City of Salina, Kansas Regular Meeting of the Board of Commissioners January 17, 1977 The Regular Meeting of the Board of Commissioners met in the Commission Room, City -County Building, on Monday, January 17, 1977, at four o'clock p.m. The Mayor asked everyone to stand for the pledge of allegiance to the Flag and a moment of silent prayer. There were present: Mayor Gerald F. Simpson, Chairman presiding Commissioner Keith G. Duckers Commissioner Karen M. Graves Commissioner W. M. Usher Commissioner Jack Weisgerber comprising a quorum of the Board, also: L. 0. Bengtson, Norris D. Olson, D. L. Harrison, Absent: None City Attorney City Manager City Clerk The Minutes of the Regular Meeting of January 10, 1977, were approved as printed. THE MAYOR PROCLAIMED the Week of January 16 through 22, 1977 - "JAYCEE WEEK". The proclamation was read by Larry McPhail. STAFF AGENDA AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE annexing certain land to the City of Salina, Kansas, in conformity with the provisions of K.S.A. 12-520." (SWC SE14 17-14-2, as requested in Petition Number 3598 which was filed by the Salina Presbyterian Manor Committee.) A motion was made by Commissioner Weisgerber, seconded by Commissioner Usher to adopt the ordinance as read and the following vote was had: Ayes: Usher, Weisgerber, Duckers, Graves, Simpson (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered 8537. The ordinance was introduced for first reading January 10, 1977. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE annexing certain land to the City of Salina, Kansas, in conformity with the provisions of K.S.A. 12-520." (A tract of land in the NE14 SWk 36-13-3, as requested in Petition Number 3602 which was filed by James R. Ward.) A motion was made by Commissioner Usher, seconded by Commissioner Duckers to adopt the ordinance as read and the following vote was had: Ayes: Usher, Weisgerber, Duckers, Graves, Simpson (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered 8538. The ordinance was introduced for first reading January 10, 1977. THE CITY ENGINEER reported on Petition Number 3614 which was filed by Ray Cardwell for water and sanitary sewer service to Blocks 3, 6, 10, Mayfair Addition, that the petitioners constitute 56% of the property owners who own 530 of the property within the benefit district, and it is therefore a valid petition, A motion was made by Commissioner Usher, seconded by Commissioner Duckers to accept the City Engineer's report and approve the petition. Ayes: (5). Nays: (0). Motion carried. rs' 1 11 L 1 1 161 PUBLIC AGENDA PETITION NUMBER 3616 was filed by A. B. Seelye Company, Inc., by George C. Etherington, President for the approval of the replat of Blocks 4, 10, 11, and 12, Georgetown Addition. A motion was made by Commissioner Weisgerber, seconded by Commissioner Usher to refer the petition to the City Planning Commis Ayes: (5). Nays: (0). Motion carried. PETITION NUMBER 3617 was filed by George Etherington for the rezoning of the Replat of Blocks 4, 10, 11, and 12, Georgetown Addition from District "C" (Apartment House District) "R-3" (Multiple Family Residential District) to District "A" (Second Dwelling House District) "R-1" (Single Family Residential District) and "B" (Two -Family Dwelling House District) "R-2" (Multiple Family Residential District). A motion was made by Commissioner Duckers, seconded by Commissioner Usher to refer the petition to the City Planning Commission. Ayes: (5). Nays: (0). Motion carried. PETITION NUMBER 3618 was filed by Dwight S. Tolle, 2126 Edgehill Road, for the rezoning of a tract of land in the East g of the Northeast Quarter of Section 26-14-3, from District "A" (Second Dwelling House District) "RS" (Single Family Residential Suburgan District) to District "B" (Two -Family Dwelling House District) "R-2" (Multiple Family Residential District). A motion was made by Commissioner Usher, seconded by Commissioner Weisgerber to refer the petition to the City Planning Commission. Ayes: (5). Nays: (0). Motion carried. CEREAL MALT Beverage License Applications for 1977 were filed by: The Lighthouse of Salina, Inc., d/b/a The Lighthouse, 671 South Broadway. (New application) Ruth Ann Alley, d/b/a Colonial House, 1842 North Ninth Street. (New application) The City Clerk reported the applicants have paid the required fee, and the applications have been approved by the Health Department, Zoning Officer, and the Police Department. A motion was made by Commissioner Usher, seconded by Commissioner Weisgerber to approve the license applications and authorize the City Clerk to issue the licenses. Ayes: (5). Nays: (0). Motion carried. A TREE TRIMMING and Treating License Application for 1977 was filed by Twin Valley Garden Center., Inc., 440 North Ohio. (Renewal). The City Clerk reported the applicant has paid the required fee and has the proper surety bond and certificate of public liability insurance on file. A motion was made by Commissioner Duckers, seconded by Commissioner Usher to approve the license applications and authorize the City Clerk to issue the license. Ayes: (5). Nays: (0). Motion carried. COMMISSION AGENDA THE COMMISSIONERS brought the following items to the floor for discussio4: Mayor Simpson requested that, "The Engineering Department and the Legal Department initiate whatever needs to be done, a feasibility study, a resolution, to place on the City Commission agenda a request to resurface East i Crawford Street Road from the east side of the bridge extending east to the city limits, including the annexation. We can no longer tolerage the condition of East Crawford or continue to ignore it, if it isn't feasible to patch it up or put some kind of surface until federal funding comes through, I would like to see us attempt to get something done." Commissioner Usher said, "This is a matter of technicality, you mentioned resurfacing, but I don't think that is what you had in mind, so that the City Engineer understands, we want to put in a new road." Mayor Simpson agreed on a new road. The Commissioners and staff discussed the history of East Crawford, availability of funding, and the procedures and time involved to acquire funds. A motion was made by Commissioner Usher, seconded by Commissioner Duckers that the Engineering Department and the Legal Department be instructed to draft the necessary resolution to initiate the improvement and have it ready next week. Ayes: (5). Nays: (0). Motion carried. 162 Commissioner Usher commented on the housing and winterization program. He said, "The news media is attempting to get this out to the community, which we appreciate very much. I did get some feed -back concerning this, and I would like to say again that the winterization does not require inspection of the home, the only requirement is salary, or income. You have to meet a certain income. There must be an inspection of the attic to make sure it needs insulati A MOTION was made by Commissioner Usher, seconded by Commissioner Duckers that the Regular Meeting of the Board of Commissioners be adjourned.
