06-26-1978 Minutes11 4.8 City of Salina, Kansas Regular Meeting of the Board of Commissioners June 26, 1978 The Regular Meeting of the Board of Commissioners met in the Commission S' Room, City -County Building, on Monday, June 26, 1978, at four o'clock P.M. II The Mayor asked everyone to stand for the opening ceremony. There were present: Mayor Jack Weisgerber, Chairman presiding Commissioner Keith G. Duckers Commissioner Dan S. Geis Commissioner Karen M. Graves Commissioner Gerald F. Simpson comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None The Minutes of the Regular Meeting of June 19, 1978 were approved as printed. STAFF AGENDA BIDS WERE RECEIVED for Engineering Project 78-639 for street and utility improvements in Country Club Heights Addition #5 and Dow Addition: Part I Water and Sanitary Sewer Improvements Stevens Contractors, Inc. $100,115.00 Commence July 15, 1978 and require 180 calendar days Smoky Hill, Inc. 109,357.50 Commence September 25, 1978 and require 90 calendar days Earth Excavation, Inc. 110,066.00 Commence September 5, 1978 and require 150 calendar days Engineer's Estimate 112,110.00 Part 11 Storm Sewer and Pavement Improvements (Asphaltic Pavement Alternate) Brown and Brown, Inc. $202,032.50 Commence September 1, 1978 and require 180 calendar days after completion of Part 1 Engineer's Estimate $210,875.00 Part II Storm Sewer and Pavement Improvements (Concrete Pavement Alternate) No bids Engineer's Estimate $210,875.00 1 L 1 1 A motion was made by Commissioner Simpson, seconded by Commissioner Duckers to award the contract for Part I to Stevens Contractors, Inc., as the low bidder in the amount of $100,115.00, and to award the contract for Part II to Brown and Brown, Inc. as the low bidder for the asphaltic pavement alternate, in the amount of $202,032.50, providing the bids meet the specifications. Ayes: (5). Nays: (0). Motion carried. THE ARCHITECT reports on the bids received for the construction of the ballfield complex in Lower Indian Rock Park. (Bids were received June 16, 1978) Mr. Shelby Willis, Bucher & Willis, said there is a strong possibility that about 1/2 of the contracts for which bids were received June 16th can be awarded, but they are not ready to recommend that and asked the City Commission to delay action on the matter one week so they can negotiate contracts on a few items outsite the engineer's estimate. Commissioner Simpson asked if that is preferable to letting bids at this time. The City Attorney said it is imperative that the City Commission know the work can be completed within the engineer's estimate. A motion was made by Commissioner Duckers, seconded by Commissioner Graves to grant the request of the Architect and that the delay in receiving the report be granted. Ayes: (5). Nays: (0). Motion carried. AN ORDINANCE was introduced for second reading entitled: ''AN ORDINANCE providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof.'' [Z78-6 filed by Planters State Bank for the rezoning of Lots 110, 111, 112, 113 on Iron Avenue and Lot 114 on 8th Street, Original Town, from C-1 to C-4 (Central Business District).] A motion was made by Commissioner Geis, seconded by Commissioner Duckers to adopt the ordinance as read and the following vote was had: Ayes: Simpson, Duckers, Geis, Graves, Weisgerber (5). Nays: (0). The Mayor approved the ordinance and it is numbered 8640. The ordinance was introduced for first reading June 12, 1978. A LETTER was received from the City Planning Commission recommending that individual mobile homes be added to residential districts (R, RS, R-1, R-2, R-2.5, and R-3) as a conditional use with certain restrictions. [Z78-7 filed by the Salina City Planning Commission to allow the placement of individual mobile homes on residential lots as a conditional use.] Evelyn Poague, said she was present at the City Planning Commission meeting and she feels the 17'minimum width requirement is too wide, because low and moderate income families cannot afford mobile homes that large. George Etherington was present in opposition to the recommendation and asked that the matter be referred back to the City Planning Commission so he will have an opportunity for some input. Myrna Baker said she was present at the City Planning Commission meeting and is opposed to the restriction of 17' minimum width and asked that the proposal be denied or discussed more. Lyle Melvin explained that basically nothing has been changed because modular homes can be put anywhere in Salina provided they meet the Salina Building', Code. He said the 17 foot minimum width would eliminate mobile homes on residential lots because there are no 17' wide mobile homes. When you get into that width you are into multi -sections or sectional housing. He said this is a good recommendation and should be adopted. Commissioner Geis said he is in favor of this recommendation of the City Planning Commission on the basis that it does provide an option to those people in the income bracket where such residential quarters would be desirable. He said he thinks the restrictions that have been placed on them would be sufficient to eliminate them from some of the areas mentioned in the local newspaper editorial. Commissioner Simpson said it seems there is little doubt of the value of the mobile home to provide lower cost housing than conventional structurf but is seems to be incompatible with a good land use program to incourage mobile home development outside of a contiguous area that is provided for by our present zoning laws, whether they be rental or for sale type units in mobile home zoning and we should encourage that type of development. Commissioner Graves said she is concerned about the neighborhoods and that the City Commission must look at the entire city and can't allow neighborh to decline without reinvesting in them. Commissioner Simpson said if Mr. Melvin's comments are correct and there are no mobile homes 17 feet wide, we are not talking about putting mobile homes any place, we are talking about putting modular housing that does not meet the Salina Housing Code and thus is called a mobile home in isolated areas. It seems to be more feasible to address that subject by itself or insure some way for modular housing to meet the building codes so we could be sure people had low cost, but yet good and safe housing. If this doesn't have anythinc to do with mobile homes it would seem capricious to introduce it into our ordinanc A motion was made by Commissioner Simpson, seconded by Commissioner Graves to reject the recommendation of the City Planning Commission and deny the Zoning Application. Mr. Bengtson explained this application must be returned to the City Planning Commission once for its reconsideration with the reasons stated for it being returned. A motion was made by Commissioner Simpson, seconded by Commissioner Graves to refer the zoning application back to the City Planning Commission for its reconsideration at the request of Mr. Etherington and others, and to reconsider a minimum width of less than 17 feet. Ayes: (5). Nays: (0). Motion carried. A LETTER was received from the City Planning Commission recommending that County Zoning Request 78-5, filed by Abbott Construction Company for the rezoning of 99.5 acres in the Southeast Quarter of the East half of the Southwest Quarter of Section 2, Township 14 South, Range 3 West from AG (Agricultural) to IH (Heavy Industrial), be approved subject to platting. A motion was made by Commissioner Graves, seconded by Commissioner Duckers to accept the recommendatior of the City Planning Commission and recommend that County Zoning Request 78-5 be approved, subject to it being platted. Ayes: (5). Nays: (0). Motion carried. A MOTION was made by Commissioner Geis, seconded by Commissioner Duckers to introduce an ordinance for first reading providing for the payment of interest by the City on deposits made by water customers; amending Section 35-26 of the Salina Code; and repealing the existing section. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: A MOTION was made by Commissioner Geis, seconded by Commissioner Duckers to introduce an ordinance for first reading providing for the forfeiture of unclaimed deposits of water customers; amending Section 35-29 of the Salina Code; and repealing the existing section. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: MAURICE BOWERSOX AND RALPH RICKLEFS, Wilson and Company, presented a report on the South Salina Drainage Study, authorized by the City Commission on October 17, 1977. They proposed the construction of ponding areas, main interceptors, open ditch drainage, and enclosed drainage. They explained the alternative financing methods and the possibility of federal and state aid. A motion was made by Commissioner Geis, seconded by Commissioner Duckers to accept the report from Wilson and Company. Ayes: (5). Nays: (0). Motion carried. IS) S. 1 1 1 1 5t The City Manager set the date of July 10, 1978 for a public hearing on the proposed use of Revenue Sharing Money for the 10th Entitlement Period, and instructed the City Clerk to advertise for requests to be received by his office. PUBLIC AGENDA A SURETY ON BAIL BOND License Application was filed by Kyle B. Mansfieldb 142 South Third, Agent for B S K Bonding. The City Clerk reported the applicant has paid the required fee and has been fingerprinted by the Police Department. A motion was made by Commissioner Duckers, seconded by Commissioner Graves to approve the license application and authorize the City Clerk to issue the license. Ayes: (5). Nays: (0). Motion carried. A REQUEST was received from Homestead Savings and Loan Association for the approval of a 42' driveway entrance at 2070 South Ohio. A motion was made by Commissioner Simpson, seconded by Commissioner Geis to refer the request to the City Engineer for a report. Ayes: (5). Nays: (0). Motion carried. A REQUEST was received from Arthur F. Crocker for the City Commission to establish a policy for reserving the gazebo in Oakdale Park. Commissioner Duckers said he feels it works well the way it has been done in the past and moved that the request be tabled. The motion died for the lack of a second. A motion was made by Commissioner Graves, seconded by Commissioner Geis to put up a bulletin board so people can reserve their own dates. Ayes: Graves, Simpson (2). Nays: Geis, Duckers (2). Mayor Weisgerber voted Aye. Motion carried. COMMISSION AGENDA A MOTION was made by Commissioner Graves, seconded by Commissioner Geis to call a Special Meeting July 3, 1978 at 2:00 P.M. to consider appointments to boards and commissions and to discuss the Smoky Hill River Channel Study. Ayes: (5). Nays: (0). Motion carried. Commissioner Simpson suggested the Commissioners consider changing the meeting time of City Commission meetings to earlier in the afternoon so there will be sufficient time to consider items the Commissioners wish to discuss. The Commissioners did not bring any other items to the floor for discussion. A MOTION was made by Commissioner Geis, seconded by Commissioner Simpson that the Regular Meeting of the Board of Commissioners be adjourned. Ayes: (5). Nays: (0). Motion carried.
