August 18, 1975
The Regular Meeting of the Board of Commissioners met in the
Commissioners' Room, City -County Building, on Monday, August 18, 1975 at four
o'clock P.M.
The Mayor asked everyone to stand for the pledge of allegiance to the
Flag and a moment of silent prayer.
There were present:

DAY''. The proclamation was read by Roger Morrison, United Way Chairman.
STAFF AGENDA
Bids were received on Bond Series P-217 for $428,000.00 for 10 years.
The Bids were opened and tabulated by the City Clerk. A motion was made by
Commissioner Usher, seconded by Commissioner Simpson to award the bid to Ranson
and Company, Inc., Wichita, Kansas, for a total interest cost to the City of
$133,690.63, with an average interest rate of 5.22229%, and to introduce an
ordinance for first reading authorizing the issuance of Internal Improvement
Bond Series P-217. Ayes: (4). Nays: (0). Motion carried.

AN ORDINANCE was introducLed for second reading entitled: ''AN ORDINANCE
approving, adopting and appropriating by fund the budget of the City for the year
beginning January 1, 1976." A motion was made by Commissioner Weisgerber,
seconded by Commissioner Usher to adopt the ordinance as read and the following
vote was had: Ayes: Simpson, Usher, Weisgerber, Caldwell (4). Nays: (0).
Commissioner Duckers absent. Carried. The Mayor approved the ordinance and it
is numbered 8449. The ordinance was introduced for first reading August 11, 1975
THE CITY COMMISSIONERS considered an ordinance for second reading
entitled: ''AN ORDINANCE changing the name of a certain street located within the
City of Salina, Kansas.'' (Seitz Drive to Eastborough Road)
Petition Number 3505 was filed by Ella Drown prior to the meeting and
it was signed by eight property owners on Seitz Drive protesting the street name
change.
Mr. Lou Ticket asked if this change was requested by petition or on the
recommendation of the City Planner.

Keith Rawlings explained the recommendation was from the City Planning
Commission because the City Planning Commission and the City Commission approved
the plat of Georgetown Addition which has a street named Eastborough Road on the
east edge of the plat and they feel Seitz Drive should be changed so this can be
a through street when the entire area is platted and developed.
Mr. Tickel said, "Individuals do have rights, and as the ones who have
paid for this street, owning the land adjacent to the street, we are all opposed.
We can see nothing to gain by changing the name except causing a lot of undue
hardship. Eastborough Road does not go all the way through, there is also an
area not presently in the City, and it is speculation what is going to happen to
that so far as development goes, it would have been easier to approve the name
of the street platted in Georgetown Addition to be Seitz Drive, and there wouldn'
be any problem at all."
Mayor Caldwell commented there was no response from the property owners
when the matter was considered by the City Planning Commission.
Mr. Tickel replied he has been out of town and the first he knew of it
was when a friend told him about it. He said the people rely on the City
Commission to safeguard a lot of their rights, and to change a street name for
something that may happen in the future certainly causes a lot of undue hardship
on the people who live there at the present time and there is nothing to gain by
changing it at this time.
Mr. Terry Odle was present protesting the possibility of having a
through street there, because it would become a thoroughfare and not really serve
that many houses.
Mr. Tom Drown, 156 Seitz Drive was concerned about the run off of rain
water from Georgetown Addition.
Mrs. Tom Drown said moving is becoming more difficult because of the
extensive use of computers, it takes months to get numbers and names changed.
The mail is missent and lost.
Mayor Caldwell asked if there was any protest at the hearing on the
changing of the name of the street.
Mr. Rawlings said the City Planning Commission did not notify the
property owners due to the fact that it was up for their consideration as to
what action they wanted to take, and they chose to go ahead and pass at that
time the recommendation on to the City Commission without official notification
on its part.
Mayor Caldwell asked if they usually sent out notification about
changing the name of a street.
Mr. Rawlings replied they don't always do that, and that they are not
required to do that.
Mr. Olson said planners have to plan to get continuity. Now are you
saying, am I hearing this? Leave Seitz Drive named as Seitz Drive and change
this quarter section strip in Georgetown Addition to Seitz Drive?
Mr. Tickel replied,"If you are going to change anything, I am in
favor of this. There is nobody living on that street that it would affect."
Mr. Olson said,"Then you would not be disrupting the present labeling
of Eastborough down to this point where it takes a curve at your house and you
would continue there with Seitz Drive over to Crawford. There must be the
continuity, so as an alternative, and looking for a possible alternative,
don't know if we have gone that far, what would your reaction be to that Keith?"
Mr. Rawlings replied, "I think possibly it would be the second best
alternative, but I think that part of the consideration in this was the fact
that we do have no through streets in that area, and this would be the only one
for at least 1/2 mile. Salina has collectors leading into arterials which are

generally separated by sections one mile apart and the distance of the collectors
in between are generally 1/2 mile intervals, this particular street is going to
be serving, no matter what the street name is, it is going to be serving as a
collector street. It is an established street name down this half section line.
I think that one of the things said earlier is true, that there are about an
equal number of homes on Eastborough as on Seitz, it is only true if you restrict
your discussion to that small segment of Eastborough that shows on the map you
have there. There is another 1/2 mile or so north of that that is also Eastborou h
Road and so we did perhaps consider changing Eastborough to Seitz. I can't speak
for the Planning Commission about the willingness to go Seitz Drive on the
Georgetown property. My personal feeling would be somewhat negative, but not
totally without some further consideration."
A motion was made by Commissioner Usher, seconded by Commissioner
Simpson to return the matter to the City Planning Commission for their
reconsideration of naming the street Seitz Drive to the south, through Georgetowr
Addition to Crawford, instead of changing the present Seitz Drive to Eastborough
Road. Ayes: (4). Nays: (0). Motion carried.
Commissioner Usher suggested in the future situations, the people
should be notified as a matter of courtesy, so they can appear at the meeting anc
make their wishes known.
COMMISSION AGENDA
A MOTION was made by Commissioner Usher, seconded by Commissioner
Weisgerger to add appointments to boards and commissions to the agenda for
consideration. Ayes: (4). Nays: (0). Motion carried.
THE MAYOR, with the approval of the City Commissioners, made the
following appointments:

Dr. Daniel L. Bratton, President of Kansas Wesleyan University
Building Trustee Courthouse Renovation Committee

PUBLIC AGENDA
PETITION NUMBER 3502 was filed by H. A. Weber for the rezoning of
Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, and the West 17 feet of Lots 19 and 20,
Block 1, Calkins Addition from District "B" (Two -Family Dwelling House District)
to District "F" (Light Industrial District). A motion was made by Commissioner
Weisgerber, seconded by Commissioner Usher to refer the petition to the City
Planning Commission. Ayes: (4). Nays: (0). Motion carried.
PETITION NUMBER 3503 was filed by William D. Smith for the rezoning
of Lots 8, 9, 10, Block 3, Riverview Addition from District "A" (Second Dwelling
House District) to District "C" (Apartment House District). A motion was made
by Commissioner Usher, seconded by Commissioner Simpson to refer the petition to
the City Planning Commission. Ayes: (4). Nays: (0). Motion carried.
PETITION NUMBER 3504 was filed by Mrs. Izetta M. Lamer for the rezoning
of Lots 28, 30, and 32, Block 2, Episcopal Military Institute Addition from
District "B" (Two -Family Dwelling House District) to District "D" (Local Business
District). A motion was made by Commissioner Usher, seconded by Commissioner
Weisgerber to refer the petition to the City Planning Commission. Ayes: (4).
Nays: (0). Motion carried.
A CEREAL MALT BEVERAGE License Application was filed by B. E. Ott,
d/b/a Ott 66 Service, 2230 North Ninth Street. (New application for package sale
only). The City Clerk reported the applicant has paid the required fee, and the
application has been approved by the Health Department, Zoning Officer and the
Police Department. A motion was made by Commissioner Simpson, seconded by
Commissioner Usher to approve the license application and authorize the City
Clerk to issue the license. Ayes: (4). Nays: (0). Motion carried.

A LETTER was received from Verle Burt requesting a waiver of the
required 20 acre restriction for water hook up in Rural Water District Number 3.
Mr. Burt was present and explained he had recently purchased 13.5 acres
from Allan Hocking through the Gus Reed Agency, and was denied a request to
hook up to rural water because he did not have a 20 acre tract and is unable to
purchase any additional property.
Mr. Olson explained that at the time the negotiations were entered into
between the City and the rural water district, there was a desire of the City at
that time to put a 40 acre stipulation, and this was reduced and agreed to a limi
of 20 acres, the premise being the City had no argument with providing water to
truly rural residents, in fact they wanted to do it, but it was placed in the
agreement to discourage the creation of a city immediately along side the city,
the residents of which have made Salina what it is today, including the utilities
the streets, the payments for all the things that are good that do with the City.
The board and the members who made up the rural water district at that time had
no arguments with that whatsoever, and were fully aware of not only that conditior
but all the other 18 conditions that went into the contract.
A motion was made by Commissioner Usher, seconded by Commissioner
Simpson to deny the request. Ayes: (4). Nays: (0). Motion carried.
A MOTION was made by Commissioner Usher, seconded by Commissioner
Weisgerber that the Regular Meeting of the Board of Commissioners be adjourned.
Ayes: (4). Nays: (0). Motion carried.
