Regular Meeting of the Board

March 21, 1977
The Regular Meeting of the Board of Commissioners met in the Commissi
Room, City -County Building, on Monday, March 21, 1977, at four o'clock p.m.
The Mayor asked everyone to stand for the pledge of allegiance to the
Flag and a moment of silent prayer.

The Minutes of the Regular Meeting of March 14, 1977 were approved as

A motion was made by Commissioner Usher, seconded by Commissioner Graves to
award the bid for $6,500,000 General Obligation Bonds to Stern Brothers and
Company, consortium, with the lowest net interest cost to the City of 4.948768%,
and to introduce the bond ordinance for first reading. Ayes: (5). Nays: (0).

A RESOLUTION was introduced and passed entitled: "A RESOLUTION to
accept the assignment of all remaining duties and responsibilities in completion
of the Salina Urban Renewal Project No. Kans. R-29." A motion was made by
Commissioner Usher, seconded by Commissioner Duckers to adopt the Resolution as
read and the following vote was had: Ayes: Duckers, Graves, Usher, Weisgerber,
Simpson (5). Nays: (0). Carried. The Mayor approved the Resolution and it is
numbered 3313.

The City Manager reported there is a surplus in the R-29 project of
$205,814.30, and the completion of this project also frees a surplus in the A-8
project of $73,141.30. The money will be made available to the CD Block Grant
Program as will any money from the land inventory in the Northeast Industrial
Park Project, and is over and above the approved CD allocation.

providing for the amendment of Ordinance Number 8526, the same being Chapter 36
of the Salina Code, and the Zoning District Map therein and thereby adopted and
providing for the rezoning of certain property within the City and prescribing

numbered 8549. The ordinance was introduced for first reading March 7, 1977.
THE CITY CLERK reported the assessment rolls are ready for the following
improvements, to -wit: (Engineering Project 76-604)
Curbing, guttering, paving, grading and drainage of the FRONTAGE ROAD
from the south line of Lot One (1), Block One (1), Sullivan Addition
to the City of Salina, Saline County, Kansas, to the north line of
Belmont Boulevard, extended.
Curbing, guttering, paving and grading of PLANET AVENUE from the south
line of Saturn Avenue north Eight Hundred Sixty-two and forty-one
hundredths feet (862.41') to the existing pavement.

The assessments have been determined and the final costs have been
filed by the City Engineer.
A motion was made by Commissioner Duckers, seconded by Commissioner
Weisgerber to instruct the City Clerk to publish notice in the official city
newspaper at least once not less than ten days prior to the date of April 4,
1977, the date set for the hearing on said assessments, and that at the same
time notice is published to mail to the owners.of property made liable to pay
the assessment, at their last known post office address, a notice of the hearing
and a statement of the cost proposed to be assessed against the land so owned
and assessed. Ayes: (5). Nays: (0). Motion carried.

THE CITY ENGINEER reported on Petition Number 3625 which was filed by
Stanley Livengood and Donald Dieckhoff requesting vacation of a 20 foot easement
in the replat of Block 10, Riker Addition, that the easement affects only that
property which is owned by the petitioners; that the easement has not been used
in the past for any utilities and there are no present plans for its use in the
future; that the lots affected have utility access on other public rights-of-
way, and recommended the vacation of the easement. A motion was made by Commissi
Weisgerber, seconded by Commissioner Usher to accept the City Engineer's recommen
and to approve the petition and introduce an ordinance for first reading to
vacate the easement. Ayes: (5). Nays: (0). Motion carried.

the Salina Code, and repealing the existing section. Ayes: (5). Nays: (0).

dimensional requirements for zoning lots; amending Appendix B, Section VI(E)(1)

A LETTER was received from the City Planning Commission recommending
the approval of the final plat of Blocks 11 and 12, Northeast Industrial Park,
as requested in Petition Number 3414-I, which was filed by the Salina Urban
Renewal Agency. A motion was made by Commissioner Usher, seconded by Commissioner
Duckers to accept the recommendation of the City Planning Commission and approve
the final plat of Blocks 11 and 12, Northeast Industrial Park, and authorize the
Mayor to sign. Ayes: (5). Nays: (0). Motion carried.
A LETTER was received from the City Planning Commission recommending
the approval of a Planned Development District for Lot 1, Block 1, Holmquist
Estates Addition, as requested in Petition Number 3623 which was filed by
A. J. Holmquist. A motion was made by Commissioner Graves, seconded by Commissi
Duckers to accept the recommendation of the City Planning Commission and approve
the petition, and to introduce the rezoning ordinance for first reading. Ayes:
(5). Nays: (0). Motion carried.

A LETTER was received from the City Planning Commission recommending
the approval of the rezoning of Nord Subdivision from District A-1 (Agricultural
District) to District MH (Mobile Home Park District) as requested by Kenneth
Nordboe in Zoning Request Z77-1, subject to 3 corrections on the mobile home
park plan. A motion was made by Commissioner Graves, seconded by Commissioner
Duckers to accept the recommendation of the City Planning Commission and approve
the Zoning Request and to introduce the rezoning ordinance for first reading.
Mr. Nordboe was present and asked the City Commission to make a
determination if they would allow gravel on the streets he dedicated in his
subdivision.
Jim Maes, explained that, according to the Mobile Home Ordinance,
dedicated streets in a mobile home court must be paved according to the engineeri
standards prior to placement of mobile homes on the lots; but private streets
allow for surfacing with gravel, asphalt, concrete, sand or any suitable substitu
Mr. Nordboe asked to have the streets in Nord Subdivision vacated if
the City Commission will not approve gravel streets.
Mr. Bengtson explained to Mr. Nordboe that he must file a petition to
vacate the streets.
The Mayor called for a vote on the motion to accept the City Planning
Commission's recommendation. Ayes: (5). Nays: (0). Motion carried.

PETITION NUMBER 3627 was filed by Richard and Ann Barlow, for the
annexation of a tract of land in the Southwest Quarter of the Northwest Quarter
of Section 20, Township 14 South, Range 2 West. A motion was made by Commissioner'
Usher, seconded by Commissioner Weisgerber to refer the petition to the City
Planning Commission for a recommendation. Ayes: (5). Nays: (0). Motion carried.!
A CEREAL MALT Beverage License application was filed by J. B. Hinkle,
d/b/a Godfather's Pizza of Kansas, 2530 South Ninth Street. (New application)
The City Clerk reported the applicant has paid the required fee and the applicatic
has been approved by the Health Department, Zoning Officer, and Police Department.
A motion was made by Commissioner Duckers, seconded by Commissioner Usher to
approve the license application and authorize the City Clerk to issue the license.

SURETY ON BAIL BOND License applications were filed by Glenn Kearns,
d/b/a Kearns Wholesale Stamp and Coin Supplies, 129 North 7th Street; and Donald
Nesmith, agent for Glenn Kearns. The City Clerk reported the applicants have
paid the required fee and have been fingerprinted by the Police Department, and
that Glenn Kearns has the proper certification of appraisal on file. A motion
was made by Commissioner Weisgerber, seconded by Commissioner Usher to approve
the license applications and authorize the City Clerk to issue the licenses.

COMMISSION AGENDA
A MOTION was made by Commissioner Graves, seconded by Commissioner
Weisgerber to add appointments to boards and commissions to the agenda for
consideration. Ayes: (5). Nays: (0). Motion carried.
THE MAYOR, with the approval of the Board of Commissioners made the
following appointments:
Trustees of the Municipal Band
Glen R. VanCleef, reappointed for a 3 year term to January 1, 1980.
Mobile Home Craftsman Examining Board
Don Mergen, Gas and Plumbing Inspector, reappointed for a 1 year term
to January 19, 1978.
Orville Darrow, Electrical Inspector, reappointed for a 1 year term to
January 19, 1978.
Jim Chase, Licensed Mobile Home Craftsman, reappointed for a 1 year
term to January 19, 1978.
Mayor Simpson asked for citizen volunteers for the Citizens' Advisory
Commission.
The Commissioners did not bring anything to the floor for discussion.
A MOTION was made by Commissioner Weisgerber, seconded by Commissioner
Usher that the Regular Meeting of the Board of Commissioners be adjourned.
