Regular Meeting of the Board
of Commissioners
July 3, 1978
The Regular Meeting of the Board of Commissioners met in the Commissioners'
(Room, City -County Building, on Monday, July 3, 1978, at four o'clock P.M.
The Mayor asked everyone to stand for the opening ceremony.
There were present:
Mayor Jack Weisgerber, Chairman presiding
Commissioner Keith G. Duckers
Commissioner Dan S. Geis
Commissioner Karen M. Graves
Commissioner Gerald F. Simpson
comprising a quorum of the Board, also:
L. 0. Bengtson, City Attorney
Norris D. Olson, City Manager
D. L. Harrison, City Clerk
Absent:
None
The Minutes of the Regular Meeting of June 26, 1978 were approved as
printed.
Mr. Olson introduced the Director of the Salina Bicentennial Center,
Mickey Yerger, and the Commissioners welcomed him.
STAFF AGENDA
Mr. Shelby Willis, Bucher and Willis, reported on the bids received
June 16, 1978 for the construction of the ballfield complex in Lower Indian Rock
Park, and recommended the contracts for Item 1, Earthwork and Item 9 for asphaltic
paving be awarded to Brown and Brown, Inc. in the amount of $230,621,50; and that
�Item 2 for concrete and Item 5 for landscaping be awarded to Western Construction
in the amount of $92,684.50, and that items 3, 4, 6, 7, 8 and 10 be rejected and
readvertise for bids on those items. A motion was made by Commissioner Simpson,
seconded by Commissioner Duckers to award the contracts for Items 1 and 9 to
Brown and Brown, Inc., in the amount of $230,621.50, and to award the contracts
for Items 2 and 5 to Western Construction Company, in the amount of $92,684.50,
and to reject the bids on items 3, 4, 6, 7, 8 and 10, and to instruct the
architect to readvertise for bids on those items as soon as practically feasible.
Ayes: (5). Nays: (0). Motion carried.
AN ORDINANCE was introduced for second reading entitled: ''AN ORDINANCE
providing for the payment of interest by the City on deposits made by water
customers; amending Section 35-26 of the Salina Code; and repealing the existing
section.'' A motion was made by Commissioner Graves, seconded by Commissioner
Geis to adopt the ordinance as read and the following vote was had: Ayes:
Simpson, Duckers, Geis, Graves, Weisgerber (5). Nays: (0). Carried. The Mayor
approved the Ordinance and it is numbered 8641. The ordinance was introduced for
first reading June 26, 1978.
AN ORDINANCE was introduced for second reading entitled: ''AN ORD114ANCE
Droviding for the forfeiture of unclaimed deposits of water customers; amending
Section 35-29 of the Salina Code; and repealing the existing section.'' A motion
Nas made by Commissioner Geis, seconded by Commissioner Duckers to adopt the
)rdinance as read and the following vote was had: Ayes: Simpson, Duckers, Geis,
craves, Weisgerber (5). Nays: (0). Carried. The Mayor approved the Ordinance
and it is numbered 8642. The ordinance was introduced for first reading June 26,
1978.

THE CITY ENGINEER reported on a request from The Shaver Partnership for
a 42 foot exit driveway for Homestead Savings and Loan. "This Driveway is on
the west side of Ohio Street at 2070 South Ohio. It is planned as an exit onto
Ohio from a 6 lane drive-through banking facility. As this drive can only be
used as an exit I would have no objections to it being constructed as shown on
their plot plan.
'They have also requested a left turn bay be constructed in the median
at the intersection of Ohio Street and Shalimar Drive and expressed a willingness
to pay for the construction of the same.
"I would recommend approval of both these requests under the above
stated conditions."
A motion was made by Commissioner Simpson, seconded by Commissioner
Duckers to accept the recommendation of the City Engineer and approve the 42'
exit driveway and the left turn bay in the median in the 2000 block of South
Ohio. Ayes: (5)• Nays: (0). Motion carried.
A MOTION was made by Commissioner Duckers, seconded by Commissioner
Graves to introduce an ordinance for first reading pertaining to the procedure
for processing complaints and providing for the time in which to file an appeal
from a determination made by the (Human Relations) Director; amending Section
Ila -72(6) and Section lla72-(8) of the Salina Code and repealing the existing
sections. Ayes: (5). Nays: (0). Motion carried.

Simpson to introduce an ordinance for first reading providing for the procedure
for requesting a public hearing before the Human Relations Commission; amending
Section Ila -72(9) of the Salina Code and repealing the existing section. Ayes:

A MOTION was made by Commissioner Graves, seconded by Commissioner
Duckers to introduce an ordinance for first reading providing the procedure for
notifying the complainant and respondent of the result of the public hearing;
amending Section lla-72(13) of the Salina Code and repealing the existing section.

PETITION NUMBER 3705 was filed by Richard Barlow for water service for
Lots 1, 2, 5, Block 1; Lot 1, Block 2; and Lot 1, Block 3, Eastridge Addition.
A motion was made by Commissioner Duckers, seconded by Commissioner Graves to
refer the petition to the City Engineer for a report. Ayes: (5). Nays: (0).
Motion carried.
PETITION NUMBER 3706 was filed by Dr. D. C. King for the vacation of
the West 25 feet of street right-of-way on Ohio Street between Cloud and Schippel
Drive. A motion was made by Commissioner Geis, seconded by Commissioner Simpson
to refer the petition to the City Engineer for a recommendation. Ayes: (5)•
Nays: (0). Motion carried.
COMMISSION AGENDA
"RECONSIDERATION OF PREVIOUS POSITION TAKEN BY THE CITY COMMISSION
RELATIVE TO SCHILLING MANOR HOUSING COMPLEX." (Sponsored by Mayor Weisgerber)
Mayor Weisgerber - I think the Commissioners are all aware of the reasor
for this, through one means or another, but in the beginning when the disposition
of Schilling Manor by the General Services Administration was talked of, we had
hoped that the city might act as a pass through agency and that this might go to
Good Sam. When that fell through then there was talk, and I think the real
estate people in town, perhaps, were afraid of the impact of "dumping" houses out
at Schilling might have on the community; so we talked with the GSA about a
preventive maintenance contract and letting these houses, perhaps, be sold a few

at a time under the wing of the city and Airport Authority. Since that time the
Schilling Task Force, a committee appointed and working with the Chamber of
Commerce, with representation from the City Commission, the County Commission and
from the school board and from the real estate people in town, have changed their
thinking. Their thinking now is, let's tell GSA to sell those as quickly as
possible. Some time, some way some how the city has to feel the impact, and it
just as well be now and get them worked out and get that over with, much like was
true with Schilling in the beginning. So they have asked the City, the special
task force has asked the City to officially write a letter to GSA requesting them
to make disposition, put those up for auction, make disposition of those homes
just as soon as possible. The longer they go there will be more deterioration,
the more quickly they can be sold, the better shape they will be in and these
houses and their availability won't hang over the Salina housing market like a
sword. I have talked to the other Commissioners about it, they have been to
different meetings, different places, and I think perhaps we are in agreement on
this, but this is the reason and a little bit of quick background on the reason
for having this particular item on the agenda.
Bob Whitworth - That was very well put Mr. Mayor. I have no additional
comments unless there are questions.
Commissioner Simpson - We were to receive an official epistle from GSA
in regard to their economic impact study, have we received anything of that, or
is it mothballed somewhere?
Bob Whitworth - I do not think that there is going to be any report on
the impact study. After this action taken today it will be a mute question
anyway.
Commissioner Duckers - But even the delay that we are getting on that
is more reason that we should take this action today, in my opinion, each time it
just takes longer than they tell us it will, and we anticipate it will drag on,
and deterioration would just continue.
Bob Whitworth - They have just recently advertised the Cullen Village
complex, 1,053 units, and they will be sold August 16th of this year, and I think
they are already making plans to prepare to sell the Schilling Manor complex
Nithin 60 days following the sale of the properties there in Topeka. They have
asked the Chamber to provide some information concerning the community. I guess
this helps them get a higher price for the homes, but that has been forwarded to
3SA and I think they are already preparing to dispose of the homes. In addition
to what the Mayor has reported, I think it is the opinion of most of the GSA
3eople that they would like to go ahead and sell the property anyway as soon as
Dossible. We may or may not have had an opportunity for a P.M. contract.
Lee Boller - Have these things been appraised at all, and do you know
how much does it go for on the average?
Bob Whitworth - They have been appraised but the appraisal price is not
public information. GSA will release that.
I Commissioner Simpson - I would concur with the recommendation. I think
the community, the area is in pretty good economic situation right at the present
Itime,
with I think the latest figures will show somewhere in excess of 25,000 in
!the labor force and a rather low unemployment figure, and coming off of what
appears to be a pretty good harvest. There is no good time to have this type of
Ithing hit the community, but now is probably as good a time as any.
Mayor Weisgerber - I think this is what the Board of Realtors came
!around to feeling that it better be done.
Commissioner Graves - Our experience was so good in 1962 rebounding, I
think that most people don't fear what is going to happen. I think the track
record of this community is pretty darn good in dealing with this kind of thing.
I think everybody just thinks if it is inevitable, get it over with.
Commissioner Simpson - I would wonder if the Planning Commission might
look at the possibility of annexation of Schilling Manor, the ramifications of
that and what desirability it has.
Keith Rawlings - That is one of the areas that has been on the annexatio
plan for the 1 to 3 year period and I think it is about due anyway for considerati n.
Commissioner Simpson - It probably should be fairly immediate considerat on
because of the eminent sale.
A motion was made by Commissioner Simpson, seconded by Commissioner
Duckers that the Mayor notify the General Services Administration that it is the
desire of the City of Salina that they release and sell the Schilling Manor
complex at the earliest possible date. Ayes: (5). Nays: (0). Motion carried.
A MOTION was made by Commissioner Simpson, seconded by Commissioner
Graves, to add appointments to boards and commissions to the agenda for considerat on.
Ayes: (5)• Nays: (0). Motion carried.
The Mayor, with the approval of the City Commissioners, made the
following appointments:
Human Relations Commission
Josephine Hernandez, appointed to succeed Mrs. Manuel (Gladys C.)
Guzman for a 3 year term to June 7, 1981.
Leon Boldridge, appointed to succeed Flavel Simcox for a 3 year term to
June 7, 1981.
RECREATION COMMISSION
Stan Nelson, reappointed for a 4 year term to June 30, 1982.

The Commissioners brought the following items to the floor for discussio :
Commissioner Geis said he has had several complaints from an area about
a prolonged garage sale, and asked the staff to look into an ordinance limiting
the time a garage sale may be carried on.
The City Attorney replied that the city is aware of the present situatior
and is doing what it can do under the present provisions of the Salina Code to
get the present situation stopped. He said he has asked the Planning Commission
to make a recommendation as to the definition of what activities can be carried
on in a residential area in the guise of a garage sale.
A MOTION was made by Commissioner Simpson, seconded by Commissioner
Duckers to recess into executive session until 5:00 P.M to discuss a personnel
matter. Ayes: (5)• Nays: (0). Motion carried.
The Commissioners recessed at 4:42 P.M. and reconvened at 5:00 P.M.
A MOTION was made by Commissioner Duckers, seconded by Commissioner
Geis, that the Regular Meeting of the Board of Commissioners be adjourned. Ayes:
(5). Nays: (0). Motion carried. The meeting adjourned at 5:01 P.M.

WAIVER AND CONSENT TO HOLD A SPECIAL MEETING
OF THE BOARD OF COMMISSIONERS
We, the undersigned, being the duly elected, qualified and acting
Commissioners of the City of Salina, Kansas, and constituting a majority of the
Board of Commissioners of the City of Salina, Kansas, do hereby waive notice and
consent to the holding of a special meeting of the Board of Commissioners on the
10th day of July, 1978, at 1:30 P.M. for the purpose of holding a Budget Work
Session.
