05-08-1978 Minutes1.4 City of Salina, Kansas Regular Meeting of the Board of Commissioners May 8, 1978 The Regular Meeting of the Board of Commissioners met in the Commissions' er Room, City -County Building, on Monday, May 8, 1978, at four o'clock p.m. II The Mayor asked everyone to stand for the opening ceremony. There were present: Mayor Jack Weisgerber, Chairman presiding Commissioner Keith G. Duckers Commissioner Dan S. Geis Commissioner Karen M. Graves Commissioner Gerald F. Simpson comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None printed. The Minutes of the Regular Meeting of May 1, 1978 were approved as MAYOR WEISGERBER presented a plaque "In recognition of service rendered by Keith Duckers as Mayor of the City of Salina, Kansas, April 18, 1977 to April 17, 1978", and the gavel he used during his term in office, and thanked him for an outstanding year and a job well done. Commissioner Duckers thanked him, and thanked the citizens for the recognition. THE MAYOR PROCLAIMED the Week of May 14 through 21, 1978 - "NATIONAL NURSING HOME WEEK". The proclamation was read by Jane Mapes, Activity Director of Shalimar Plaza Nursing Home, for Shalimar Plaza Nursing Home and for Kenwood View Nursing Home. THE MAYOR PROCLAIMED the Week of May 13 through 20, 1978 - "KEEPING AND STAYING FIT WEEK". The proclamation was read by Norma Thomas, Supervisor at the Memorial Hall Neighborhood Center. THE MAYOR PROCLAIMED the Week of May 7 through 13, 1978 - "HOSPITAL WEEK IN SALINA". The proclamation was read by Larry Evans of St. John's Hospital. THE MAYOR PROCLAIMED the Week of May 7 through 14, 1978 - "NATIONAL MUSIC WEEK". The proclamation was read by Mrs. Hannen Middleton. THE MAYOR PROCLAIMED the Month of May, 1978 - "BETTER HEARING AND SPEECH MONTH IN SALINA, KANSAS". The proclamation was read by John Zimmerman, School Audiologist. STAFF AGENDA AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE authorizing the issuance of Internal Improvement Bonds of the City of Salina, Kansas, in the sum of $755,000.00, to pay the cost of sidewalks, lighting, landscaping, curbing, guttering, paving, sanitary sewer, storm sewer and water main improvements in the City, to be designated as Series P-221." A motion was made by Commissioner Simpson, seconded by Commissioner Graves to adopt the ordinance as read and the following vote was had: Ayes: Duckers, Geis, Graves, Simpson, Weisgerber (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered 8634. The ordinance was introduced for first reading May 1, 1978. f' 1 �7 1 1.1.55 I A RESOLUTION was introduced and passed entitled: "A RESOLUTION authorizing and ordering certain curbing, guttering, paving, grading storm sewer, water main, sanitary sewer and sewage pump station and force main improvements, ordering preparation of plans and specifications, and the estimate of costs." (Engineering, Project 78-635 - Park West Addition) A motion was made by Commissioner Duckers, seconded by Commissioner Geis to adopt the Resolution as read and the following vote was had: Ayes: Duckers, Geis, Graves, Simpson, Weisgerber (5). Nays: (0). Carried. The Mayor approved the Resolution and it is numbered 3368. THE CITY ENGINEER filed plans and specifications for street and utility 1 improvements in Park West Addition in Engineering Project 78-635. A motion was made by Commissioner Geis, seconded by Commissioner Graves to approve the plans and specifications as filed by the City Engineer. Ayes: (5). Nays: (0). Motion carried. A MOTION was made by Commissioner Geis, seconded by Commissioner Graves to set the date of May 22, 1978 as the date to receive bids for street and utility improvements in Engineering Project 78-635, and to instruct the City Clerk to advertise for bids. Ayes: (5). Nays: (0). Motion carried. A MOTION was made by Commissioner Graves, seconded by Commissioner Simpson to introduce an ordinance for first reading authorizing and directing the issuance of $4,394,000.00 principal amount of combined Water and Sewage System Refunding Revenue Bonds, Series of 1978, of the City of Salina, Kansas, for the purpose of refunding $4,670,000 principal amount of outstanding combined Water and Sewage System Revenue Bonds of said city, prescribing the form and details of said Refunding Revenue Bonds, providing for the collection, segregation and application of the Revenues of said system for the purposes authorized by law, including paying the cost of operation, improvement and maintenance of said utility, paying the principal of and interest on the Refunding Revenue Bonds of said City issued against said system and providing adequate reserve funds, making certain covenants with respect to said bonds, authorizing an escrow trust agreement relating to certain prior lein bonds and authorizing a securities option and purchase agreement relating to the bonds herein authorized." Ayes: (5). Nays: (0). Carried. Ordinance Passed: Number: A MOTION was made by Commissioner Duckers, seconded by Commissioner Graves to introduce a Charter Ordinance for first reading exempting the City of Salina, Kansas, from K.S.A. 79-5011; providing substitute and additional provision s on the same subject; and authorizing the levying of taxes to create a special fund for the purpose of paying utility service costs." Ayes: (5). Nays: (0). Motion carried. Charter Ordinance Passed: Number: Mr. Bengtson explained this charter ordinance is to remove the cost of utilities to the city, which are now under the General Fund, and make a special fund for utilities. A LETTER was received from the City Planning Commission recommending the approval of Zoning Application 78-5, filed by Raymond Boyer, for the rezoning of the West 210 feet of the South 65 feet of Lot 2, Block 1, Tolle Subdivision to District R-2 (Mutliple-Family Residential). A motion was made by Commissioner' Geis, seconded by Commissioner Simpson to accept the City Planning Commission's recommendation and approve the zoning application, and to introduce the rezoning ordinance for first reading. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: None PUBLIC AGENDA COMMISSION AGENDA A MOTION was made by Commissioner Simpson, seconded by Commissioner Duckers to add appointments to boards and commissions to the agenda for consideration. Ayes: (5). Nays: (0). Motion carried. THE MAYOR, with the approval of the Board of Commissioners, made the following appointments: Electrical Code Panel John Wickersham, Electrical Contractor, appointed to succeed John Snedker for a 5 year term to April 6, 1983. Salina Airport Authority Dean Tinkler, reappointed for a 3 year term to April 26, 1981. Ben Vidricksen, appointed to succeed C. J. Wertz for a 3 year term to April 26, 1981. Joe Cloud, appointed to fill the unexpired term of John Zimmerman to April 26, 1979. Board of Zoning Appeals William Grosser, Jr., reappointed for a 3 year term to May 3, 1981. D. Wayne Montgomery, reappointed for a 3 year term to May 3, 1981. City Planning Commission Jerry Exline, appointed to succeed Mrs. Dan Geis for a 3 year term to May 3, 1981. Carl Ramsey, reappointed for a 3 year term to May 3, 1981. Mrs. 0. S. Fent, appointed to succeed Kenneth Rhea for a 3 year term to May 3, 1981. Board of Public Welfare Mrs. Hilmer Andersen, reappointed for a 5 year term to May 21, 1983. Salina Arts Commission Mrs. Maxine Mitchell, appointed to fill the unexpired term of Charles Roth to March 10, 1981. The Commissioners brought the following items to the floor for discussion: repairs. Commissioner Duckers asked for an update on the railroad crossing Mr. Boyer replied Missouri Pacific started work on the Ohio Street crossing, and that the City will probably remove the tracks and repair the crossings for Rock Island. The Commissioners and staff discussed the use of Community Development funds to make the railroad crossing repairs, the procedure to let the job out on bids, the necessity of a federal wage determination, and the advisability of temporary repairs. Commissioner Graves asked about the baseball diamonds. r 1 1 1 Mr. Olson replied work is progressing well. The fencing is ready to go, and the lights are being installed, and the work will probably be completed by the time the scheduled season of play begins; and that the architect will probably file plans and specifications for the Lower Indian Rock ball diamonds next Monday, and the date can be set to receive bids for the construction of that complex. A MOTION was made by Commissioner Duckers, seconded by Commissioner Simpson, that the Regular Meeting of the Board of Commissioners be adjourned. Ayes: (5). Nays: (0). Motion carried.
