Special Meeting of the Board
of Commissioners
November 26, 1973
The Special Meeting of the Board of Commissioners met in the
Commissioners' Room, City -County Building, on Monday, November 26, 1973,
at four o'clock P.M.
The Mayor asked everyone to stand for the pledge of allegiance to the
Flag and a moment of silent prayer.
There were present:
Mayor Jack Weisgerber, Chairman presiding
Commissioner Robert C. Caldwell
Commissioner Norma G. Cooper
Commissioner W. M. Usher
comprising a quorum of the Board, also:
L. 0. Bengtson, City Attorney
Norris D. Olson, City Manager
D. L. Harrison, City Clerk
Absent:
Commissioner Mike Losik, Jr.
The meeting was called for the purpose of considering the business
regularly scheduled to come before the Board on the 26th day of November, 1973
at 7:00 o'clock P.M., the regularly scheduled meeting date and time.
Mayor Weisgerber called for the approval of the minutes of the
Regular meeting of November 19, 1973.
Commissioner Cooper asked that her statement, "We discussed this
earlier, and I don't see any way to avoid it, because we are committed for it;
however, it is hoped that in the future we could find some way of avoiding
these conflicts when there isn't any reason for them, but I will support it
since it is for a special purpose", be added to the minutes on Page 4, under
the Miscellaneous Agenda.
The Minutes were approved as amended.
STAFF AGENDA
AN ORDINANCE was introduced for second reading entitled: 'PAN ORDINANCE
providing for the amendment of Zoning Ordinance Number 6613 and the Zoning
District Map therein and thereby adopted and providing for the rezoning of
certain property within the city and prescribing the proper uses thereof."
(For the rezoning of 11.11 acres in the Southeast Quarter of Section 26-14-3,
requested by George Wallerius in Petition Number 3354 to District "D" (Local
Business District). A motion was made by Commissioner Usher, seconded by
Commissioner Cooper to adopt the ordinance as read and the following vote was
had: Ayes: Caldwell, Cooper, Usher, Weisgerber (4). Nays: (0). Commissioner
Losik absent. The Mayor approved the ordinance and it is numbered 8321. The
ordinance was introduced for first reading November 12, 1973.

THE CITY ATTORNEY reported on a request by Leon J. Dinkel and Clarence
M. Smith for an amendment in Section 28-56 of The Salina Code, regarding
Merchant Police Bond and Insurance, and recommended the section be amended for
the bond to read, "to save the city harmless from all liabilities for any injury
to persons or property which the principal, his agent, servant or employee may
cause by reason of engaging in the business of merchant police," and for insuran
to be carried as a condition of the issuance of the license. A motion was made
by Commissioner Usher, seconded by Commissioner Caldwell to accept the recommends
of the City Attorney and introduce an ordinance for first reading amending the
section. Ayes: (4). Nays: (0). Motion carried.

A LETTER was received from the Metropolitan Planning Commission
informing the City Commission that Petition Numbers 3342 and 3344 have been
tabled for six months by the Metropolitan Planning Commission, or uneil May 24,
1974, at the request of the petitioner. (There was no action required of the
City Commissioners.)
A LETTER was received from the Metropolitan Planning Commission
recommending the approval of the final plat of Meadowlark Acres Addition Number 2
which was requested by the National Bank of America, in Petition Number 3353. A
motion was made by Commissioner Caldwell, seconded by Commissioner Cooper to
accept the recommendation of the Metropolitan Planning Commission and approve
the final plat; and also to introduce the rezoning ordinance for first reading.
(Rezoning was approved by the City Commission on August 13, 1973, subject to the
approval of the final plat.) Ayes: (3). Nays: (0). Commissioner Usher abstaine(

THE CITY COMMISSIONERS considered an amendment to the agreement entered
into on the 31st day of May, 1973, by and between the City of Salina, Kansas, and
the County of Saline, Kansas, regarding the North Central Regional Planning
Commission. "For 1 -he coming year and until changed by mutual agreement of the
parties, the City will pay 22% and the County will pay 78% of the North Central
Regional Planning Commission budget which is assigned to Saline County," A motio
was made by Commissioner Usher, seconded by Commissioner Caldwell to approve the
amendment and authorize the Mayor to sign. Ayes: (4). Nays: (0). Motion carrie
A MOTION was made by Commissioner Cooper, seconded by Commissioner Ushe
to instruct the City Clerk to publish a "Notice of Bond Sale" for bids to be
received December 17, 1973, for Series P-215 in the amount of $250,736.00 General
Obligation Bonds, for 10 years, for street, sewer and water improvements.
Ayes: (4). Nays: (0). Motion carried.
A MOTION was made by Commissioner Usher, seconded by Commissioner
Caldwell to set the date of December 10, 1973 to receive bids for water and
sewer extensions to serve Salina, Inc., School Specialty and John Deere in the
South Industrial Area, Engineering Project 73-563, and instruct the City Clerk
to publish a notice to bidders. Ayes: (4). Nays: (0). Motion carried.
THE CITY MANAGER reported on the paper recycling project. He said,
"The assignment was one given to staff, and staff felt the Citizens' Advisory
Committee could get some feel from the citizens. They met several times and
several hours at each meeting with Mr. Harris and Mr. Estes, and they came up
with four possibilities: 1. Curbside collection, at least monthly, by a special
city vehicle and a two or three man crew; 2. Curbside collection by the
Sanitation Department crews; 3. Volunteer delivery to schools at scheduled
intervals; 4. Volunteer delivery to mechanically serviced containers located
at Fire Stations 1, 2, and 4 or parking lots of retail areas in various parts of
the city.
"The packet of information gives you the pros and cons of each of these
four alternatives and the estimated expenditures and revenues of the first two
operations.

"Today we are recommending that you consider the possibility that all
refuse be collected at the curb or alley; and I strongly urge you to also consider
some sort of legislation for the establishment of some conditions that would
prevent cans from being blown over or dumped over by dogs, and the plastic sack
from being torn by dogs. I believe this community has appreciated not having the
curb line problems of spilled garbage on the gutter, and we want to keep it that
way."
Commissioner Cooper asked what this would do for the so called
aesthetics of the community.
Mr. Harris replied, "It doesn't enhance the aesthetics at all, but it
is not an uncommon practice. A number of cities do it. When we were working
with the task force on this, we wrote to 15 different communities requesting
information and received replies from 10. We learned that the city that somewhat
pioneered this paper salvage deal was Madison, Wisconsin, and they do have curb
side refuse collection which facilitates the refuse crews being able to handle it
in the way that they do. They keep the paper separated by putting it into racks
that are built under the beds of the trucks. Here, where we have what we call
the carry out system, our fellows have to utilize these 2 wheel carts and barrels
in order to move the refuse out. At the times when the trucks are working in the
alleys, that equipment is stored under the beds of the trucks, so this would
make it quite difficult, if not impossible, for us to mount this rack under the
truck like Madison, Wisconsin does. As the Manager said, we are not at all
enthused about the idea of requiring people to put the refuse out on the curb for
pick up. It is not the level of service we are accustomed to in Salina, where
we have the convenience of having our crews go in and carry it out; but there is
one other thing besides the fuel situation that enters into it and that is the
savings of considerable time on our route by having it set out at the curb or at
the alley. We know if we continue our present operation, we are going to have
to add one, possibly two, trucks next year. We presently operate six which means
we will have to man one or two more trucks. We have had quite a personnel turn
over this year, nineteen to be exact, out of a department that has eight drivers
and fourteen laborers, for a total of twenty-two people. The labor market has
been quite tight this past year, and these crews are operating at peak loads;
so it is not going to be easy if we are going to have to put on additional crews.
We have these two things to consider, among others, the possibility of saving
fuel by not having to add another truck and possibly being able to take off at
least one from what we are operating now, along with easing the labor problem.
"It is not going to enhance the aesthetics, and it is going to be an
inconvenience. It appears we are going to experience several inconveniences
because of our fuel shortage, and this might be one we can live with.
"Our recommendation would be as the Citizens' Advisory Committee
recommended, to put on the first truck. In all fairness to that committee, we
did discuss having the refuse put out at the curb. One of the members, after
reading the material from Madison, Wisconsin, said he felt we should do this.
We discouraged it for the verious reasons we have been mentioning. For the
aesthetics and secondly that it is going to be an inconvenience; but day by day.
we become more cognizant of the fuel situation and the labor problems, and this
is the reason we have had a change of thinking since the Citizens' Advisory
Committee took their action. We are suggesting you consider this matter of
requiring them to put the refuse at the curb; and our final recommendation would
be to withhold a decision on the municipal paper salvage project until we can
get something worked out with the private haulers to obtain a good percentage of
the available corrugated paper. We can see no way that the salvage of newsprint
will ever be self supporting, so we are going to have to involve the salvage of
currugated paper in order to hope to make it a paying proposition."
After a short discussion, a motion was made by Commissioner Usher,
seconded by Commissioner Caldwell to table the matter until January 7, 1974,
at 2 o'clock P.M., when the City Commissioners will meet with the staff to
consider it. Ayes: (4). Nays: (0). Motion carried.

PETITION NUMBER 3378 was filed by Bucher and Willis, for the approval
of development drawings for park improvements and authorization for the Girl
Scouts of Salina to make such improvements to the park. (South Park School Site)
Sally Lambert, of the Central Kansas Council of Girl Scouts, explained
that about a year ago it was made known to Girl Scouts of this area that through
the Readers' Digest Foundation, a grant of up to $500.00 could be acquired by
Senior Girl Scouts for community projects of some kind. "Judy Miller is the one
responsible for submitting the application to the Readers Digest Foundation, and
has been involved this past year with the development of the plans for this mini -
park. Mr. Shelby Willis, of Bucher and Willis, donated time and worked with the
troop in the development of the plans for this mini -park."
Mr. Tom Darnell, of Bucher and Willis, explained the plans include
making two mounds of dirt with a bridge between, which is basically a piece of
play equipment, with a dry river effect, which will be a sandpile. He said
there will be a couple of pieces of play equipment, and the area would be edged
with railroad ties, which the Union Pacific Railroad has agreed to donate to the
project."
The City Manager asked if they are talking about the expenditure of
any city funds?
PETITION NUMBER 3379 was filed by Merle R. Greever, owner of the Flower
Nook, for a temporary loading zone until such time as the demolition of buildings
and clearance of the alley north of 145 North Santa Fe Avenue is accomplished.
Mr. Bassett, Assistant City Engineer, reported they had a chance to
review this petition before the meeting and recommended the request be approved,
because the contractor uses the alley, and even though he doesn't have it blocked
at all times, he uses it periodically and is inconsistent, and the businesses
don't know whether they are going to be able to get through or not.
A motion was made by Commissioner Usher, seconded by Commissioner
Caldwell to accept the City Engineer's recommendation and approve the request.
Commissioner Cooper also seconded the motion and requested the City Engineer
forward his written recommendation to the Commission. The City Manager asked
Commissioner Cooper if the record of the recommendation in the minutes would be
sufficient. Commissioner Cooper replied it would be, if it is in there.

A MOTION was made by Commissioner Caldwell, seconded by Commissioner
Usher that the Special Meeting of the Board of Commissioners be adjourned.
