The Regular Meeting of the Board of Commissioners met in the City
Commission Meeting Room, City -County Building, on Monday, February 5, 1979, at
four o'clock p.m.
The Mayor asked everyone to stand for the opening ceremony.

A RESOLUTION was introduced and passed entitled: "A RESOLUTION determini
the advisability of curbing, guttering, paving, grading, water main and services,
and sanitary sewer improvements, estimating the cost thereof, defining the
boundaries of the improvement district, method of assessment, and apportioning
the cost between the improvement district and the City -at -large." (Marydale,
Woodland, Schippel, Dow, Twin Oaks, and Grain Belt Additions - Engineering
Project 79-646). A motion was made by Commissioner Geis, seconded. by Commissioner
Usher to adopt the Resolution as read and the following vote was had: Ayes:
Geis, Graves, Usher, Weisgerber (4). Nays: (0). Commissioner Duckers absent.
Carried. The Mayor approved the Resolution and it is numbered. 3407.

A MOTION was made by Commissioner Usher, seconded by Commissioner
Graves to set the date of February 26, 1979 as the date to receive bids for 3
Sanitation Department Refuse Trucks, and to instruct the City Clerk to advertise

A RECOMMENDATION was received from the Director of Human Relations to
amend Section 11A-63 of the Salina Code, to require that affirmative action
programs of contractors be submitted with bids to the City of Salina in order to
insure equal treatment of all employees.
A motion was made by Commissioner Usher, seconded by Commissioner Geis
to accept the recommendation of the Human Relations Director and introduce an
ordinance for first reading to amend Section lIA-63 of the Salina Code.

A RECOMMENDATION was received from the Director of Human Relations to
amend Section 11A-72 of the Salina Code, regarding the filing and processing of
complaints.
A motion was made by Commissioner Graves, seconded by Commissioner
Usher to accept the recommendation of the Human Relations Director and introduce
an ordinance for first reading to amend Section 11A-72 of the Salina Code.

amend Section 11A-93 of the Salina Code, pertaining to the recruiting and
advertising by the City of Salina, Kansas, for employees in order to insure non-
discrimination in employment opportunities.
A motion was made by Commissioner Geis, seconded by Commissioner Usher
to accept the recommendation of the !uman Relations Director and introduce an
ordinance for first reading to amend Section 11A-93 of the Salina Code. !:%res:

motion was made by Commissioner Usher, seconded by Commissioner Graves to refer
the petition to the City Planning Commission for a recommendation. Ayes: (4).

A SURETY ON BAIL BOND License Application was filed by E. P. Piichols,
d/b/a Nichols Bail Bond, 911 Park, Salina, Kansas. The Acting City Clerk
reported the applicant has paid the required fee and has all his documents on
file. A motion was made by Commissioner Geis, seconded by Corimissioner Usher to
approve the license application and authorize the City Clerk to issue the
license. Ayes: (4). Plays: (9). Motion carried.
COMMISSIOP! AGENDA
THE COMIIISSIONERS CONSIDERED PROPOSALS received for (lousing Mortgage
Revenue Bonds.
J. Thomas Phoenix was present representing Boettcher and Company, and
gave a brief history of his company and asked the City Commission to accept his
proposal to organize the local lenders, develop the data of the local lenders
and determine the need of the housing market in Salina and then to retain his
firm to underwrite the Housing Mortgage Revenue Bonds.
Dennis Mitchell, Shearson, Hayden and Stone gave a brief history of
his company and explained the legislation pending concerning the Housing Mortgage
Revenue Bonds and asked the City Commission to accept his proposal to underwrite
the Housing Mortgage Revenue Bonds.

Mr. Don Henke, President of Homestead Savings and Loan Association,
said this is a matter the City Commission should study very carefully

acting too quickly, and that in addition to meeting with the lenders, the real
estate people should be involved. Ile said Homestead Savings and Loan Associatio
is primarily involved in mortgage lending with a high percentage of loans going
into single family residences, and that they are completely committed to making
loans to the people in our particular community on the best terms and best rates
possible; however it is their desire to make these particular loans through the
private market. "We see a considerable danger in going to this method to provid
funds for housing. If we were in a capital short community, and some communitie
are, if we could not grant the loans we have the demand for, then you have a
different ball game and you have a need for outside assistance. Here, over the
years, we probably have more dollars to lend than there has been demand for
loans. When some of the bond houses say there is a pressing need for housing
credit in this particular community, I have to stand here and say that is
absolutely untrue."
Commissioner Graves asked if this program is inflationary.
Dean Boone replied that market does creep up to compensate for the
discount points the seller has to pay under the program and the price comes up
slightly because there is an advantage on the monthly payment because of the
decreased interest rate.
Bob Begnoche, Security Savings and Loan, "I am a little bit apprehensi
about subsidizing middle income housing in Salina. The savings and loan
institutions are being monitored pretty closely by the Federal Government as to
where we lend our dollars and how we perform our lending practices. Ue are not
to discriminate as to income and location and the type of property we are going
to lend on if it is residential or what it costs but we are talking about a
program that is telling us exactly to do that. This is another question we need
to look at."
Sue Baxter asked if these properties would be taken off the tax roll
as other industrial revenue properties are.
The Commissioners replied that these properties will not be exempt
from taxes.
Robert Frobenius said we need something like this.
Dean Boone said, "As a citizen and a realtor, I have personal
reservations as to the feasibility, the economic effect, etc. Realtors of
Salina could possibly do a better job in assisting with accomplishing the
premise of this bill if we could find some way of eliminating the initial cost
of getting into a home and eliminating the 2 car payments that take out as much
as $250.00 of a persons income that applies to a person's qualifying process.
don't find very many people who could not qualify for a home. I find many who
can't afford the down payment and the closing costs. I find many people who
can't qualify simply because they are carrying too many bills. References to
this bond issue are directed to moderate income families. There is need in the
low income area, nothing in the moderate income area. If we apply the US
Department of Commerce average sale price, as this bill directs us to, then we
are talking about homes that will run in the low 50's. If we are going on the
premise that we are helping moderate or low income families, there are people
here who should give this serious consideration."
Commissioner Geis said he understands the City Commission can set the
limits and the criteria for such loans, and can decide, based on the community's
available housing and needs, what those limits should be and limit the loans to
a given income.
An unidentified man said this is correct, and in order to have a AA
rating you have to have so many loans and you have to have so many dollars.
This means in order to achieve that kind of volume you are going to have to open
this thing to $40,000 to $50,000 loans in order to get that many loans in the
package to qualify for a AA rating.

Steve Shogren, United Securities, was present again this week and said,
"The Saline County Commission has hired our two firms to do a study of the
housing needs in Saline County, and that the input of local people is imperative
to get a bond issue that will best benefit Salina. If it does not prove feasible,
we don't want to do it. We want to have an independent CPA firm gather the
information for you, sit down with a steering group made up of all segments of
your community and determine whether or not this is feasible to continue. At
that point in time, perhaps we have a bond issue, perhaps not, and that would
be part your decision. By the nature of the bond issues, it is imperative for
the City of Salina to retain a fiscal advisor, a financial advisor, to help draw
all the materials and all the proper people together so that if the legislation
passes you can be ready to act in a very logical manner. If legislation passes
I believe we are going to see a lot of bonds here in the State of Kansas, whether
or not that affects our bond market or not I can't determine, but it could,
and for Salina to have their information, their wheels turning, and be ready to
act on this could be a factor in your favor. He ask you to hire us to promote a
project in conjunction with the County to do a feasibility study and gather that
data so you can make a logical choice when the time comes."
Commissioner Usher said the Commission needs to decide whether it
wants to pursue the mortgage revenue bond issue, and if so, to pick a firm to do
the study.
Commissioner Graves asked each firm how many bond issues it has completed.

Commissioner Graves moved to accept the proposal of First Securities
and Stern Brothers to do a feasibility study at no cost to the City because they
have closed 2 bond issues.
The motion died for the lack of a second.
A motion was made by Commissioner Usher, seconded by Commissioner Geis
to employ United Securities and Kirchner Moore to do the study for us at no cost
with the stipulation that in the event it develops into a bond sale that those
who have participated and provided us with all this information share in the
sale if they choose to. Ayes: (4). (Jays: (0). Motion carried.
"PROGRESS REPORT on East Crawford Improvements". (Sponsored by
Commissioner Graves)
The City Engineer reported, "The plans for the section of this project
from Marymount Road east to the City limits are 90°10 complete. The section from
Marymount Road west to Ohio Street is only about 20% complete. Two things have
happened to cause a short delay in proceeding with the plans for this section of
the project. The weather has prevented us from obtaining additional field
information for almost two months. In addition and during this same time
period, we have had a question relating to the actual location of the section
line and right-of-way lines through this mile of roadway. He have been working
with the County Engineer to resolve the right-of-way question and feel it has
been worked out to everyone's satisfaction. As soon as the snow melts, and the
County and City attorneys are in agreement that the right-of-ways are legally
established where they now exist in the field, we will proceed with that section
of Crawford Street from Marymount Road to Ohio Street.
"In addition to our roadway plans, we will need to award a contract
for design of the bridge across the Smoky Hill River. !,le should not proceed
with this contract until the right-of-way question is resolved, as it is
imperative that the designer know the exact location of the bridge before he
begins his design.

"We expect that these problems will be worked out in the next two or
three weeks. This being the case, we are still shooting for a Spring 1979
letting for this project."
Mr. Craig Roberts, Wilson and Company, said he wrote the City Commission
7 months ago asking to be considered for this project and understands that the
Engineering Department is doing the design "in house". He asked why the Engineering
Department was encouraged to build up an engineering staff, in house, of the
size and type to do the projects they have done over the last two years as
opposed to keeping an administrative staff, which is a very legitimate function
of the City Engineer to administer those projects and let the design, as well
as the construction work out to private enterprise?
Mr. Boyer explained the department has done a lot more work in the
past year in dollar volume, but have not had any big build up in staff. The
department has been increased by 1 employee in the last 10 years, and through
better organization, timing and work flow the department did 2z times the work
last year as it did in 1977. He said he does not subscribe to the principle of
building up a big engineering department for a large project, and as we have
done more work we have awarded more work to consultants this past year. 14e are
not fighting free enterprise we are not having a big build up, but we feel the
forces we do have on board should be taxed to the maximum before we let it out
to private enterprise.
Mr. Harris said the bridge design is recommended to be let out for
contract.
Mayor Weisgerber commented that the Commission must guard the expenditure
of tax funds.
Mr. Roberts said there is no way the city can do these design
engineering services cheaper than they can be provided by private engineering
firms.
Mr. Harris said the budget records and engineering documents are
available for his study.
A MOTION was made by Commissioner Usher, seconded by Commissioner Geis
to recess into executive session to discuss a personnel matter for 10 minutes.

The Commissioners recessed at 6:07 P.M. and reconvened at 6:39 P.M.
A motion was made by Commissioner Graves, seconded by Commissioner
Usher that the Regular Meeting of the Board of Commissioners be adjourned.

WAIVER AND CONSENT TO HOLD A SPECIAL MEETING
OF THE BOARD OF COMMISSIONERS
We, the undersigned, being the duly elected, qualified and acting
Commissioners of the City of Salina, Kansas, and constituting a majority of the
Board of Commissioners of the City of Salina, Kansas, do hereby waive notice and
consent to the holding of a special meeting of the Board of Commissioners on the
21st day of February, 1979, at 9:00 A.M. for the purpose of considering the
Wilson and Company, Engineers and Architects, Salina Calcining Plant Study.
