There were present: Mayor Robert C. Caldwell, Chairman presiding Commissioner Keith G. Duckers Commissioner Gerald F. Usher The Minutes of the Regular Meeting of March 29, 1976, were approved as printed. THE MAYOR PROCLAIMED the Week of April 5 through 10, 1976 - "KANSAS BANK WEEK". The proclamation was read by Commissioner Simpson. STAFF AGENDA A PUBLIC HEARING was held on the proposed assessments for the improvemens in Engineering Project 75-590: (Country Hills Number 2, Georgetown Addition; Twin Oaks Sub -division; Fairway Addition) Water main in Van Horne Street from Ohio Street to the Missouri Pacific Railroad as authorized by Resolution Number 3230, passed by the Board of Commissioners of the City of Salina, Kansas, on the 21st day of April, 1975. Mr. Phil Eaton was present, and asked why he is being assessed for a street that is not in front of his property? Mr. Olson explained each lot in town is assessed for its front street and its nearest side street. Mr. Jerry Barringer was present, and said he thought the developer had to pay for the improvements. Mr. Olson explained the developers are required to deposit 50a of the proposed cost of improvements in an undeveloped area. Mr. Eaton asked about the cost cost of the improvements. A motion was made by Commissioner Simpson, seconded by Commissioner Duckers to approve the assessments and to introduce the assessment ordinance for first reading. Ayes: (4). Nays: (0). Motion carried. Ordinance Passed: Number: AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing for a zoning district to be known as 'Planned Development District', amending the zoning ordinance of the City of Salina, Kansas, the same being Ordinance Number 6613." A motion was made by Commissioner Weisgerber, seconded by Commissioner Duckers to adopt the ordinance as read and the following vote was had: Ayes: Duckers, Simpson, Weisgerber, Caldwell (4). Mr. Harrison replied the total cost for Riker Manor is $3,778.30; Georgetown Addition is $157,994.31; Twin Oaks Sub -division is $109,799.54; adult care homes, other than for the insane or feebleminded to be in Section Country Hills Addition Number 2 is $28,572.91; and Fairway Addition is $7,466.18. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing for the amendment of Section 1 or Ordinance Number 6613 and repealing the original section; and repealing Section 20, Community Unit Plan and Developme of Ordinance Number 6613." After a short discussion, it was agreed 4 hours is a little short, and they agreed 24 hours after the auction would be a reasonable amount of time for the area to be cleared of merchandise if the auction is not held in the confines of a building. A motion was made by Commissioner Simpson, seconded by Commissioner Duckers to accept the City Manager's report and instruct the City Attorney to draft an ordinance to provide for an auction room license fee to be $150.00 for the annual fee or $25.00 per sale, with a 24 hour removal clause. Ayes: (4). Nays: (0). Motion carried. A LETTER was received from Mrs. Lewis C. Crawford, Chairman of the Citizens' Advisory Committee, recommending Section 4 of Resolution Number 3215 be amdeded to include: "Any member who moves from the neighborhood from which he was appointed to another neighborhood within the City, shall be required to resign his position on the Citizens' Advisory Committee. Said member's name will be added to the current list of volunteers for his new neighborhood, unless he notifies the City otherwise." A motion was made by Commissioner Simpson, seconded by Commissioner Weisgerber to accept the Citizens' Advisory Commission recommendation and to adopt a resolution entitled: "A RESOLUTION creating the Salina Citizens' Advisory Committee; setting forth its purposes and functions; determining its membership and the method of selection thereof; amending Resolution Number 3215 and repealing the original resolution", and the following vote was had: Ayes: Duckers, Simpson, Weisgerber, Caldwell (4). Nays: (0). Carried. The Mayor approved the Resolution and it is numbered 3267. A LETTER was received from Mrs. Lewis C. Crawford, Chairman of the Citizens' Advisory Committee, recommending Section 5 of Resolution Number 3217 be amended to include except for amendatory applications which will allow citizens to submit their opinions regarding community development needs and priorities and a minimum of one public hearing for presentation of all segments of the proposed amendatory application." A motion was made by Commissioner Duckers, seconded by Commissioner Weisgerber to accept the Citizens' Advisory Commission recommendation and to adopt a resolution entitled: "A RESOLUTION setting forth a plan for citizen participation in the development and carrying out of an ongoing housing and community development plan for the City of Salina, Kansas; amending Resolution Number 3217 and repealing the original resolution", and the following vote was had: Ayes: Duckers, Simpson, Weisgerber, Caldwell (4). Nays: (0). Carried. The Mayor approved the Resolution and it is numbered 3268. THE CITY ENGINEER reported on Petition Number 3536, which was filed by James E. Sullivan for water service, sanitary sewer service and frontage road pavement to serve the North 483 feet of Lot 1, Block 1, Sullivan Addition to the City of Salina, Kansas, that it a sufficient petition as Mr. Sullivan is the only resident property owner in the benefit district. A motion was made by Commissioner Simpson, seconded by Commissioner Duckers to accept the City Engineer's report and approve the petition. Ayes: (4). Nays: (0). Motion carried. THE CITY Manager reported on a request by Lonnie Wilson for a reduction in Auction Room license fees, (Referred to the City Manager at the March 15, 1976 meeting), that he has discussed the request with Mr. Bengtson and the Police Chief and they generally agree the license fees for auction rooms is relatively high. He recommended the license fee be reduced to a fee in the neighborhood of $150.00, and establishing a per sale fee of something in the neighborhood of $25.00, this would give the auctioneer a choice of auction fees to pay, and that the premises of an outside auction be entirely cleared of merchandise within 4 hours after an auction. He also stated that auctions for charitable organizations should not be exempt from the provisions of the ordinance as it would constitute preferential treatment. He said if the Commissioners do approve the ordinance when it is drafted, a copy will be mailed to all auctioneers in the telephone book, and if consignment auctions become popular, the Police Officers will become better acquainted with the auctioneers to eliminate any possible activity that would be questionable. Crawford, Chairman of the Citizens' Advisory Committee, recommending approval and implementation of a Housing Conservation Program. Mr. Jim Maes and Mr. Keith Rawlings were present and answered the questions of the Commissioners regarding funding, participation, enforcement, and the target area of the Housing Conservation Program. A motion was made by Commissioner Duckers, seconded by Commissioner Simpson to accept the recommendation of the Citizens' Advisory Committee and approve the implementation of the Housing Conservation Program. Ayes: (4). Nays: (0). Motion carried. A LETTER was received from Mrs. Lewis C. Crawford, Chairman of the Citizens' Advisory Committee, listing the suggestions made by 402 different individuals and organizations for second year Housing and Community Development funds: Mr. Olson said this was on the Citizens' Advisory Committee agenda last week and they had quite an exchange on the subject. Commissioner Simpson commented they postponed a report on it until the next meeting. Commissioner Duckers said he is not sure he follows what the Mayor is referring to on a tree maintenance program. He said individuals would do it, but does the City have to have a policy before an individual would cut down a dead tree? Mayor Caldwell responded, "The City already has that, as far as the set up, but I mean a volunteer group that is going out to do something about the trees that we have in Salina. Two or three years ago they did have a tree problem and it was on the mind of all the citizens to do something about it, and we did set up a program to get trees set out, various ones in the community. The number is of now, but they really had a good program, and we had a good committee working on it, and previous to that there were other programs set up." 92 requested additional child care facilities 12 suggested better street lighting 8 wanted sidewalks improved 22 asked for street repairs and improvements 2 spoke for improved railroad crossings 6 suggested better street signing program 1 asked for better signing to direct Interstate travelers into and out of town, particularly those using the State Street ramps on I-35 14 recommended a tree maintenance program for the city 8 spoke of the need for river cleanup 22 wanted general improvements of existing parks 32 asked for additional park facilities 11 individuals expressed the need for a public transportation system 12 mentioned juvenile detention facilities Mayor Caldwell said he would like to make one comment on the tree maintenance program, "It was suggested from the chairman sometime back on setting up a committee to check on our tree program here which was turned down by the Commission, but it was turned over to the Citizens' Advisory Committee at the time and this is the only action that has been taken on those trees since that time and I do know that the previous programs that the Commission has set up have had some bearing on the tree program in the city. I was outvoted at the time and I still think that it is a good program for the City Commission to adopt. We had a working committee that was ready to go to work on this particular item, and they had fire and dander ready to go, but we turned it over to the Citizens' Advisory Committee and they had a lot of things to do, and this is the only response we have received from them since time back." Mr. Olson said this was on the Citizens' Advisory Committee agenda last week and they had quite an exchange on the subject. "What I thought you had in mind before was somehow for the city to become involved in funding, that is why it was referred back to the CAC; but as far as a volunteer committee, I am in favor of that." Commissioner Duckers asked why they don't get it back in the works? Commissioner Weisgerber suggested they see what recommendation comes from the CAC. Mr. Harris commented, "I think maybe we had, possibly still have, some confusion in what the goal and intent was here. If it is an effort to encourage people, on a volunteer basis, to plant trees, that is one thing; but I think most of us were under the impression that this was to give considerati to a comprehensive ordinance, a tree maintenance ordinance, and possibly a forestry type sdrvice requiring city funding, and if not that far at least if there is an ordinance stating what types of trees can and cannot be planted on public property, then comes the matter of enforcing that ordinance, staffing and so forth, and at least that is the impression that we had on staff and this was discussed before that it was to be a follow-up to the study that was done by Kansas State, and to give consideration to developing a comprehensive ordinance which might in fact bring back to you a recommendation to spend considerable amount of money on an annual basis. Now perhaps we were on the wrong track if you were thinking strictly of this volunteer type of a thing and encourage people to plant trees as has been done in the past; I think really it should not have gone to the Citizens' Advisory Committee for that type of thing." Mayor Caldwell responded, "At the time it was posed, they asked us to hold off until this group of that they were going to try to appoint, headed by Mrs. Hartnett, and what we had proposed was a volunteer group. We held off from that because they had some other ideas of what they would like to do. I wasn't concerned about that so much, as I was about the volunteer group; however I am only bringing this up for comment and conversation with the commission. I could care less if the ordinance is changed or not, but these are the things the CAC could not get around to doing is what I am saying. When they are going to get around to doing them I don't know but the item here is recommended maintenance for trees. That is the only comment I have." A motion was made by Commissioner Weisgerber, seconded by Commissioner Simpson to accept the letter from the Citizens' Advisory Committee. Ayes: (4). Nays: (0). Motion carried. Seelye Company, Inc. for the rezoning of Lot 22, Block 3, and Lot 9, Block 6 in the proposed Dow Addition from District "A" (Second Dwelling House District) to District "C" (Apartment House District). A motion was made by Commissioner Weisgerber, seconded by Commissioner Simpson to refer the petition to the City Planning Commission. Ayes: (4). Nays: (0). Motion carried. PETITION NUMBER 3549 was filed by Barry Burgard, President of Brann's Warehouse, Inc. for an amendment to the zoning ordinance to read one parking space for each 400 square feet of enclosed floor area, instead of one parking space for each 200 square feet of enclosed floor area for furniture stores and appliance stores. A motion was made by Commissioner Simpson, seconded by Commissioner Weisgerber to refer the petition to the City Planning Commission. Ayes: (4). Nays: (0). Motion carried. Mayor Caldwell commented, "That would be up to the individual if they wanted to purchase trees and plant them, they did it themselves, and the only thing that came out of the city's funds were probably the mailing of letters and all this type of thing. A motion was made by Commissioner Weisgerber, seconded by Commissioner Duckers to refer the petition to the City Planning Commission. Ayes: (4). Nays: (0). Motion carried. A CEREAL MALT BEVERAGE License Application was filed by Rebecca S. Vering, d/b/a The Tree House, 121 East Walnut. (New application) The City Clerk reported the applicant has paid the required fee and the application has been approved by the Health Department, Zoning Officer and the Police Department. A motion was made by Commissioner Duckers, seconded by Commissioner Simpson to approve the cereal malt beverage license application and authorize the City Clerk to issue the license. Ayes: (4). Nays: (0). Motion carried. A REQUEST was received from Mel Jarvis to construct a stable and utility barn to stable not more than four horses, on Block 6, Lakewood Addition. A motion was made by Commissioner Duckers, seconded by Commissioner Simpson to approve the request, subject to the approval of the Health Department. Ayes: (4). Nays: (0). Motion carried. A REQUEST was received from the the Bicentennial Festivals Committee for the city to accept the ownership of a memorial gazebo to be constructed at the intersection of Santa Fe and Iron, for the street fair activities June 11 and 12. Mrs. Gene Chapman was present and explained they have a donor to build a large, 24 foot diameter, gazebo for the street fair, in which all the entertainment will take place, if the city will accept the ownership of it at the conclusion of the street fair. Mr. Dennis Poer was also present and explained the donor would like to be assured the City will accept ownership of the building and maintain it as a memorial of the bicentennial. He said they have talked with several members of the staff and they were excited about receiving the gift and are willing to move the gazebo from the intersection of Santa Fe and Iron to the proposed site of the Claflin building which was at one time in Oakdale Park, and then to maintain it. A motion was made by Commissioner Weisgerber, seconded by Commissioner Duckers to accept the ownership of the gazebo at the conclusion of the street fair and to have it moved to its permanent location in the park. Ayes: (4). Nays: (0). Motion carried. Commissioner Simpson expressed thanks and appreciation to the Festivals Committee of the Bicentennial Commission. COMMISSION AGENDA The following items were brought to the floor for discussion: Commissioner Simpson asked about the response to the first weekend of free gate fees at the landfill. Mr. Olson replied the response was greater than they had originally anticipated. He quoted Section 32-1 of the Salina Code as it relates to the vehicles spilling garbage on the roadways. He said they encourage the citizens of Salina to use the free gate fees, but said he is not enthused about the condition that West Crawford was left in last Saturday and Sunday Evenings. He also added that the Police Department is aware of the situation and there may be some tickets issued next weekend if more care isn't given to the sightlines of the streets and avenues in town. He concluded by saying the use of the facility was very good, approximately 200 vehicles each day. The number on an average weekend would be 25-30 vehicles. 29 Mayor Caldwell thanked the staff for the City of Salina Calendar which was printed in the bicentennial theme. He said it was well constructed, well planned, and well printed. Commissioner Duckers asked for an update on the Downtown Beautification Project. Mr. Olson replied that they were approximately 30o complete at the end of March when the last progress payment was made.
