March 15, 1976
The Regular Meeting of the Board of Commissioners met in the Commissi
Room, City -County Building, on Monday, March 15, 1976, at four o'clock P.M.
The Mayor asked everyone to stand for the pledge of allegiance to
the Flag and a moment of silent prayer.
There were present:
Mayor Robert C. Caldwell, Chairman presiding
Commissioner Gerald F. Simpson
Commissioner W. M. Usher
Commissioner Jack Weisgerber
comprising a quorum of the Board, also:
L. 0. Bengtson, City Attorney
Norris D. Olson, City Manager
D. L. Harrison, City Clerk
Absent:
Commissioner Keith G. Duckers
The Minutes of the Regular Meeting of March 8, 1976, were approved
as printed.
THE MAYOR PROCLAIMED Saturday, March 20, 1976 "TOOTSIE ROLL DAY".
The proclamation was read by Frank Thelen of the Salina Council of the Knights
of Columbus.
STAFF AGENDA
A RESOLUTION was introduced for second reading entitled: "A RESOLUTION
determining the necessity of and directing that the owner or owners of certain
lots construct, in compliance with plans and specifications of the City
Engineer, a sidewalk abutting said lots within 30 days of the adoption and
publication hereof and providing that in the event the owner or owners fail
to do so, that the City of Salina shall proceed to construct, or cause to be
constructed, said sidewalk and that the total cost thereof shall be assessed
against such lot or lots on which such sidewalk shall abut as other special
assessments." (sidewalks abutting Lots 6 and 7, Block 27, Key Acres Addition,
requested in Petition Number 3518 which was filed by John P. Garrison). A
motion was made by Commissioner Weisgerber, seconded by Commissioner Simpson
to adopt the Resolution as read and the following vote was had: Ayes: Simpson,
Usher, Weisgerber, Caldwell (4). Nays: (0). Carried. The Mayor approved
the Resolution and it is numbered 3261. The Resolution was introduced for
first reading March 8, 1976.
THE CITY ENGINEER reported on a request by Gene Hinde for a parking
variance on Parkwood Street and the frontage road parallel to Ohio Street in
Parkwood Village, that he and Mr. Hinde do not have all the details worked
out on the request, and that he will report back next week.
THE CITY MANAGER reported on free gate fees at the landfill for one
or two weeks in connection with a fix -up, paint -up, clean-up campaign.

Mr. Olson said, "I have visited with some of our people on staff.
We cannot, nor would we choose to, disagree with the idea. We think it is
probably a good idea. We would, I think, suggest that such a free gate fee
be made available only to residents of Saline County and here we are talking
about private individuals. We would prefer that it not be opened to commercial
users, to the city sanitation department, city trucks, contractors, commercial
haulers, because we are set up to take care of this type of activity. We
feel that the normal day to day type of waste disposal would and should
continue. We wonder if it would be desirable to have a nine day period
starting with a Saturday and finishing with a Sunday, because I think most of
the resident property owners are going to be able to do this type of activity
over the weekend. We would encourage weekend activity because our commercial
haulers and our own sanitation trucks and the like are not at the landfill at
this time during the week, and if we do get a lot of play of cars, cars
Pulling trailers, pickups and the like, they wouldn't have to compete with
the commercial haulers at the landfill. The ordinance that was passed in
November 1973 does permit you the privilege of waiving fees, suspending them
or waiving them, by another simple resolution. We don't feel as though it is
going to be one of those activities that is going to jeopardize revenue very
much because we would anticipate, that this would be over and above that
which is normally generated and hauled anyway. I think this was propably the
intent of your suggestion anyway."
Commissioner Usher commented he is interested in the Saturday and
Sunday proposal and suggested the landfill be opened on Saturday and Sunday
during the Month of April for individuals to haul their own trash.
Mr. Olson said Mr. Estes and Mr. Hill throught this suggestion was
worthy of asking the Commission to consider that the vehicle bear a Saline
County tag as the sanitation operation is a Saline County activity.
A RESOLUTION was introduced and passed entitled: "A RESOLUTION
temporarily suspending the service fee charged residential users of Solid
Waste Disposal Area." A motion was made by Commissioner Usher, seconded by
Commissioner Simpson that the Resolution be adopted as read and the following
vote was had: Ayes: Simpson, Usher, Weisgerber, Caldwell (4). Nays: (0).
Commissioner Duckers absent. Carried. The Mayor approved the Resolution and
it is numbered 3262.
A MOTION was made by Commissioner Weisgerber, seconded by Commissioner
Usher to introduce an ordinance for first reading entitled, "An ordinance
relating to public officials and employees of the City of Salina, Kansas;
providing security, indemnification and payment of certain expenses incurred
in adjusting, settling or defending claims brought against them for their
actions in discharging city duties or performing city employment." Ayes: (4).
Nays: (0). Motion carried.

A MOTION was made by Commissioner Usher, seconded by Commissioner
Simpson to introduce an ordinance for first reading entitled: "An ordinance
providing for the billing and collection for water and sewerage service and
the procedure for disconnection of said water service for non payment of
bills; amending Section 35-64 of the Salina Code and repealing the existing
section." Ayes: (4). Nays: (0). Motion carried.

PUBLIC AGENDA
A REQUEST was received by Lonnie Wilson to appear before the City
Commission about a reduction in Auction Room License Fee.
Mr. Wilson was present and explained the license fee for an auction
room is $666.00 a year; and that the license fee for operators of auction
rooms in which all merchandise owned or consigned is stored within the confines
of an enclosed building, is $333.00 a year, and asked the City Commission to
reduce the license fee, and that charity auctions be allowed with no license
fee.
Mr. Bengtson explained the license fee was set high, because it is
Possible for someone to bring in stolen items to be consigned for auction, and
a police officer is needed to check all the items going in and coming out.
Commissioner Usher asked how the city handles the charity auctions?
Mr. Harrison replied they have not had to purchase a license.
During discussion of the request, it was suggested that a license
fee be established for a single auction.
A motion was made by Commissioner Weisgerber, seconded by Commissioner
Simpson to refer the request to staff for a recommendation, with the possibility
of establishing a per sale license fee. Ayes: (4). Nays: (0). Motion carried.
A CEREAL MALT BEVERAGE LICENSE APPLICATION was filed by Yankee
Clipper of Salina, Inc., 732 South Broadway, Dennis Sperling, Manager. The
City Clerk reported the applicant has paid the required fee and the application
has been approved by the Zoning Officer and the Police Department, and the
applicant requests approval of the license subject to the final approval of
the Health Department. A motion was made by Commissioner Simpson, seconded by
Commissioner Weisgerber to approve the license subject to the final approval
of the Health Department, and authorize the City Clerk to issue the license at
that time. Ayes: (3). Nays: (0). Commissioner Usher abstained. Motion
carried.
A SURETY ON BAIL BOND LICENSE APPLICATION was filed by Jack Kindlesparg
d/b/a B & K Bonding, 908 East Crawford. The City Clerk reported the applicant
has paid the required fee and has the required documents on file, and his
application has been approved by the Police Department. A motion was made by
Commissioner Usher, seconded by Commissioner Simpson to approve the license
application and authorize the City Clerk to issue the license. Ayes: (4).
Nays: (0). Motion carried.
SURETY ON BAIL BOND LICENSE APPLICATION were filed by Eric Kindlesparger
agent for B & K Bonding; and Stephen Klingzell, agent for B & K Bonding. The
City Clerk reported the applicants have paid the required fee and the applications
have been approved by the Police Department. A motion was made by Commissioner
Simpson, seconded by Commissioner Usher to approve the license applications
and authorize the City Clerk to issue the licenses. Ayes: (4). Nays: (0).

COMMISSION AGENDA
The following item was brought to the floor for discussion:
Commissioner Usher asked to place an item on the agenda for the
first inter -local meeting of the City, County, and School Board:
"A discussion of trying to resolve the ownerships of property; for
example we lease the Oakdale Park ground from the County, and yet we are
pouring Salina tax dollars into the park over there; and we own Kenwood Park
and the County is pouring County tax dollars into their improvements; and it
seems to me it makes just good sense if you are going to put money into improve
in a piece of ground you own the ground. I am wondering if we couldn't explore
this in our meeting and see if anybody agrees with me, and if they do; let's
see if we can't resolve this thing that has been going on for the last 100
years. To me it doesn't seem like it has to be such an impossible problem and
why it hasn't been done up to this point is beyond me; but before we go and
pour anymore money into Kenwood Park, I would like to see if we could resolve
this problem, and at least be using our tax dollars on ground we own.
