The Regular Meeting of the Board of Commissioners met in the Commission rs'
Room, City -County Building, on Monday, September 19, 1977, at four o'clock p.m.
The Mayor asked everyone to stand for the pledge of allegiance to the
Flag and a moment of silent prayer.
There were present:

Meeting September 12, 1977 were approved as printed.
THE MAYOR PROCLAIMED Saturday, September 24, 1977 - "SALINA HUNTING AND
FISHING DAY'. The proclamation was read by Dick Worth, Legislative Chairman of
the Saline County Rod and Gun Club.

AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE
annexing certain land to the City of Salina, Saline County, Kansas, in conformityi,!
with the provisions of K.S.A. 12-519 to 12-526, inclusive." [32 acre tract in i
the NE 1/4 of Section 35-13-3, requested in Petition Number 3654 filed by John W.
Mize.] A motion was made by Commissioner Simpson, seconded by Commissioner 11
Weisgerber to adopt the ordinance as read and the following vote was had: Ayes: 11
Simpson, Weisgerber, Geis, Graves, Duckers (5). Nays: (0). Carried. The Mayor II
approved the ordinance and it is numbered 8600. The ordinance was introduced fore
first reading September 12, 1977•

AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE
levying special assessments against certain property to pay the cost of constructing
certain sidewalks in the parking abutting the following property to -wit:
A concrete sidewalk installed at the property line on
the east side of Ohio Street, adjacent to Lot 1, Block 1,
Mayfair Addition to the City of Salina, Saline County, Kansas.
A concrete sidewalk installed at the property line on the
west side of Belmont Boulevard, adjacent to Lot 14, Block 7,
Key Acres Addition to the City of Salina, Saline County,
Kansas.
A concrete sidewalk installed at the property line on the R
east side of Belmont Boulevard, adjacent to Lots 3, 49 5,
Block 29, Key Acres Addition to the City of Salina, Saline
County, Kansas.''

A motion was made by Commissioner Graves, seconded by Commissioner Weisgerber to
adopt the ordinance as read and the following vote was had: Ayes: Simpson,
Weisgerber, Geis, Graves, Duckers (5). Nays: (0). Carried. The Mayor approved
the ordinance and it is numbered 8601. The ordinance was introduced for first
reading September 12, 1977.
A CHARTER ORDINANCE was introduced for second reading entitled: ''A
CHARTER ORDINANCE exempting the City of Salina, Kansas, from the provisions of
K.S.A. 13-1024a and providing substitute and additional provisions on the same
which relate to general improvements and the issuance of bonds for the purpose of
paying for said improvements.'' A motion was made by Commissioner Weisgerber,
seconded by Commissioner Geis to adopt the Charter Ordinance as read and the
following vote was had: Ayes: Simpson, Weisgerber, Geis, Graves, Duckers (5).
Nays: (0). Carried. The Mayor approved the Charter Ordinance and it is numbered
13. The Charter Ordinance was introduced for first reading September 12, 1977.
THE CITY ENGINEER filed plans and specifications for a 20'' water line
on Ohio Street from Crawford Street to Magnolia Road, and on Magnolia Road from
Ohio Street to Ninth Street. (Engineering Project 77-626). A motion was made by
Commissioner Geis, seconded by Commissioner Simpson to accept the plans and
specifications for a 20'' water main in Engineering Project 77-626. Ayes: (5).
Nays: (0). Motion carried.
N MOTION was made by Commissioner Simpson, seconded by Commissioner
Geis to set the date of October 3, 1977 as the date to receive bids for a 20''
water main in Engineering Project 77-626, and instruct the City Clerk to advertise
for bids. Ayes: (5). IJays: (0). Motion carried.
PUBLIC AGENDA
PETITION NUMBER 3660 was filed by A. B. Seelye Company, Inc. for the
vacation of a 50 foot oil pipeline easement in Lots 1 and 39, Block 16; Lots 6,
11, and 12, Block 6; Lots 3 and 6, Block 7; Lots 2, 4, 6, 8, and 10, Block 8;
Block 5 and Lot 7, Block 2, Georgetown Addition. A motion was made by Commission
Graves, seconded by Commissioner Simpson to refer the petition to the City
Engineer for a recommendation. Ayes: (5). Nays: (0). Motion carried.
A LETTER was received from the Salina Area Chamber of Commerce Conventiolns
Task Force Chairman, Ken Stephenson, and Chamber President Roy Allen requesting
that the City Commissioners proceed with the necessary legal steps to enact a
2% bed tax. i
Mr. Ken Stephenson was present and explained the fund will be used for
conventions and tourism for the entire community and not just for the Bicentennial
Community Center. He said the Chamber of Commerce met with hotel and motel
operators, 15 of the 18 were represented, and no one opposed, but they did
question how the money would be used. He explained that Senate Bill 37 clearly
outlines how the funds are to be gathered and how they may be used.
Mayor puckers said a 10 member board will be appointed by the City
Commission, 6 members will be from the hotel, motel industry.
A motion was made by Commissioner Simpson, seconded by Commissioner
Graves, to proceed to draft the necessary ordinance to put this in effect in the
City of Salina. Ayes: (5). Nays: (0). Motion carried.
A CEREAL MALT beverage license application was filed by Trey, Inc.,
d/b/a Sandpiper Club, 261 South Broadway. (New application.) The City Clerk
reported the applicant has paid the required fee and the application has been
approved by the Health Department, Zoning Officer, and the Police Department. A
motion was made by Commissioner Simpson, seconded by Commissioner Geis to approve
the license application and authorize the City Clerk to issue the license. Ayes:
(5). Nays: (0). Motion carried.

Mr. Usher outlined the Groundbreaking Ceremonies to be held 10:00 A.M.,
Monday, September 26, 1977•
The Commissioners did not bring any other item to the floor for discussion.
Mr. Bengtson, City Attorney, asked the Commissioners to recess into
Executive Session to discuss a matter of litigation and a matter of land acquisition.
A motion was made by Commissioner Weisgerber, seconded by Commissioner
Graves to recess into Executive Session to discuss litigation and land acquisitioj.
Ayes: (5). Nays: (0). Motion carried.
