Special Meeting of the Board
Of Commissioners
October 14, 1975
The Special Meeting of the Board of Commissioners met in the
Commissioners' Room, City -County Building, on Tuesday, October 14, 1975, at
11:45 A.M. for the purpose of reconsidering the bids received for Police vehicles.
There were present:
Mayor Robert C. Caldwell, Chairman presiding
Commissioner Keith G. Duckers
Commissioner Gerald F. Simpson
Commissioner W. M. Usher
Commissioner Jack Weisgerber
comprising a quorum of the Board, also:
L. 0. Bengtson, City Attorney
Norris D. Olson, City Manager
D. L. Harrison, City Clerk
Absent:
None
The City Attorney explained that the apparent low bidder at the time th
bids were opened, Jim Sullivan Chevrolet Company, has indicated to us through the r
attorney that a mistake was made in their bid and they feel no contract was enter(d
into, and in view of this have refused to deliver the vehicles in accordance with
their bids, and your action now would be whether you want to proceed and award th
contract to the next lowest bidder, Bennett Pontiac, Inc.
Commissioner Usher asked if staff has talked with Bennett to see if he
is in a position to stick with his bid?
Mr. Harris reported staff has talked with him a couple of times and he
is in a position to deliver the vehicles providing a decision is made promptly.
Mr. Harrison reported Bennett Pontiac's bid is $33,269.00.
A motion was made by Commissioner Duckers, seconded by Commissioner
Usher to award the contract to Bennett Pontiac, Inc., in the amount of $33,269.00
for the eight police vehicles. Ayes: (5). Nays: (0). Motion carried.
Commissioner Weisgerber brought up the possibility of litigation.
A motion was made by Commissioner Usher, seconded by Commissioner Simps n
that the Board of Commissioners recess for an executive session. Ayes: (5).
Nays: (0). Motion carried.
The Board of Commissioners recessed at 11:55 and reconviened at 12:13.
A motion was made by Commissioner Simpson, seconded by Commissioner
Duckers to allow Jim Sullivan Chevrolet Company to withdraw their bid on the
eight police vehicles. Ayes: (5). Nays: (0). Motion carried.
Commissioner Usher said, "Because of this some kind of a change in our
bidding procedure has to be considered, because I don't think it is the respon-
sibility of the City Commission to continue to protect bidders because they make
mistakes and I think some method needs to be discussed on how we can prevent that
in the future."
Commissioner Weisgerber said, "I don't think it is practical to get
involved in a law suit for a difference of $3,000. At the same time this isn't
a very happy situation. Probably the answer is a study and a change in the bid
procedures so we don't get involved in this again."
A motion was made by Commissioner Duckers, seconded by Commissioner
Simpson that the Special Meeting of the Board of Commissioners be adjourned.
Ayes: (5). Nays: (0). Motion carried.
