Regular Meeting of the Board
of Commissioners
January 3, 1977
The Regular Meeting of the Board of Commissioners met in the Commis
Room, City -County Building, on Monday, January 3, 1977, at four o'clock p.m.
The Mayor asked everyone to stand for the pledge of allegiance to the
Flag and a moment of silent prayer.
There were present:

The Minutes of the Regular Meeting December 27, 1976 were approved as
STAFF AGENDA
A RESOLUTION was introduced for second reading entitled: "A RESOLUTION
determining necessity of and directing that the owner or owners of certain lots
construct, in compliance with plans and specifications of the City Engineer, a
sidewalk, abutting said lots within 120 days of the adoption and publication
hereof and providing that in the event the owner or owners fail to do so, that
the City of Salina, shall proceed to construct, or cause to be constructed, said
sidewalk and that the total cost thereof shall be assessed against such lot or
lots on which such sidewalk shall abut as other special assessments." A motion
was made by Commissioner Usher, seconded by Commissioner Weisgerber to adopt the
Resolution as read and the following vote was had: Ayes: Duckers, Usher, Weisge
Simpson (4). Nays: (0). Carried. Mayor Simpson approved the Resolution and it
is numbered 3202. The Resolution was introduced for first reading December 27,
1976.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE
adopting, by reference, the 1976 Edition of the Uniform Building Code and all
appendices, amending Section 9-18 of the Salina Code and repealing the existing
section." A motion was made by Commissioner Duckers, seconded by Commissioner
Weisgerber to adopt the ordinance as read and the following vote was had: Ayes:
Duckers, Usher, Weisgerber, Simpson (4). Nays: (0). Carried. The Mayor approved
the Ordinance and it is numbered 8531. The Ordinance was introduced for first
reading December 27, 1976.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE
adopting, by reference, the 1975 Edition of the One and Two Family Dwelling
Code." A motion was made by Commissioner Usher, seconded by Commissioner
Duckers to adopt the ordinance as read and the following vote was had: Ayes:
Duckers, Usher, Weisgerber, Simpson (4). Nays: (0). Carried. Mayor Simpson
approved the Ordinance and it is numbered 8532. The Ordinance was introduced
for first reading December 27, 1976.

adopting, by reference, the 1976 Edition of the Uniform Plumbing Code, amending
Section 9-200 of the Salina Code and repealing the existing section." A motion
was made by Commissioner Weisgerber, seconded by Commissioner Duckers, to adopt
the ordinance as read and the following vote was had: Duckers, Usher,
Weisgerber, Simpson (4). Nays: (0). Carried. The Mayor approved the Ordinance
and it is numbered 8533. The Ordinance was introduced for first reading
December 27, 1976.
AN ORDINANCE was introduced for second reading entitled; "AN ORDINANCE
adopting, by reference, the 1976 Edition of the Uniform Mechanical Code and all
appendices, amending Section 9-440 of the Salina Code and repealing the existing
section." A motion was made by Commissioner Duckers, seconded by Commissioner
Usher to adopt the ordinance as read and the following vote was had: Ayes:
Duckers, Usher, Weisgerber, Simpson (4). Nays: (0). Carried. The Mayor approved
the Ordinance and it is numbered 8534. The Ordinance was introduced for first
reading December 27, 1976.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE
adopting, by reference, the 1976 Edition of the Uniform Sign Code, except as
modified by Article IV of Chapter 9 of the Salina Code, amending Section 9-63 of
the Salina Code and repealing the existing section." A motion was made by
Commissioner Weisgerber, seconded by Commissioner Usher to adopt the Ordinance
as read and the following vote was had: Ayes: Duckers, Usher, Weisgerber,
Simpson (4). Nays: (0). Carried. The Mayor approved the Ordinance and it
is numbered 8535. The Ordinance was introduced for first reading December 27,
1976.
THE CITY ENGINEER reported on Petition Number 3607, which was filed by
Kenneth Wasserman for Park, Ltd., requesting paving, curbing, and guttering of
Armory Road commencing at Broadway Boulevard, thence westerly for a distance of
approximately 550 feet, all as shown on the plat of Park West Addition, that the
petitioner owns 100% of the property within the benefit district, and it is
therefore a valid petition. A motion was made by Commissioner Usher, seconded
by Commissioner Duckers to accept the City Engineer's report and approve the
petition. Ayes: (4). Nays: (0). Motion carried.
PUBLIC AGENDA
PETITION NUMBER 3613 was filed by Cloyd E. and Darvin D. Dent, for the
rezoning of Lots 12, 13, 14, Block 5, Circle Addition from District "B" (Two -
Family Dwelling House District) "R-2" (Multiple Family Residential District) to
District "C" (Apartment House District) "R-3" (Multiple Family Residential
District). A motion was made by Commissioner Weisgerber, seconded by Commissioner
Usher to refer the petition to the City Planning Commission. Ayes: (4). Nays:
(0). Motion carried.
PETITION NUMBER 3614 was filed by Ray Cardwell for sewer and water
service to Blocks 3, 6, 10, Mayfair Addition to the City of Salina, Kansas. A
motion was made by Commissioner Duckers, seconded by Commissioner Usher to refer
the petition to the City Engineer. Ayes: (4). Nays: (0). Motion carried.
PETITION NUMBER 3615 was filed by William R. Umphrey for the rezoning
of Lots 33 and 35, Block 3, Van Trines Addition from District "B" (Two -Family

Dwelling House District) "R-2" (Multiple Family Residential District) to District
"C" (Apartment House District) "R-3" (Multiple Family Residential District). A
motion was made by Commissioner Usher, seconded by Commissioner Weisgerber to
refer the petition to the City Planning Commission. Ayes: (4). Nays: (0).
Motion carried.

COMMISSION AGENDA
"SELECTION OF A REPLACEMENT for Robert C. Caldwell on the City Commiss
(Sponsored by Mayor Simpson.)
Mayor Simpson recommended Mrs. Karen Graves be appointed to fill the
unexpired term of Robert Caldwell. He said she has agreed to serve and to be a
candidate for election to the office in the City Election.
A motion was made by Commissioner Usher, seconded by Commissioner
Duckers to approve the appointment of Mrs. Karen Graves to fill the unexpired
term of Robert Caldwell on the City Commission. Ayes: (4). Nays: (0). Motion
carried.
THE COMMISSIONERS brought the following item to the floor for discussion;
Commissioner Usher asked that the Commission address the Schilling
Manor problem, and asked that the existing committee be enlarged and that commit
called upon to start examining the position of the City on this problem.
A MOTION was made by Commissioner Duckers, seconded by Commissioner
Weisgerber that the Regular Meeting of the Board of Commissioners be adjourned.
Ayes: (4). Nays: (0). Motion carried.
