Resolution and it is numbered 3186. Mayor Usher asked Mr. Rawlings, Planning Director, how long after the resolutions have been passed that the insurance protection will be available. Mr. Rawlings replied 4 to 6 weeks. A MOTION was made by Commissioner Caldwell, seconded by Commissioner Losik to set the date of July 8, 1974 as the date for a public hearing to discuss the environmental effects of the proposed Water Treatment Plant Improvements, and to instruct the City Clerk to publish the notice of public hearing. Ayes: (5). Nays: (0). Motion carried. Commissioner Cooper asked, "Exactly what kind of ,environmental effects might we be directing this hearing toward?" Mr. Olson replied, "Primarily it is the elimination of dumping lime and alum discharges into the river." 159 COMMISSION AGENDA "REVIEW ESTABLISHING NEW RATES FOR MUNICIPAL RENTALS, LICENSES AND ETCETERA." (Sponsored by Commissioner Cooper) Commissioner Cooper said, "This is a subject that has been brought to the Commission's attention in the past and is long overdue for some kind of actio on our part, I believe. This would include the building rentals, the license feeE, the mowing charges, the different fees and rates that the City charges for, I don't know, to get their money, I guess, from the people who do business in these areas; so I thought possibly Norris, if you had some kind of proposals you wanted to submit to the Commission that we could do something with it. I think you have mentioned to us in the past, you brought it to our attention in the proposed 1974 Budget that this was something that we should do. That you would provide us with some input. I asked again in January if maybe you could give us some kind of proposals that we might consider and I think we are running out of time unless we are going to wait until after we adopt a new budget and go through the same process all over again and nothing happens." Mr. Olson replied, "We can feed you material from time to time, however you might choose to approach the subject. We have a certain amount of data that has already been accumulated, there are other data that I would like to probably bring up to date as far as what maximums are concerned. I don't know if there is any legislation this past year, that was passed, as for example, that might relate to beer or liquor licenses. We should probably research a few of those." Mayor Usher said, "I wonder if you, Norris, might be able to come up with a list of those fees and licenses that we are now charging, and then what th staff recommends, say in the next 10 days or so, and let us have it and then let us have a few days to look it over and then maybe we could have a night meeting if that is alright with the other Commissioners, to review it." Mr. Olson commented, "I think that probably this is true, it is a time consuming exercise." Commissioner Cooper said, "Alright, but you did mention, you did bring it again to the Commission's attention in your budget and said you would follow up with some kind of input information on it. This is not restricted simply to beer licenses and these kinds of fees, this also includes, you mentioned mowing charges, building rentals and these kinds of things, cemetery rates and these kinds of things. I asked about and inquired about information from staff back in January on this same subject. I also asked you to maybe visit with the Chief of Police to see something in the nature of bicycle licensing, and this kind of thing, and since you are apparently in the process of doing preliminary budget preparations, I figured we were going to go through this same cycle all over again." Mr. Olson said, "I am merely pointing out that it can become a very tim consuming detail, depending on how far you intend to go down through the multitud of licenses and fees." Commissioner Cooper said, "We are probably going to go into it as deepl as you feel it is advisable for us to do. Whatever you had in mind initially would be a beginning at least." Mr. Olson replied, "We haven't organized it that much, but then if you give us a week we could get something organized and we would be happy to give you something in writing to get it at least rolling." Commissioner Losik said, "Norris, as far as the list, it is true there are many of them, but I think on that basis, if we could get them there, we could set up a priority as which would be the ones that we should get on number 1, 2, 3 and resolve them and eventually we would get them all down the line." 1130 Mr. Olson said, "I would suggest doing that when we get into that area of licenses. If we could put it out to you to get a large overview, a large picture." Commissioner Cooper said, "Well if you will put it all together and gi it to us we will see if we can't at least dispose of some things that have been pending for a considerable length of time." Mr. Olson said, "It might be too, that you would want to give this an evening." Commissioner Losik said, "We could do like we have done in the past a lot of these things, sit down in front of here and if somebody has some input they can throw it to us, if not and like I say and then we can come up with some recommendations, do it in our shirt sleeves." Commissioner Cooper said, "This is my reason for placing this item on the agenda." Mr. Olson said, "Maybe 10 days, Bill is gone. We will see if we can't get it this week." PUBLIC AGENDA PETITION NUMBER 3431 was filed by A. B. Seelye Company, Inc. for 8 inch asphalt pavement from the east line of Fairdale Road on Northwood to the south line of Glen Avenue. Water and sanitary sewer service to serve Lot 1, Block 18; Lots 19 - 29 inclusive, Block 19; Lot 1, Block 19, Lot 6, Block 17; Lots 6 - 20 inclusive, Block 16, all in Georgetown Addition. A motion was made by Commissionor Losik, seconded by Commissioner Weisgerber to refer the petition to the City Engineer for a recommendation. Ayes: (5). Nays: (0). Motion carried. PETITION NUMBER 3432 was filed by A. B. Seelye Company, Inc. for 8 inch asphalt pavement from the south line of Brookwood Lane on Fairdale Road to the south line of Applewood Lane and also from the south line of Brookwood Lane on Beechwood Road to the south line of Applewood Lane and 8 inch asphalt from the east line of Fairdale Road on Applewood Lane to the west end of the Applewood Lane cul-de-sac, and sewer to service lots 12 - 22, Block 1; and water to serve Lots 7 - 12, Block 3; Lots 7 - 17 inclusive, Block 1; all in Georgetown Addition. A motion was made by Commissioner Weisgerber, seconded by Commissioner Losik to refer the petition to the City Engineer for a recommendatio . Ayes: (5). Nays: (0). Motion carried. Seelye Company, Inc. for construction of a storm sewer drainage swale from the east line of Fairdale Road through Lot 1, Block 14, Riker Manor, and through Blocks 17 and 16, to the north line of Glen Avenue. A motion was made by Commissioner Weisgerber, seconded by Commissioner Caldwell to refer the petition to the City Engineer for a recommendation. Ayes: (5). Nays: (0). Motion carried. Mr. Olson said, "We would be happy to." Commissioner Losik said, "At least we would be working toward that end and if we could go along with that I believe we could accomplish something there.' Mr. Olson said, "Get Lakewood Lodge, Memorial Hall, the Theatre, Golf Course." Commissioner Losik said, '71 think one of them we had an inquire from a few of the here that carriers in so far as the policy on the full year's license fee for maybe one or two months because we are running on a calendar year, and this might be something to look at again to see if we could be a little more equitable in that area." Motion carried. if l PETITION NUMBER 3434 was filed by Apco Oil Corporation for the construction of a sewer line to service the property at 1900 South Ninth Street. A motion was made by Commissioner Caldwell, seconded by Commissioner Losik to refer the petition to the City Engineer for a recommendation. Ayes: (5). Nays: (0). Motion carried. A REQUEST was received from Robert F. Froben ius, 19 10 East Crawford, for authorization to lay a 2" heavy duty plastic line in right-of-way easements belonging to the City of Salina from an oil tank located on L. H. Burkholder property adjacent to Salina Municipal Golf Course in a northerly direction to and across East Crawford Street and thence easterly on East Crawford to the City limits to permit the disposal of excess salt water in an existing water disposal line running north and located on the section line east of Salina Municipal Golf Course. Said location of line to be determined by the City Engineer so as not to interfere with present underground water, telephone or sewer lines. A motion was made by Commissioner Cooper, seconded by Commissioner Losik to refer the request to the City Engineer for a recommendation. Ayes: (5). Nays: (0). Motion carried. A CEREAL MALT BEVERAGE License Application was filed by Keith D. Graybeal, d/b/a Music Box Cabaret, 925 West Lincoln. (Transfer of location). The City Clerk reported the application has been approved by the Zoning Officer and the Health Department. A motion was made by Commissioner Losik, seconded by Commissioner Caldwell to approve the transfer of location and authorize the City Clerk to amend the original license. Ayes: (5). Nays: (0). Motion carried A REQUEST was received from KINA to install antenna and receiver for their mobile unit on Gypsum Hill Water Tower. The City Manager reported there ar 7 such antennae on the tower now and this would not interfere. A motion was made by Commissioner Losik, seconded by Commissioner Cooper to approve the request and authorize the Mayor to sign the formal agreement authorizing the antenna on the water tower, and it is known as Resolution 3187. Ayes: (5). Nays: (0). Motion carried. A MOTION was made by Commissioner Caldwell, seconded by Commissioner Losik that the Regular Meeting of the Board of Commissioners be adjourned. Ayes: (5).
