07-11-1977 Minutes7-�,,,is City of Salina, Kansas Regular Meeting of the Board of Commissioners July 11, 1977 The Regular Meeting of the Board of Commissioners met in the Commissione I Room, City -County Building, on Monday, July 11, 1977, at four o'clock p.m. The Mayor asked everyone to stand for the pledge of allegiance to the I Flag and a moment of silent prayer. There were present: Mayor Keith G. Duckers, Chairman presiding Commissioner Dan S. Geis Commissioner Karen M. Graves Commissioner Gerald F. Ayes: (5). Nays: (0). Motion carried. BIDS WERE RECEIVED for the lease of agricultural land in Section 7-15-3: (3 year lease) Quenten L. and Dennis D. Swenson H & R Peterson Farms, Inc. Kelley Brothers Darwin and Keith Bacon 2/5 share of grain crops $2,850.00 a year for pasture land 2/5 share of grain crops plus $1.00/acre or $427.00 toward fertilizer expense $1,870.00 a year for pasture land 1/3 share of grain crops $2,286.00 a year for pasture land 1/3 share of grain crops $1,505.00 for pasture land A motion was made by Commissioner Simpson, seconded by Commissioner Geis to accept the Quenten L. and Dennis D. Swenson bid subject to approval by the legal department. Ayes: (5). Nays: (0). Motion carried. A PUBLIC HEARING was held by the City Manager for the proposed use of Revenue Sharing Funds for the Sth and 9th Entitlement Periods. There were no written or oral comments concerning the proposed use of Revenue Sharing Funds, therefore the public hearing was closed. AN ORDINANCE was introduced for second reading entitled; ''AN ORDINANCE levying special assessments on lots, pieces and parcels of ground in the City of Salina, Kansas, for the purpose of paying a portion of the cost of: Curbing, guttering, paving and grading of ARGONNE DRIVE from the east line of Estates Drive to the East line of Lot 12, Block 2, Country Club Estates Addition Number 2, Curbing, guttering, paving and grading of DOUGLAS DRIVE from the south line of Argonne Drive to the south line of Lot 18, Block 3, Country Club Estates Addition Number 2, Water main and services for certain lots in Country Club Estates Addition Number 2, Lateral Sanitary Sewer 550." (Engineering Project 76-608) A motion was made by Commissioner Graves, seconded by Commissioner Geis to adopt the ordinance as read and the following vote was had: Ayes: Weisgerber, Geis, Graves, Simpson, Duckers (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered _8574. The ordinance was introduced for first reading June 27, 1977• A RESOLUTION was introduced and passed entitled: ''A RESOLUTION authorizii and approving certain curbing, guttering, paving, grading, water main and services and sanitary sewer improvements, ordering preparation of plans and specifications, and the estimate of costs.'' (Improvements in Dow, Replat of Dow, Key Acres 2nd, and Georgetown Additions.) [Engineering Project 77-620.1 A motion was made by Commissioner Simpson, seconded by Commissioner Weisgerber to adopt the Resolution as read and the following vote was had: Ayes: Weisgerber, Geis, Graves, Simpson, Duckers (5). Nays: (0). Carried. The Mayor approved the Resolution and it is numbered 3330. W THE CITY ENGINEER filed plans and specifications for Engineering Project 77-622 for sidewalk improvements on Ohio Street and Belmont Boulevard, which were requested in Petition Numbers 3609 and 3633. A motion was made by Commissioner Geis, seconded by Commissioner Graves to accept the plans and specifications as filed by the City Engineer. Ayes: (5)• Nays: (0). Motion carried. A MOTION was made by Commissioner Geis, seconded by Commissioner Graves to set the date of July 25, 1977 as the date to receive bids on Engineering Project 77-622, and instruct the City Clerk to advertise for bids. Ayes: (5). Nays: (0). Motion carried. THE CITY ENGINEER filed a feasibility report for water and sanitary sewer improvements in Hocking Addition, requested in Petition Number 3638 filed by Alan Hocking. A motion was made by Commissioner Simpson, seconded by Commissior Weisgerber to accept the feasibility report as filed. Ayes: (5)• Nays: (0). Motion carried. THE CITY MANAGER reported on bids received June 27, 1977 for property in the Northeast Industrial Park, that the successful bidders are: Central Supply Company, Inc. Block 10 $3,510.00 Wilfam, Inc. Lots 4 & 5 Block E 23,330.00 Wilfam, Inc. Lots 2, 3, 4, Block F 22,750.00 Q. A. Applequist Lots 1 & 2 Block 4 5,600.00 and that each meets or exceeds the minimum acceptable price. The City Planner explained there are minor problems or discrepancies either in the statement of proposed use or in the site plans of each bidder, but each has agreed to correct the problems. A motion was made by Commissioner Simpson, seconded by Commissioner Geis to accept the bids recommended by the City Manager with the exceptions noted by the City Planner. Ayes: (5). Nays: (0). Motion carried. A MOTION was made by Commissioner Geis, seconded by Commissioner 'Simpson to introduce an ordinance for first reading entitled; "AN ORDINANCE ;authorizing the City of Salina, Kansas, to purchase and acquire the real estate hereinafter described and to construct thereon certain buildings and improvements and to purchase machinery and equipment, all to be used for industrial and ,manufacturing facilities, and to be leased to Research Chemical Company; authorizir land directing the issuance of $1,000,000.00 principal amount of Salina, Kansas, ;Research Chemical Company Industrial Revenue Bonds of 1977, of said City for the ;purpose of providing funds for the purchase of the real estate and the construction of buildings and improvements thereon and to purchase machinery and equipment to Lbe used for industrial and manufacturing facilities to be leased to Research ':Chemical Company; and prescribing the form and authorizing the execution of a (lease by and between said City and Research Chemical Company.'Ayes: (5). Ordinance Passed: Number: A MOTION was made by Commissioner Weisgerber, seconded by Commissioner !Graves to introduce an ordinance for first reading entitled: "AN ORDINANCE ;providing for the removal of abandoned railroad tracks from the city street 'right-of-way; however retaining the rights of the Chicago, Rock Island and 'Pacific Railroad Company, Union Pacific Railroad Company, Missouri Pacific Railroad Company, and the Atchison, Topeka and Santa Fe Railroad Company, in regard to the future use of such crossings.'Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: :r 1 1 1 301 PUBLIC AGENDA PETITION NUMBER 3646 was filed by George C. Etherington for the vacatior of a 20 foot utility easement between Lots 2, 3, 37, 38, Block 16, Georgetown Addition; and the vacation of the east 25 feet of a 50 foot pipeline easement located on Lots 1, 2, 3, 4, 5, 6, Block 16 and Lots 1, 2, 3, 4, 5, 6, 7, Block 19, Georgetown Addition. A motion was made by Commissioner Simpson, seconded by Commissioner Graves to refer the petition to the City Engineer for a recommendatic Ayes: (5). Nays: (0). Motion carried. PETITION NUMBER 3647 was filed by Robert F. Miller for the annexation of a tract of land in the Northwest Quarter of Section 20, Township 14 South, Range 2 West. A motion was made by Commissioner Geis, seconded by Commissioner Weisgerber to refer the petition to the City Planning Commission for a recommendation. Ayes: (5). Nays: (0). Motion carried. PETITION NUMBER 3648 was filed by Raymond E. Folken for the vacation of a triangular tract of land in the Southeast corner of the intersection of Edward and Fulton Streets. A motion was made by Commissioner Graves, seconded by Commissioner Geis to refer the petition to the City Engineer and City Planning Commission for a recommendation. Ayes: (5). Nays: (0). Motion carried. A REQUEST was received from the co -directors of the Martin Luther King, Jr. Child Care Center Association, 1214 North Santa Fe, for a signal light, flashing light, or similar device to be installed at the crosswalk at 1214 North Santa Fe. Geraldine Briscoe, Jerry J. Nelson and Karolyn K. Zerger were present. Geraldine Briscoe read their letter to the City Commission. Karolyn Zerger explained that there is a crosswalk, but drivers do not stop for people in the crosswalk. They have tried signing complaints against violators but this has not been satisfactory because the charges are dismissed somewhere in the process. A motion was made by Commissioner Weisgerber, seconded by Commissioner Graves to refer the request to Traffic and Engineering for a recommendation. Ayes: (5). Nays: (0). Motion carried. A REQUEST was received from George Etherington for an access opening on Marymount Road 300 feet north of the southwest corner of Lot 7, Block 2, Georgetown Addition; and an access opening on Crawford Street 300 feet East of the southwest corner of Lot 7, -Block 2, Georgetown Addition. A motion was made by Commissioner Simpson, seconded by Commissioner Geis to refer the request to the City Engineer and the City Planning Commission for a recommendation. Ayes: (5)• Nays: (0). Motion carried. A REPORT was received from the Baseball Study Committee that it had voted to review its original recommendation and determine if any additions or deletions should be recommended. A motion was made by Commissioner Geis, seconded) by Commissioner Simpson to accept the report from the Baseball Study Committee. Ayes: (5). Nays: (0). Motion carried. Mr. Philip Sanchez, 1227 Elmhurst, read a prepared statement relating to locating the Salina baseball diamonds in a proposed family sports complex at the old municipal airport. A motion was made by Commissioner Simpson to receive the report without comment and hold it in abeyance until the Baseball Committee report is received. COMMISSION AGENDA The Commissioners did not bring any item to the floor for discussion.
