10-02-1978 Minutes1 1 1 City of Salina, Kansas Regular Meeting of the Board Of Commissioners October 2, 1978 The Regular Meeting of the Board of Commissioners met in the City Commission Meeting Room, City -County Building, on Monday, October 2, 1978, at four o'clock P.M. The Mayor asked everyone to stand for the opening ceremony. There were present:. Mayor Jack Weisgerber, Chairman presiding Commissioner Keith G. Duckers Commissioner Dan S. Geis Commissioner Karen M. Graves Commissioner Gerald F. Simpson comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None printed. The Minutes of the Regular Meeting September 25, 1978 were approved as THE MAYOR PROCLAIMED the Week of October 8 through 14, 1978 - "FIRE PREVENTION WEEK". The proclamation was read by Fire Inspector Jerome Schmidt of the Salina Fire Department. THE MAYOR PROCLAIMED the Week of October 9 through 13, 1978 - "DAY IN COURT OBSERVANCE WEEK FOR LEGAL SECRETARIES". THE MAYOR PROCLAIMED Saturday, October 7, 1978 - "ONE -ARMY DAY". The proclamation was read by Lt. Col. Lowe. STAFF AGENDA AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE levying special assessments on lots, pieces and parcels of ground in the City of Salina, Kansas, for the purpose of paying a portion of the cost of: Water Main and Services Main Sanitary Sewer "AW" and Pump Station Lateral Sanitary Sewer 581" (Engineering Project 77-619 - Hocking Addition) A motion was made by Commissioner Geis, seconded by Commissioner Simpson to adopt the ordinance as read and the following vote was had: Ayes: Graves, Simpson, Duckers, Geis, Weisgerber (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered 8665. The ordinance was introduced for first reading September 25, 1978. AN ORDINANCE was introduced for first reading entitled: "AN ORDINACE providing for the vacation of White Avenue within the City of Salina, Saline County, Kansas." (Requested in Petition Number Number 3726, filed by Clint Baird) A motion was made by Commissioner Graves, seconded by Commissioner Duckers to adopt the ordinance as read and the following vote was had: Ayes: Graves, Simpson, buckers, Geis, Weisgerber (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered 8666. The ordinance was introduced for first reading September 25, 1978. a 4(1 THE CITY ENGINEER filed plans and specifications for Engineering Project 78-643 for water main improvements in Eastridge Addition. A motion was made by Commissioner Simpson, seconded by Commissioner Geis to approve the plans and specifications as filed by the City Engineer. Ayes: (5). "Jays: (0). Motion carried. A MOTION was made by Commissioner Simpson, seconded by Commissioner Geis to set the date of October 16, 1978 as the date to receive bids for Engineer Project 78-643 for water main improvements in Eastridge Addition, and to instruct the City Clerk to advertise for bids. Ayes: (5). Nays: (0). Motion carried. A RESOLUTION was introduced and passed entitled: ''A RESOLUTION designating the official depositories for all moneys of the City of Salina, Kansas, and directing the City Treasurer to deposit all moneys received by him therein. A motion was made by Commissioner Duckers, seconded by Commissioner Geis to adopt the resolution as read and the following vote was had: Ayes: Graves, Duckers, Geis, Weisgerber (4). Nays: (0). Commissioner Simpson abstain Carried. The Mayor approved the Resolution and it is numbered 3391• THE CITY ENGINEER reported on Petition Number 3727, filed by D. L. Sampson for curbing, guttering, and paving on Gold Road from the frontage road on the east side of US 81 Highway and extending east 650 feet, that the petitioner owns 100% of the property in the benefit district and is therefore a valid petition. A motion was made by Commissioner Geis, seconded by Commissioner Duckers to accept the City Engineer's report and approve the petition. Ayes: (5). Nays: (0). Motion carried. THE CITY ENGINEER reported on Petition Number 3728, filed by Gary J. McClellan for curbing, guttering and paving on Front Street between Pacific Avenue and Forest Avenue, that the petitioners own 750 of the property in the benefit district and is therefore a valid petition. A motion was made by Commissi ner Duckers, seconded by Commissioner Graves to accept the City Engineer's report and approve the petition. Ayes: (5)• Nays: (0). Motion carried. 11 THE CITY CLERK reported the assessment rolls are ready for the followi improvements, to -wit: (Engineering Project 77-627 - Dow Addition) Curbing, guttering, paving and grading of BELOIT AVENUE from Ohio Street to Courtney Drive. Curbing, guttering, paving and grading of LOUISE LANE from the north line of Lot 2, Block 8, to the east line of Lot 15, Block 8, Replat of Lot 22, Block 3, and Lot 9, Block 6, Dow Addition Water main and service lines Lateral Sanitary Sewer 587 Lateral Sanitary Sewer 588 as authorized by Resolution Number 3345, passed by the Board of Commissioner! on the 31st day of October, 1977. The assessments have been determined and the final costs have been filed by the City Engineer. A motion was made by Commissioner Geis, seconded by Commissioner Simpson to instruct the City Clerk to publish notice in the official city newspap( at least once not less than ten days prior to the date of October 16, 1978, the date set for the hearing on said assessments, and that at the same time notice is published to mail to the owners of property made liable to pay the assessment, at their last known post office address, a notice of the hearing and a statement of the cost proposed to be assessed against the land so owned and assessed. Ayes: (5). Nays: (0). Motion carried. I�I 1 990 PUBLIC AGENDA A CEREAL MALT BEVERAGE license application was filed by Matthew K. Wagoner, d/b/a Village Gate, 1329 East Iron Avenue. (New application). The City Clerk reported the applicant has paid the required fee, and the application has been approved by the Health Department, Zoning Officer and the Police Department. A motion was made by Commissioner Duckers, seconded by Commissioner Geis to approve the license application and authorize the City Clerk to issue the license. Ayes: (5). Nays: (0). Motion carried. COMMISSION AGENDA The Commissioners brought the following items to the floor for discussion: A MOTION was made by Commissioner Graves, seconded by Commissioner Duckers to place the consideration of an ordinance to establish a Neighborhood Centers Board on the Commission agenda for consideration. Ayes: (5). Nays: (0). Motion carried. A MOTION was made by Commissioner Graves, seconded by Commissioner Duckers to introduce an ordinance for first reading creating and establishing the Neighborhood Centers Board; providing for the appointment of its members and defining the duties and powers of said board. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: A MOTION was made by Commissioner Simpson, seconded by Commissioner Geis to recess into executive session to discuss the possible issuance of Industrial Revenue Bonds and to reconvene at 4:45 P.M. The Commissioners recessed at 4:17 P.M. and reconvened at 5:00 P.M. A MOTION was made by Commissioner Duckers, seconded by Commissioner Simpson that the Regular Meeting of the Board of Commissioners be adjourned. Ayes: (5). Nays: (0). Motion carried.
