01-26-1976 Minutes252 City of Salina, Kansas Regular Meeting of the Board of Commissioners January 26, 1976 The Regular Meeting of the Board of Commissioners met in the Commissione Room, City -County Building, on Monday, January 26, 1976, at four o'clock p.m. The Mayor asked everyone to stand for the pledge of allegiance to the Flag and a moment of silent prayer. There were present: Mayor Robert C. Caldwell, Chairman presiding Commissioner Keith G. Duckers Commissioner Gerald F. Simpson Commissioner W. M. Usher Commissioner Jack Weisgerber comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None The Minutes of the Regular Meeting of January 19, 1976 were approved as printed. STAFF AGENDA AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing for the bond and insurance to be furnished by an applicant for a sign erector or installer license, amending Section 9-69 of the Salina Code and repealing the existing section." A motion was made by Commissioner Usher, seconded by Commissioner Simpson to adopt the Ordinance as read and the following vote was had: Ayes: Duckers, Simpson, Usher, Weisgerber, Caldwell (5). Nays: (0) Carried. The Mayor approved the Ordinance and it is numbered 8468. The ordinance was introduced for first reading January 19, 1976. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing for the insurance requirements for Electrical Contractors doing business within the City of Salina, amending Section 9-134 and repealing the existing section." A motion was made by Commissioner Duckers, seconded by Commissioner Usher to adopt the Ordinance as read and the following vote was had: Ayes: Duckers, Simpson, Usher, Weisgerber, Caldwell (5). Nays: (0). Carried. The Mayor approved the Ordinance and it is numbered 8469. The ordinance was introduced for first reading January 19, 1976. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE prescribing the liability insurance to be furnished by any person engaged in the business or trade of plumbing in the City, amending Section 9-225 of the Salina Code and repealing the existing section." A motion was made by Commissione Simpson, seconded by Commissioner Weisgerber to adopt the Ordinance as read and the following vote was had: Ayes: Duckers, Simpson, Usher, Weisgerber, Caldwell (5). Nays: (0). Carried. The Mayor approved the Ordinance and it is numbered 8470. The ordinance was introduced for first reading January 19, 1976 1 n 1 20-3 AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE making it unlawful to engage in the business of installation of elevators within the City of Salina without first obtaining an elevator contractors license; prescribing the annual fee and minimum amounts of liability insurance, amending Section 9-387 of the Salina Code and repealing the existing section." A motion was made by Commissioner Weisgerber, seconded by Commissioner Usher to adopt the ordinance as read and the following vote was had: Ayes: Duckers, Simpson, Usher, Weisgerber, Caldwell (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered 8471. The ordinance was introduced for first reading January 19, 1976. A RESOLUTION was introduced and passed entitled: "A RESOLUTION authorizing the temporary investment of approximately $1,200,000.00 of Idle Funds of the City of Salina, Kansas." A motion was made by Commissioner Weisgerber, seconded by Commissioner Duckers to adopt the Resolution as read and the following vote was had: Ayes: Duckers, Weisgerber, Caldwell (3). Nays: (0). Commissioners Simpson and Usher abstained. Carried. The Mayor approved the Resolution and it is numbered 3259. A LETTER was received from the City Planning Commission regarding Petition Number 3513 which was filed by James Sullivan for approval of the final plat of Sullivan Addition, Block One. A motion was made by Commissioner Duckers, seconded by Commissioner Weisgerber to approve the final plat of Sullivan Addition, Block One, and authorize the Mayor to sign. Ayes: (5). Nays: (0). Motion carried. A LETTER was received from the Citizen's Advisory Committee recommending the approval of the 2nd year Community Development Application. A motion was made by Commissioner Duckers, seconded by Commissioner Usher to approve the 2nd year Community Development Application and at the same time commend Mrs. Crawford and the members of her committee for a hard job well done. Ayes: (5). Nays: (0). Motion carried. PUBLIC AGENDA PETITION NUMBER 3519 was filed by William E. Oehlert, Jr., 517 Aullwood, for the rezoning of Lot 8, Block 4, Woodland Addition from District "B" (Two - Family Dwelling House District) to District "D" (Local Business District). A motion was made by Commissioner Weisgerber, seconded by Commissioner Simpson to refer the petition to the City Planning Commission. Ayes: (5). Nays: (0). Motion carried. PETITION NUMBER 3520 was filed by John W. Ditto requesting a change in The Uniform Building Code of Salina, Chapter 14, Section 1404 3rd paragraph. A motion was made by Commissioner Usher, seconded by Commissioner Duckers to refer the petition to the Building Code Advisory Board, and also charge them to examine the entire code with relationship to amending, or changing, those parts that would make it more of an energy saving code than it is, at the same time they consider the request in the petition. Ayes: (5). Nays: (0). Motion carried. PETITION NUMBER 3521 was filed by George C. Etherington, to amend Zoning Ordinance Number 6613 to allow inclusion of Planned Unit Developments, as per pages 16 - 27 of the Proposed Zoning Ordinance (Petition Number 3501) and the addition of hospitals, sanitariums, nursing homes, rest homes as permitted uses in District "A". A motion was made by Commissioner Usher, seconded by Commissioner Simpson to refer the petition to the City Planning Commission. Ayes: (5). Nays: (0). Motion carried. PETITION NUMBER 3522 was filed by Vernon Peatling, 122 Overhill, for the rezoning of Lots 7, 8, 9, 10, Block 17, Pacific Addition from District "B" (Two -Family Dwelling House District) to District "D" (Local Business District). A motion was made by Commissioner Simpson, seconded by Commissioner Weisgerber to refer the petition to the City Planning Commission. Ayes: (5). Nays: (0). Motion carried. 254 A CEREAL MALT BEVERAGE LICENSE APPLICATION was filed by Joe Hartman, d/b/a Hartman Texaco, 407 West Diamond Drive. (Renewal). The City Clerk reported the applicant has paid the required fee and the application has been approved by the Health Department, Zoning Officer, and the Police Department. A motion was made by Commissioner Usher, seconded by Commissioner Duckers that the license application be approved and the City Clerk be authorized to issue the license. Ayes: (5). Nays: (0). Motion carried. A TREE TRIMMING AND TREATING LICENSE APPLICATION was filed by Marvin E. Prater, President of Twin Valley Garden Center, Inc., 440 North Ohio. (Renewal). The City Clerk reported the applicant has paid the required fee and has the required surety bond and public liability insurance on file. A motion was made by Commissioner Duckers, seconded by Commissioner Usher that the license application be approved and the City Clerk be authorized to issue the license. Ayes: (5). Nays: (0). Motion carried. A LETTER was received from Carmen Chirveno, Director of Little House, to have time on the City Commission meeting January 26, 1976 to give a report on the activities of Little House, located at 901 North Ninth Street. Ms. Carmen Chirveno was present, and reported Little House will be one year old in February and this is just a courtesy report of the activities of Little House. She presented the Commissioners with a statistical report of the participants in learning activities of "Little House, Inc." She explained Little House is primarily for education; and they made extensive efforts not to duplicate any services. She said their primary objective is to help people learn to read. Commissioner Simpson asked if she had any idea what the illiteracy rate is in Salina? Ms. Chiveno replied she would guess it to be about 7% of the total population. She said they help some people achieve their G.E.D., but their primary objective is to help people learn to read. They help selected children overcome delinquent school patterns, and to teach English to the Vietnamese on a 1 to 1 basis. As a walk-in center, people come in for help in making application for food stamps, social security, to have letters and the newspaper read to them. They help people in developing and writing contracts. She explained that Little House has 3 basic phases; 1. education, to help people to help themselves; 2. Little House Free University, where people volunteer to teach things they know; 3. to help have a greater understanding of the various minority problems, and the various other problems of understanding other cultures. She reported they have been very successful with having a great amount of support and cooperation from the Police Department, Marymount College, and volunteer tutors. She said she wanted to publicly show her appreciation to the City of Salina for its cooperation. Mayor Caldwell asked what kind of budget they operate on. She replied everything is volunteer, including her services, and the funds received are all private donations, which do not come from the City of Salina. They come from friends of different areas. "There have been some private donations from a couple of service clubs and the School Board pays $210.00 a month for working with the G.E.D." She said they pay $175.00 for rent and approximately $110.00 for utilities and everything else, books, materials, furniture have all been donated. Mayor Caldwell said she has been doing an excellent job. 255 Commissioner Usher said he has been impressed by the way she approached the community when she first came here, and he appreciated that. He said it has paid dividends, and the job she is doing is great. He said he is surprised to find out the number of people being helped. Commissioner Duckers said he wanted to add a word of congratulations for the fine job she is doing. He said it is very refreshing to have someone come to City Hall and not be seeking some kind of funding, or want some applicatio s filled out. "I think it is a good lesson for all of us that you are setting here and you certainly are to be commended." The Commissioners brought the following item to the floor for discussion Commissioner Duckers said he would like to see the Commission do something rather than continue to pump money into our antiquated baseball park. He said he still doesn't have any proposal, but he intends to put something on the agenda next week just to seek ideas of what we ought to do from the public and interested groups. He said the rodeo people have met with the American Legion Baseball Park people and they want to continue to have the present stadium for rodeo use, but the Memorial Stadium Baseball Park Committee has some ideas and other groups have ideas, and he feels they should be consideri these to see what they can do to come up with some good facilities here in Salina.
