There were present: Mayor Jack Weisgerber, Chairman presiding Commissioner Keith G. Duckers Commissioner Dan S. Geis Commissioner Karen M. Graves Commissioner Gerald F. Simpson comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney W. E. Harris, Deputy City Manager D. L. Harrison, City Clerk Absent: Norris D. Olson, City Manager Commissioner Graves identified herself as the unidentified woman, referred to on Page 212 of the minutes of the special meeting September 28, 1978 at Salina High School South. Mr. Ed Skinner, Hutchinson, asked if the flood control property, the pumps and etc., would become city property in the annexation of Schilling Manor? Mr. Harris said he is of the opinion the purchaser would dedicate this to the city to maintain, but he will check with GSA tomorrow and call him with an answer. l Mr. Robert Frobenius asked what the stipulations are on the project? Mr. Harris asked if he is referring to the five points adopted by the City Commission on September 25, 1978. Mayor 14eisgerber said a more recent estimate for platting is 5125,000. Mr. Frobenius said the utilities are plotted, and that should be sufficient for the city. An unidentified man asked if there is a current estimate on the paving? Mayor Weisgerber replied it is $`?64,000. No protests, written or oral, were received. The Mayor declared the public hearing closed. The City Commissioners did not take any action to annex the property.. Ordinance Passed: Number: AN ORDINANCE was introduced for second reading entitled: ''AN ORDINANCE providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof.'' [Z78-20, filed by the Salina City Planning Commission for the rezoning of Blocks 1 through 5, inclusive, and Block 7, Country Club Estates Addition #3, from District A-1 to District R (Single Family Residential District).] A motion was made by Commissioner Duckers, seconded by Commissioner Graves, to adopt the ordinance as read and the following vote was had: Ayes: Simpson, Duckers, Geis, Graves, Weisgerber (5). AN ORDINANCE was introduced for second reading entitled: ''AN ORDINANCE creating and establishing the Neighborhood Centers Board; providing for the appointment of its members and defining the duties and powers of said board.'' A motion was made by Commissioner Graves, seconded by Commissioner Duckers to adopt the ordinance as read and the following vote was had: Ayes: Simpson, Duckers, Geis, Graves, Weisgerber (5)• Nays: (0). Carried. The Mayor approved the ordinance and it is numbered 8668. The ordinance was introduced for first reading October 2, 1978. THE CITY ENGINEER reported on Petition Number 3724, filed by Larry Weber for Pepsi Cola, requesting recessed parking on the south side of Decatur and on the north side of Lincoln from Ninth Street, 425 feet east, that ''Section 32-130 of the Salina Code says in part: No permit shall be issued for a recessed parking area which shall abut any street, the improved portion of which is less than forty (40) feet in width, measured between curb facings without the approval of at least a four-fifths (4/5) vote of the Board of Commissioners. Both Decatur and Lincoln have thirty-six (36) foot pavement. This generally means that if recessed parking is allowed, you must use the sidewalk area for parking, thereby forcing the pedestrian traffic out into the street. Inasmuch as Pepsi Cola has ample off-street parking facilities east of the building and there still being considerable pedestrian traffic in this area, I would recommend that Petition Number 3724 be denied.'' A motion was made by Commissioner Geis, seconded by Commissioner Duckers to accept the City Engineer's recommendation and deny the petition. Ayes: (5). Nays: (0). Motion carried. A LETTER was received from the City Planning Commission recommending the approval of Zoning Application 78-21, filed by Clyde and Bonita Reed for the rezoning of Lot 16 and the North 180 feet of Lot 17, Block 1, Cloverdale Addition from R to 1-2 (Light Industrial District). A motion was made by Commissioner Simpson, seconded by Commissioner Graves to accept the recommendation of the City Planning Commission and approve Zoning Application 78-21 and to introduce the rezoning ordinance for first reading. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: A LETTER was received from the City Planning Commission recommending the approval of Zoning Application 78-22, filed by the Salina Journal for the rezoning of the East 60 feet of Lots 169 and 171 and all of Lot 173, on Fourth Street, Original Townsite, from R-3 to C-3 (Shopping Center District). A motion was made by Commissioner Duckers, seconded by Commissioner Simpson to accept the recommendation of the City Planning Commission and approve Zoning Application 78-22 and to introduce the rezoning ordinance for first reading. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: 1 1 A LETTER was received from the City Planning Commission recommending the approval of UR77-4A, filed by Jack Just (Western Steel and Automation) for the amendment to a development plan on Lot 2, Block 13, Northeast Industrial Park, subject to the usable parking being shown on the plan. A motion was made by Commissioner Graves to accept the recommendation of the City Planning Commission and approve UR77-4A. Mr. Harris explained this is a joint ownership between Jack Just and Webb Johnson, and it is his opinion, so each would have sufficient room for parking and maneuvering, that they should file a common easement for this tract granting each other an easement on their half of the street. He recommended the City Commission approve this request subject to the City Attorney approval once the document has been recorded with the Register of Deeds. Commissioner Graves amended her original motion to include that approval; is subject to a common easement and useable parking plan being demonstrated. Commissioner Duckers seconded the motion. Ayes: (5). Nays: (0). Motion carried.! A MOTION was made by Commissioner Geis, seconded by Commissioner Graves to introduce an ordinance for first reading entitled: ''AN ORDINANCE authorizing the City of Salina, Kansas to acquire the United Building Condominium units, the real estate, improvements and common areas applicable thereto, and to reconstruct repair, enlarge, remodel and improve the same for use as commercial facilities to be leased to certain occupants of such condominium units; authorizing and directing the issuance of $9901000.00 principal amount of Salina, Kansas, United Building of Salina Industrial Revenue Bonds of 1978, of said City for the purpose of providing funds for the acquisition of said condominum units, the real estate, improvements and common areas applicable thereto, and the reconstruction, repair, enlargement, remodeling and improvement of the building, which consists of such condominium units, and to purchase and install machinery and equipment to be used for commercial facilities to be leased to certain occupants of the condominuum units; and prescribing the form and authorizing the execution of leases by and between said city and certain occupants of said condominium units.'' Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: PUBLIC AGENDA Number: PETITION NUMBER 3729 was filed by Coronado School PTA Safety Committee for a sidewalk extending from the Corondao School parking lot south to Gail Drive. This sidewalk would be on the east side and parallel to Ray Avenue. A motion was made by Commissioner Simpson, seconded by Commissioner Geis to refer the petition to the City Engineer for a report. Ayes: (5). Nays: (0). Motion carried. A REQUEST was received from KASA Industrial Controls, Inc., to discuss the issuance of $280,000 of Industrial Revenue Bonds. Dean Owens, Attorney representing the company was present and explained that KASA desires to acquire a site in the South Industrial Area, utilize an existing building as an office and construct a manufacturing facility on the site and is asking the City of Salina to issue Industrial Revenue Bonds for this purpose. A RESOLUTION was introduced and passed entitled: ''WHEREAS, the City of Salina, Kansas, (the ''City'') is authorized and empowered under the provisions of the Kansas Industrial Revenue Bond Act, K.S.A. 12-1740 to 12-1749, inclusive, as amended, to issue revenue bonds for industrial development purposes; and,'' A motion was made by Commissioner Duckers, seconded by Commissioner Simpson to adopt the Resolution as read and the following vote was had: Ayes: Simpson, Duckers, Geis, Graves, Weisgerber (5). Nays: (0). Carried. The Mayor approved the Resolution and it is numbered 3392• Mr. Bengtson explained that the resolution of intent stipulates there I will be a payment in lieu of taxes equal to the taxes that would be assessed against there are the property as of now, presently improvements based on on the the assessed property and valuation in as much as this would conform with the previous policy of not reducing the tax base by issuing Industrial Revenue Bonds. A RESOLUTION was introduced and passed entitled: ''WHEREAS, the City of Salina, Kansas, (the ''City'') is authorized and empowered under the provisions of the Kansas Industrial Revenue Bond Act, K.S.A. 12-1740 to 12-1749, inclusive, as amended, to issue revenue bonds for industrial development purposes; and,'' A motion was made by Commissioner Duckers, seconded by Commissioner Simpson to adopt the Resolution as read and the following vote was had: Ayes: Simpson, Duckers, Geis, Graves, Weisgerber (5). Nays: (0). Carried. The Mayor approved the Resolution and it is numbered 3392• A REQUEST was received from Morgan Supply, Inc. to discuss the issuance of $300,000 of Industrial Revenue Bonds. Bruce Kepling, representing Morgan Supply, Inc., was present and explained that Morgan Supply desires to acquire land and construct a warehouse facility in the Northeast Industrial Park and is asking the City of Salina to issue Industrial Revenue Bonds for this purpose; and that in exchange for the 10 year exemption for real estate taxes, Morgan Supply would pay the City of Salina $7,500 at the end of the 20 year lease, which is 2-1/2% of the issuance face value. Mr. Bengtson explained that this is consistent with the policy adopted with regards to Lee Hardware which is a similar industry. A RESOLUTION was introduced and passed entitled: "WHEREAS, the City of Salina, Kansas, (the "City") is authorized and empowered under the provisions of the Kansas Industrial Revenue Bond Act, K.S.A. 12-1740 to 12-1749, inclusive, as amended, to issue revenue bonds for industrial development purposes; and," A motion was made by Commissioner Simpson, seconded by Commissioner Duckers to adopt the Resolution as read and the following vote was had: Ayes: Simpson, Duckers, Geis, Graves, Weisgerber (5). flays: (0). Carried. The Mayor approved the Resolution and it is numbered 3393• A REQUEST was received from Salina Nursing Center, Inc., to discuss the issuance of $1,400,000 of Industrial Revenue Bonds. No one was present at this time to make the presentation. Mr. George Etherington asked if the taxes will be forgiven on this issue? Mr. Bengtson explained that there will be no tax forgiveness, they will be required to make a payment in lieu of taxes equal to the taxes normally assessed against it. A motion was made by Commissioner Graves, seconded by Commissioner Geis, to table the request. Ayes: (5). Nays: (0). Motion carried. COMMISSION AGENDA THE CITY COMMISSIONERS considered 3 resolutions directing the City Engineer, or his designee, to prepare a feasibility report relative to the advisability of implementing phases I, II, and IV, of the South Salina Drainage Study engineering report as prepared by Wilson and Company, Engineers and Architec Commissioner Simpson requested that the staff more clearly define the scope of the project as it relates to the boundaries of the possible benefit districts and the cost that would accrue to the various benefit districts. Mr. Harris asked that the City Commission negotiate the feasibility study with Wilson and Company, because the engineering department does not have the time or staff to take this project on, and Wilson and Company, having done the initial study, is in a position to proceed with the feasibility report. Wilson and Company asked exactly what information the City Commission is requesting? The City Commissioners discussed the project and tried to decide what information they want in the feasibility report. Mr. Bengtson explained the state law relating to improvements to the City Commissioners again, and that the City Engineer should sit down with Wilson and Company and find out the cost of having them do it, and that Wilson and Company has all the information in their files right now, and it is just a matter of putting it together. =s. 235 Mayor Weisgerber said he is not in favor of spending a lot more money on studies because there are enough estimates close enough in the study that without refining those to a greater degree could be made out close enough so someone could carry a petition in favor of, if they wanted to try to get this done. ''If it has a chance to go at all, which I doubt, it has its best chance if people out there will petition for it. The cost of doing this came up a lot higher than I had hoped. I had hoped there would be a solution that would be considerably simpler than this, maybe not quite as perfect, that would be more within reason, costwise, but I still wonder if this goes along and it isn't possible to do as you have outlined it, maybe just a cutoff channel or cutoff channel and clearing Dry Creek which might be done at a relatively nominal cost might not be the perfect solution but if it might not alleviate a considerable part of the problem. If it does go in the only chance is for the people that are for it to work like the very dickens for it and carry the petition and try to get it done, but I don't think even then they can make it.'' Commissioner Graves - I don't think we should be prejudging what the people are going to do and what their reaction is going to be on this. One of the most important things as far as I am concerned that came out of this whole report, so that people won't think we wasted a lot of city tax dollars was something that just said it was too expensive are the three points mentioned early in the report and I would like to see us move on that very quickly and that is to adopt the standard design criteria for future development, some kind of a master drainage plan so we at least don't make existing problems worse, because if we can say from now on developers are going to have to file a professionally designed engineering plan to show that it ties into a master drainage plan and I would like to see us act very quickly on an ordinance that would require a developer to file that to make sure we don't end up with a crazy patch work of 18 inch pipes meeting 24 inch pipes meeting 36 inch pipes and wondering why the capacity of the system is only as great as the 18 inch pipes, we have got to do that if we do nothing else with the study. When can we get an ordinance drafted that would require developers to file with their plats a workable drainage so we don't aggravate the problems that have existing problems and so we avoid problems like this in the future. I think that is one of the most important things to come out of the study myself. Commissioner Simpson asked about the status of the City Planning Commission studying this as a part of the subdivision regulations. Mr. Rawlings said they are studying it as a part of the regulations but the status of the subdivision regulations is that they are coming along slowly. They are working through, hopefully, the final draft, and it will probably be another 60 days before they have the draft finished, at that point they will schedule public hearings. Commissioner Graves moved that staff draw up an ordinance setting forth the criteria for a master drainage plan. Commissioner Geis seconded the motion. Mrs. Eugene Hall, a resident of South Fourth Street - I feel that we have taken petitions, we have fought for years and I have thought at our meeting at South High that you would go ahead with it and then let the people that object to it take the petitions. I think we have gone through enough, let the other side take the petitions if they don't agree with it. I think it is much easier to go ahead with something ... I thought that was the way we had planned it out there at the meeting. We have floods everytime we have an inch shower, it is in our yard and it isn't much more until it is in our basements. ... On out south does come on us. Unidentified woman - I think there is a strong need for everyone to understand what benefits will be derived and what it is going to cost us personally in language that we can understand before anyone for or against does anything. Unidentified man - many people that would be in opposition to this are part of the problem. You issued industrial revenue bonds today for additional development in the South Industrial Area, they become part of the problem. They may not be beneficiary of the system but they are certainly part of the problem. 236 Norman St. John, 2406 Drake Place - ... one of the comments that I have heard fairly generally against it was couldn't Wilson and Company have come up with something reasonably effective at about 1/2 the cost? After reading the Wilson and Company study myself that was the first question that came to my mind. John Reh, 2267 Leland Way - the report is a very reasonable solution to solving the interior drainage problems in that area and second I agree with what Karen said about the need to control the drainage in future developments, that should be top priority, and third I would like to ask where the decision point is where you are going to decide where you are going to place the burden of petition on? Is that here today or after you have finished the feasibility study? Commissioner Geis - It was my opinion we were going to decide that today. Mr. Reh - That is what I was afraid of and that is why I am here. I agreed with just about everything that Jack said a while ago. I don't think you have the support, and I believe that was the intent of that option that you have and you say you have strong support for something you save the cost of an election, but in this case I don't believe you have the support and I think you should place the burden of the petition on the those that have the problem. Commissioner Simpson - I would like to have a better understanding of the cost involved on the benefit districts involved before we would vote either way on that. Rich Haggert, 314 East Laura, urged the City Commission not to spend any more money on more studies until the Commission feels that you do have 50% of the people. cost? Elton Craig, 635 Neal, asked how much the Wilson and Company studies Mr. Harris replied that the total cost was $104,022. Elton Craig - The residents on Neal have losses in excess of that because of flood. I have only been in this town 4-1/2 years. A comment was made by one of the Commissioners at South when several of us complained about the builders that you made reference to, wanting to hear from them, continually building higher than existing houses and a comment was made by one of the Commissioners that they felt it was out of order to allow this to continue, and yet within the last 30 days we had another house went up not immediately behind us but to the side of the one immediately behind us which will be casting more water down on us. Simple rain water. The flood last year was nothing more than simple rain. I wonder what would happen if we had conditions of the flood associated myself with in '51 in Kansas City. We had months of heavy rainfall, the ground was saturated you have streams and rivers up from - that were swollen. Then you have other problems of simple surface water from the rain, to try to contend with. ... We were not informed by the realtor of the flood immediately before moving here in January 1974. 1 believe it was September or October, 1973. It seems to me you are taking the effect that whoever lives there now or whoever may or may not move in there in the future, beware on their own terms. ... you are hurting your area and you are hurting your values. I find that a little difficult to swallow, that kind of an attitude. I know there have been over 100 houses over east of the railroad track beside Coronado built since our problem. To continue to allow this on is simply saying people are there, we know you have got problems, sorry, and allow the builders to go ahead and add to this problem and that distresses me a little bit too and I am willing to pay some to be in this group. I am willing to shoulder this cost, I hope the day doesn't come when you gentlemen have a problem where you live because people like myself and others may not ... to take that attitude. 1 Unidentified woman asked if the city commission has checked with the (building codes in Wichita? She said her uncle was up visiting about a year ago and saw the building going on outside her back door that they were building houses 4 feet above them and could not believe that the city would allow this. He said in Wichita there is no way he could go in and build a house 4 feet above an already existing house, that before he gets a building permit he has to show where the water is going to drain ... to us that are already there, what help are you going to give us? I agree you need to do something for building in the future, it needed to be done years ago and then we wouldn't be in this problem, but for us that are there and the house right behind us is 4 feet higher than we what help are you going to give. All the houses along Neal were built way too low, we all know that, but we were there first, and the city has allowed everyone to come in around us and build up and drain onto Neal and if we happen to have an older home then we are just sitting there in water. Commissioner Graves - It seems to me like if a lot of water comes in from Mentor from the south that if we did have a new tough drainage master plan that a lot of that water could be diverted by our new outlets and so forth before it got to you. I would ... that this ordinance and this drainage plan would alleviate the situation for a lot of you because you got a lot of water from the south, from area that we have no control over. Commissioner Duckers - I am in favor of adopting an ordinance that says the only place you can dump water is to the street, build the streets deep and let the streets flood, people can get their cars up in their driveways, but let the streets be built to carry the water. The town is not going to get any hillier than it is right now ... is there some way that could be designed that says from here on, period, if you are going to dump water it has got to go to the street. The Commissioners and staff discussed the adoption of an ordinance to regulate drainage. Mr. St. John said we need an overall drainage plan before there is any more building done anywhere, and suggested the Commissioners drive along Linda Lane between Neal and Scott and see that the houses there have been built within the last year or year and a half and the street is much higher than the back yards. Something slipped there. Mrs. Eugene Hall said Cloud Street drains down on Fourth Street also She also suggested that the city maintain Dry Creek. The Commissioners called for a vote on Commissioners Graves motion. The Commissioners discussed the intent of the motion. Mr. Bengtson said the Wilson and Company study encompases about 5% of the city of Salina and a master drainage plan would be for the entire city of Salina and the cost of preparing a master drainage plan for the entire city of Salina would be almost unbelievable. "I think we are saying we don't want to complicate the problem the existing problem if we can do this through controlling new developments, and I would suggest that planning, engineering, staff should all start working toward what would be the best way to implement the recommendations in this study, and that it be done as quickly as possible." Commissioner Duckers said that is absolutely correct. e Commissioner Geis said the master drainage plan is going to have to be broader than just to cover the obvious, such as someone's house being 4 feet higher than someone else's, and we are going to have to look outside Salina's city limits. Commissioner Graves withdrew her original motion and moved that the city staff review the section of the Wilson and Company study that deals with future development and come up with specific recommendations to the City Commission assuring the fact that the problems we have now will not happen in the future. Commissioner Duckers seconded the motion. Ayes: (5). Nays: (0). Motion carried. K The City Commissioners considered the original item on the agenda. Commissioner Simpson suggested that any further action be delayed until the additional information is received from Wilson and Company. The Commissioners discussed again what information they want from Wilson and Company. Mr. Bowersox says he understands that the City Commission wants, from the existing information, to define the boundary of the benefit areas, to determine the cost for a benefit area covered by the existing city limits, to determine the cost for a benefit area with a 3 year annexation plan in mind, to determine the cost to the tax payers for the city -at -large paying for part of the system and the remainder to be paid for by the benefit area in the present city limits. Mr. George Etherington said the city -at -large portion of phases I and II is approximately 4-1/2 million dollars, and that he just spent $170,000 for his own drainage system in Georgetown Addition, and that he is not particularly interested in paying again for the city -at -large portion. He said they are assuming the responsibility of their own and are not asking the city -at -large to pay part of his. Commissioner Geis said his position is that if the people want the improvements, it should be petitioned in. The Commissioners discussed the action they should take, and it was decided that the City Engineer get together with Wilson and Company and discuss the boundaries of the benefit districts, and the costs to benefit areas and the city -at -large. The following items were brought to the floor for discussion: Commissioner Geis said one of the comments made at the meeting with the people in South Salina was the difficulty with vehiclular traffic on the streets that were flooded adding to the damage or frustration on the part of many of the home owners. He said he visited with Don Rectenward of the Civil Preparedness, and Norris Olson and a group of people here in town for the purpose of establishing a network or system of blocking the streets that are flooded, and providing for the quick dispatch of roadblocks and personnel to these areas. He said they are working on that program. A MOTION was made by Commissioner Simpson, seconded by Commissioner Duckers to remove the request from the Salina Nursing Center, Inc. from the table for consideration at this time. Ayes: (5)• Nays: (0). Motion carried. Mr. Joe Carmichael was present and said the Salina Nursing Center, Inc., desires to use the proceeds of the $1,400,000 Industrial Revenue Bonds to acquire property and build a nursing home facility, and is asking the City of Salina to issue Industrial Revenue Bonds for this purpose. Mr. Bengtson said the resolution will stipulate that there will be a payment in lieu of taxes equal to the taxes that would be assessed against the property, if it were not exempt. A RESOLUTION was introduced and passed entitled: "WHEREAS, the City of Salina, Kansas, hereinafter sometimes referred to as the "City", desires to promote, stimulate and develop the general economic welfare and prosperity of the City and its environs, and thereby to further promote, stimulate and develop the general economic welfare and prosperity of the State of Kansas; and" A motion was made by Commissioner Simpson, seconded by Commissioner Duckers to adopt the Resolution as read, and with the addition of the payment in lieu of taxes clause as stiuplated by the City Attorney, and the following vote was had: Ayes: Simpson, Duckers, Graves, Weisgerber (4). Nays: Geis (1). Carried. The Mayor approved the Resolution and it is numbered 3394. 11 1 7 A MOTION was made by Commissioner Graves, seconded by Commissioner Duckers to place an item on the agenda concerning a filing fee to be paid by applicants for Industrial Revenue Bonds. Ayes: (5). Nays: (0). Motion carried. Commissioner Graves moved that a $500.00, non -returnable, filing fee accompany a request for Industrial Revenue Bonds, as there is a lot of city time involved in an Industrial Revenue Bond issue. The motion was seconded by Commissioner Duckers. Mr. Bengtson said he wants to prepare a standard application for Industrial Revenue Bond applicants that would require them to submit certain information at the time the application is made, and the fee could be a minimum fee or a fee and a percentage of the issue. Commissioner Graves withdrew her original motion, and Commissioner Duckers withdrew his second. A motion was made by Commissioner Graves, seconded by Commissioner Simpson that the staff and City Attorney draw up a proposal whereby applicants for Industrial Revenue Bonds would have to submit a request in written form and the City Attorney could make a recommendation as to the fee structure. Ayes: (5). Nays: (0). Motion carried. A MOTION was made by Commissioner Duckers, seconded by Commissioner Simpson that the Regular Meeting of the Board of Commissioners be adjourned. Ayes: (5).
