05-24-1976 MinutesIN City of Salina, Kansas Regular Meeting of the Board of Commissioners May 24, 1976 The Regular Meeting of the Board of Commissioners met in the Commissione s' Room, City -County Building, on Monday, May 24, 1976, at four o'clock p.m. The Mayor asked everyone to stand for the pledge of allegiance to the Flag and a moment of silent prayer. There were present: Mayor Gerald F. Simpson, Chairman presiding Commissioner Robert C. Caldwell Commissioner Keith G. Duckers Commissioner Jack Weisgerber comprising a quorum of the Board, also: printed. L. 0. Bengtson, City Attorney Norris D. Olson, City Manager M. E. Harrison, City Clerk The Minutes of the Regular Meeting of May 17, 1976, were approved as STAFF AGENDA AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE to be entitled 'Equal Opportunity and Affirmative Action', prohibiting discriminat on by reason of race, sex, religion, age, color, national origin, ancestry, physical handicap or marital status in all employment relations in all areas of public accommodations, in housing, and in public contracts; establishing a Human Relations Commission, a Human Relations Department and defining the powers and duties of each; providing for the adoption of administrative rules, regulations, and procedures to be utilized in the enforcement of this ordinance, and; establishing time limitations for the filing of complaints; enacting Chapter 11A of the Salina Code and repealing Chapter 16-1/2 of the Salina Code." A motion was made by Commissioner Duckers, seconded by Commissioner Weisgerber to adopt the ordinance as read and the following vote was had: Ayes: Caldwell, Duckers, Weisgerber, Simpson (4). Nays: (0). Commissioner Usher absent. Carried. The Mayor approved the ordinance and it is numbered 8488. The ordinance was introduced for first reading May 17, 1976. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing for the organizational structure and responsibilities for carrying out the city's commitment to the principle of nondiscrimination in city employment enacting Article X of Chapter 11A of the Salina Code." A motion was made by Commissioner Duckers, seconded by Commissioner Caldwell to adopt the ordinance as read and the following vote was had: Ayes: Caldwell, Duckers, Weisgerber, Simpson (4). Nays: (0). Commissioner Usher absent. Carried. The Mayor approved the ordinance and it is numbered 8489. The ordinance was introduced for first reading May 10, 1976. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing for the amendment of Zoning Ordinance Number 6613 and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof." (Rezoning of Lot 179 on Fifth Street, Original Townsite, from District "C" (Apartment House District) to District "E" (General Business District), which was requested in Petition Number 3547 filed by Webb Johnson Electric, Inc.) A motion was made by Commissioner Weisgerber, seconded by Commissioner Caldwell to adopt the ordinance as read and the following vote was had: Ayes: Caldwell, Duckers, Weisgerber, Simpson (4). Nays: (0). Commissioner Usher absent. Carried. The Mayor approved the ordinance and it is numbered 8490. (Rezoning of Lots 2 and 3, Block 1, Oakdale Addition from District "A" (Second Dwelling House District) to District "C" (Apartment House District), which was requested in Petition Number 3550 filed by William R. Umphrey.) A motion was made by Commissioner Caldwell, seconded by Commissioner Weisgerber, to adopt the ordinance as read and the following vote was had: Ayes: Caldwell, Duckers, Weisgerber, Simpson (4). Nays: (0). Commissioner Usher absent. Carried. The Mayor approved the ordinance and it is numbered 8491. The ordinance was introduced for first reading May 10, 1976. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing for the amendment of Section 21 of Ordinance Number 6613 and repealing the original section." A motion was made by Commissioner Weisgerber, seconded by Commissioner Duckers to adopt the ordinance as read and the following vote was had: Ayes: Caldwell, Duckers, Weisgerber, Simpson (4). Nays: (0). Commissioner Usher absent. Carried. The Mayor approved the ordinance and it is numbered 8492. The ordinance was introduced for first reading May 10, 1976. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing for the vacation of a portion of Gail Avenue within the City of Salina, Kansas." (Requested in Petition Number 3561 which was filed by Verner C. Smith.) A motion was made by Commissioner Duckers, seconded by Commissioner Caldwell to adopt the ordinance as read and the following vote was had: Ayes: Caldwell, Duckers, Weisgerber, Simpson (4). Nays: (0). Commissioner Usher absent. Carried. The Mayor approved the ordinance and it is numbered 8493. The ordinance was introduced for first reading May 17, 1976. A RESOLUTION was introduced and passed entitled: "A RESOLUTION authorizing and ordering certain curbing, guttering, paving, grading, water system, sanitary sewer system, and storm sewer improvements, ordering preparation of plans and specifications, and the estimate of costs." (Improvements on Scott Avenue in Bonnie Ridge Addition, requested in Petition Number 3538 which was filed by Monty Montee.) A motion was made by Commissioner Weisgerber, seconded by Commissioner Duckers to adopt the Resolution as read and the following vote was had: Ayes: Caldwell, Duckers, Weisgerber, Simpson (4). Nays: (0). Commissioner Usher absent. Carried. The Mayor approved the Resolution and it is numbered 3278. A MOTION was made by Commissioner Caldwell, seconded by Commissioner Duckers to set the date of June 7, 1976, as the date to receive bids for the Juvenile Detention and Booking Area in the Police Administration Building, and instruct the City Clerk to advertise for bids. Ayes: (4). Nays: (0). Motion carried. A LETTER was received from the City Planning Commission recommending the approval of the final plat of Holmquist Estates Addition. (Requested in Petition Number 3528 filed by A. J. Holmquist). A motion was made by Commissioner Weisgerber, seconded by Commissioner Caldwell to accept the recommendation of the City Planning Commission and approve the final plat of Holmquist Estates Addition, and authorize the Mayor to sign. Ayes: (4). Nays: (0). Motion carried. A LETTER was received from the City Planning Commission recommending the approval of the final plat of Victoria Heights Sub -division. (Requested in Petition Number 3494 filed by J. V. Enterprises, Inc.) A motion was made by Commissioner Caldwell, seconded by Commissioner Weisgerber to accept the recommendation of the City Planning Commission and approve the final plat of Victoria Heights Sub -Division and authorize the Mayor to sign. Ayes: (4). Nays: (0). Motion carried. 16 A LETTER was received from the City Planning Commission recommending the approval of the rezoning of a tract of land in the West 1/2 of the Northeast Quarter of Section 19, Township 14 South, Range 2 West (Victoria Heights Sub- division) from District "C" (Community Unit Plan) to District "A" (Second Dwelling House District) as requested in Petition Number 3551 which was filed by J. V. Enterprises, Inc. A motion was made by Commissioner Duckers, seconded by Commissioner Weisgerber to accept the recommendation of the City Planning Commission and approve the rezoning, and introduce the rezoning ordinance for first reading. Ayes: (4). Nays: (0). Motion carried. Ordinance Passed: Number: A LETTER was received from the City Planning Commission recommending the approval of the rezoning of Lots 6, 8, 10, Block 5; and Lots 5, 6, 7, 8, 9, Block 8, Woodland Addition from District "B" (Two -Family Dwelling House District) to District "D" (Local Business District); and Lots 1, 2, 3, 4, Block 8, Woodland Addition from District "E" (General Business District) to District "D" (Local Business District) as requested in Petition Number 3554 which was filed by Bob C. Diehl. A motion was made by Commissioner Caldwell, seconded by Commissioner Weisgerber to accept the recommendation of the City Planning Commission and approve the rezoning, and introduce the rezoning ordinance for first reading. Ayes: (4). Nays: (0). Motion carried. Ordinance Passed: Number: A LETTER was received from the City Planning Commission recommending the approval of the rezoning of Lots 1 through 9, inclusive, Block 2, Elm Grove Addition from District "A" (Second Dwelling House District) to District "D" (Local Business District) as requested in Petition Number 3555 which was filed by Gary Wooster. A motion was made by Commissioner Duckers, seconded by Commissioner Caldwell to accept the recommendation of the City Planning Commiss and approve the rezoning, and introduce the rezoning ordinance for first reading. Ayes: (4). Nays: (0). Motion carried. Ordinance Passed: Number: A MOTION was made by Commissioner Duckers, seconded by Commissioner Caldwell to set the date of June 7, 1976 to receive bids for: 1. One - ton pickup for Engineering Department 2. Five - 2 door sedans for Inspection Department 3. One - ton pickup for the Animal Shelter 4. Two - Dump trucks for the Street Department 5. One - 3/4 ton pickup for the Traffic Department 6. One - � ton pickup for Water and Sewerage Department and to instruct the City Clerk to advertise for bids. Ayes: (4). Nays: (0). Motion carried. PUBLIC AGENDA PETITION NUMBER 3566 was filed by Bradley Building Company of Kansas, Inc., 431 North 13th, for the rezoning of Lot 19, Block 6, Pacific Addition from District "E" (General Business District) to District "F" (Light Industrial District). A motion was made by Commissioner Caldwell, seconded by Commissioner Weisgerber to refer the petition to the City Plannning Commission. Ayes: (4). Nays: (0). Mr. Boyer replied it is still with the State, but they will be talking to them this week. Commissioner Duckers asked what can be done about the railroad crossings on 9th Street and particularly Santa Fe Avenue. He said the Rock Island crossings are deplorable and he wanted to find out what we can do to exert some type of pressure to get some immediate action to get them resurfaced. Mr. Bengtson suggested they contact the railroad companies and see what results they can get from them.
