Regular Meeting of the Board
of Commissioners
June 7, 1976
The Regular Meeting of the Board of Commissioners met in the Commissi
Room, City -County Building, on Monday, June 7, 1976, at four o'clock p.m.
The Mayor asked everyone to stand for the pledge of allegiance to
the Flag and a moment of silent prayer in rememberence of Albert Hawkes, former
Mayor and Commissioner.
There were present:

A motion was made by Commissioner Duckers to refer the bids to the
City Engineer for checking and consultation with the County Commissioners and
to report back on June 14, 1976 when the contract will be awarded. The
notion was seconded by Commissioner Usher. Ayes: (5). Nays: (0). Motion

AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE
providing for the amendment of Zoning Ordinance Number 6613 and the Zoning
District Map therein and thereby adopted and providing for the rezoning of
certain property within the City and prescribing the proper uses thereof."
(Rezoning of a tract of land in the West � of the Northeast Quarter of Section
19, Township 14 South, Range 2 West (Victoria Heights Subdivision) from District
"C" (Community Unit Plan) to District "A" (Second Dwelling House District) as
requested in Petition Number 3551 which was filed by J. V. Enterprises, Inc.)
A motion was made by Commissioner Caldwell, seconded by Commissioner Weisgerber
to adopt the ordinance as read and the following vote was had: Ayes: Caldwell,
Duckers, Usher, Weisgerber, Simpson (5). Nays: (0). Carried. The Mayor
approved the ordinance and it is numbered 8494. The ordinance was introduced
for first reading May 24, 1976.

Caldwell, Duckers, Usher, Weisgerber, Simpson (5). Nays: (0). Carried. The
Mayor approved the ordinance and it is numbered 8495. The ordinance was
introduced for first reading May 24, 1976.

to adopt the ordinance was read and the following vote was had: Ayes: Caldwell,
Duckers, Usher, Weisgerber, Simpson (5). Nays: (0). Carried. The Mayor
approved the ordinance and it is numbered 8496. The ordinance was introduced
for first reading May 24, 1976.
A LETTER was received from the City Planning Commission recommending
the approval of the preliminary development plan of the Midstate Industrial
Partnership by Delbert Chopp for Lot 1, Block 6, Northeast Industrial Park. A
motion was made by Commissioner Caldwell, seconded by Commissioner Weisgerber
to accept the recommendation of the City Planning Commission and approve the
preliminary development plan. Ayes: (5). Nays: (0). Motion carried.
A LETTER was received from the City Planning Commission recommending
the approval of the rezoning of Lot 7, Block 1, Cloverdale Addition from
District "A" (Second Dwelling House District) to District "F" (Light Industrial
District) as requested in Petition Number 3558 which was filed by Steven J.
Hill). A motion was made by Commissioner Usher, seconded by Commissioner
Duckers to accept the recommendation of the City Planning Commission and
approve the rezoning, and to introduce the rezoning ordinance for first
reading. Ayes: (5). Nays: (0). Motion carried.

A LETTER was received from the City Planning Commission recommending
the approval of the rezoning of Lot 9 and the West � of Lot 11, College View
Addition from District "A" (Second Dwelling House District) to District "B"
(Two -Family Dwelling House District) as requested in Petition Number 3560
which was filed by Otis L. Davis, Jr. A motion was made by Commissioner
Duckers, seconded by Commissioner Weisgerber to accept the recommendation of
the City Planning Commission and approve the rezoning, and to introduce the
rezoning ordinance for first reading. Ayes: (5). Nays: (0). Motion carried.

A LETTER was received from the City Planning Commission recommending
the approval of Petition Number 3562 which was filed by Norman R. Harris and
J. Donald Williams for the annexation of the remainder of Country Club Heights
Addition Number 4. A motion was made by Commissioner Duckers, seconded by
Commissioner Usher to accept the recommendation of the City Planning Commission
and approve the petition and introduce the annexation ordinance for first
reading. Ayes: (5). Nays: (0). Motion carried.

THE CITY ENGINEER filed a feasibility report for street and utility
improvements in Georgetown Addition, as requested in Petition Numbers 3530 and
3531 which were filed by A. B. Seelye Company, Inc., by George C. Etherington.
A motion was made by Commissioner Usher, seconded by Commissioner Duckers to
accept the feasibility report as filed. Ayes: (5). Nays: (0). Motion carried.
THE CITY ENGINEER filed a feasibility report for street improvements
in part of Wallerius Addition, as requested in Petition Number 3559 which was
filed by Warta Buick, Inc., by Lawrence Warta, President. A motion was made
by Commissioner Weisgerber, seconded by Commissioner Usher to accept the
feasibility report as filed. Ayes: (5). Nays: (0). Motion carried.
THE CITY COMMISSIONERS considered the 1980 Functional Classification
of Salina's Federal Aid Urban Street System and the urban area boundary. A
motion was made by Commissioner Duckers, seconded by Commissioner Usher to
approve the 1980 Functional Classification of Salina's Federal Aid Urban
Street System, and the urban area boundary, and authorize the Mayor to sign.
Ayes: (5). Nays: (0). Motion carried.
PUBLIC AGENDA
PETITION NUMBER 3567 was filed by George C. Etherington, for the
paving, roll type curb and gutter, sewer and water on Glen Avenue from Seitz
Drive west to Winn Road; and paving, curb and gutter, sewer and water for all
of Glen Circle, all in Georgetown Addition. A motion was made by Commissioner
Caldwell, seconded by Commissioner Weisgerber to refer the petition to the
City Engineer for a report. Ayes: (5). Nays: (0). Motion carried.
PETITION NUMBER 3568 was filed by Max McClintock for the rezoning of
Lots 8 and 9, Block 5; Lots 8, 9, 10, Block 6; and Lots 8, 9, 10, Block 7;
Lots 8, 9, 10, Block 8, all in Wallerius Addition from District "A" (Second
Dwelling House District) to District "B" (Two -Family Dwelling House District).
A motion was made by Commissioner Weisgerber, seconded by Commissioner Usher
to refer the petition to the City Planning Commission. Ayes: (5). Nays: (0).
Motion carried.
PETITION NUMBER 3569 was filed by Guy E. Trow for sanitary sewer to
serve the housing area on Stimmel Road. A motion was made by Commissioner
Usher, seconded by Commissioner Caldwell to refer the Petition to the City
Engineer for a report. Ayes: (5). Nays: (0). Motion carried.
PETITION NUMBER 3570 was filed by Jack L. Gebhart and Gary C. Gebhart
for the rezoning of Lots 28 and 29, Block 5; and Lot 18, Block 15, Meadowlark
.kcres Addition Number 3 from District "A" (Second Dwelling House District) to
District "D" (Local Business District). A motion was made by Commissioner
Ialdwell, seconded by Commissioner Duckers to refer the petition to the City
Planning Commission. Ayes: (5). Nays: (0). Motion carried.

A SURETY ON BAIL BOND LICENSE Application was filed by Gary L.
Partridge, d/b/a AAA Bail Bonds of Salina, 717 West Walnut. (New application).
The City Clerk reported the applicant has paid the required fee and has the
required documents on file, and the application has been approved by the
Police Department. A motion was made by Commissioner Duckers, seconded by
Commissioner Usher to approve the license application and authorize the City
Clerk to issue the license. Ayes: (5). Nays: (0). Motion carried.
COMMISSION AGENDA
The following items were brought to the floor for discussion:
Mayor Simpson made a public reminder on Revenue Sharing, that the
City of Salina will be receiving $224,095.00 for the 7th and final entitlement
period of July 1, 1976 to December 31, 1976, the report is due in Washington
on June 23rd and the City Commission will hear requests for Revenue Sharing
funds from responsible groups and organizations up to June 14, 1976.
A MOTION was made by Commissioner Weisgerber, seconded by Commissioner
Duckers that appointments to Boards and Commissions be added to the agenda for
consideration. Ayes: (5). Nays: (0). Motion carried.
THE MAYOR, with the approval of the City Commission made the following
appointments:

Dan West, appointed for a 2 year term to June 7, 1978

Cecil Scroggins, reappointed to fill his unexpired term to November 25,
1977.
Area "B"
Carolyn Elder, appointed to fill the unexpired term of Raymond
Zaragoza to November 25, 1977.
Area "F"
Ralph Pihl, appointed to fill the unexpired term of Bill Keeler to
November 25, 1978.
Dr. John Swartz, appointed to fill the unexpired term of Mike Losik,
III to November 25, 1977.
Area "H"
Raymond Zaragoza, appointed to fill the unexpired term of David
Forrestal to November 25, 1978.
Area "J"
John Loftus, appointed to fill the unexpired term of Dorothy Shottenkirk
to November 25, 1977.

Kenneth Gillman, appointed to fill the unexpired term of Kenneth

Mayor Simpson asked any citizens interested in serving on the
Citizens' Advisory Committee to leave their name with the City Manager's
Office to be added to a list to serve when a vacancy occurs.
A motion was made by Commissioner Caldwell, seconded by Commissioner
Duckers that the Regular Meeting of the Board of Commissioners be adjourned.
