03-06-1978 Minutes1 1 F� City of Salina, Kansas Regular Meeting of the Board of Commissioners March 6, 1978 i The Regular Meeting of the Board of Commissioners met in the Commissionets' Room, City -County Building, March 6, 1978 at four o'clock p.m. i There were present: Mayor Keith G. Duckers, Chairman presiding Commissioner Dan S. Geis Commissioner Karen M. Graves Commissioner Gerald F. Simpson comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: Commissioner Jack Weisgerber The Minutes of the Regular Meeting of February 27, 1978 were approved as printed. STAFF AGENDA THE CITY MANAGER reported on bids received February 27, 1978 for equipment and vehicles, that the bid of American Fire Equipment Company, in the amount of $38,593.00, did meet the specifications of the Mini Attack Pumper, anc recommended that bid be accepted. The low bid of Long McArthur, Inc., in the amount of $7,397.00, did meet the specifications of the truck body and chassis for the Street Department, and recommended that bid be accepted. The low bid of Bacon and Clark Dodge, Inc., in the amount of $4,597.00, did meet the specifications for the pickup truck for the Street Department, and recommended that bid be accepted. The low bid of Long McArthur, Inc., in the amount of $8,397.00, for a dump truck for the Sanitation Department did meet the specifications, and recommended that bid be accepted. The low bid of Massey Ferguson and the next low bid of Foley Tractor Company did not meet the specifications, and recommended the bid of Seller Tractor Company, in the amount of $47,000.00 for the new unit, be accepted as it did meet the specifications. A motion was made by Commissioner Graves, seconded by Commissioner Simpson to accept the recommendation of the City Manager and award the bids as recommended. Ayes: (4). Nays: (0). Motion carried. AN ORDINANCE was introduced for second reading entitled: ''AN ORDINANCE annexing certain land to the City of Salina, Kansas, in conformity with the provisions of K.S.A. 12-519 to 12-526, inclusive.'' (Annexing the remainder of Mayfair Addition). A motion was made by Commissioner Simpson, seconded by Commissioner Graves to adopt the ordinance as read and the following vote was had: Ayes: Geis, Graves, Simpson, Duckers (4). Nays: (0). Commissioner Weisgerber absent. Carried. The Mayor approved the ordinance and it is numbered 8620. The ordinance was introduced for first reading February 27, 1978. Commissioner Weisgerber absent. Carried. The Mayor approved the Ordinance and it is numbered 8621. The ordinance was introduced for first reading February 27, 1978. AN ORDINANCE was introduced for second reading providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof." [Z77-24 filed by Development Consultants, Inc. for the rezoning of part of Lots 8 and 9 and all of Lot 10, Block 7, Oakdale Addition from District R-2 to R-3 (Multiple Family Residential).] A motion was made by Commissioner Geis, seconded by Commissioner Simpson to adopt the ordinance as read and the following vote was had: Ayes: Geis, Graves, Simpson, Duckers (4). THE COMMISSIONERS considered an ordinance amending Section V (c), Appendix B of the Salina Code. [Requested in Petition Numbers 3678 and 3679, which were filed by John Mize.] A motion was made by Commissioner Simpson, seconded by Commissioner Geis to table consideration of this ordinance until March 20, 1978, and to ask the County Clerk, County Treasurer, Register of Deeds, County Appraiser, and abstracters for their input on the matter prior to, or at that meeting. Ayes: (4). Nays: (0). Motion carried. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE establishing the Bicentennial Center Authority; providing for the appointment of its members; defining their duties and responsibilities; enacting Article VIII of Chapter 2 of the Salina Code." A motion was made by Commissioner Simpson, seconded by Commissioner Graves, to adopt the ordinance as read and the following vote was had: Ayes: Geis, Graves, Simpson, Duckers (4). Nays: (0). Commissioner Weisgerber absent. Carried. The Mayor approved the ordinance and it is numbered 8623. The ordinance was introduced for first reading February 27, 1978. [i 1 i, lv THE CITY ENGINEER reported on the drainage problem for the area east of Ohio Street, west of the dike, south of Crawford Avenue and north of Cloud Street. "The above subject area is much like the land to the south of this area and on south of the City. The land is very flat with existing low areas that do not drain at the present time. Further development could take place in the area with the construction of drainage structure and the sacrifice of some land to be used as ponding areas. The ponding areas would be required to handle the drainage in excess of the capacity of the drainage structures through the dike on the west side of the area and to store the storm drainage in the event the flap gates were closed on the dike structures due to high water elevation in the Smoky Hill River. "I would recommend that the drainage problem be taken care of prior to further development to the east of the present housing developments in any part of this area. 'The Engineering Department has the capability of making this study; however, we do not think it would be fair to give it priority over our present projects. Our present work load would probable dictate a study this Fall if we were to do it. If Wilson and Company were to do it, it would have the added advantage, besides timing, of being done under the same criteria as the rest of their project. Also, if Wilson and Company were to make the study I do not think they should hold up or delay their presently contracted work to do this one as it is in a separate drainage area. However, they may be able to incorporate it into the same time frame as their present work.'' Virg Lundberg was present and informed the City Commission that Saline County Drainage District # 5 was established in the early 1930's by property owners because they were concerned about storm drainage in this area. He asked the City Commission to have the study made. A motion was made by Commissioner Simpson, seconded by Commissioner Geis to accept the City Engineer's report and to instruct the staff to contact Wilson & Company to define the scope, the cost and a time estimate for the study, and how it would tie in with the 2 projects they are currently working on. A RESOLUTION was introduced and passed entitled: "A RESOLUTION authorizing the City Manager to execute the funding agreement for Amended Third Year Community" Development Block Grant Funds." A motion was made by Commissioner Geis, seconded by Commissioner Simpson to adopt the Resolution as read and the following vote was had: Ayes: Geis, Graves, Simpson, Duckers (4). Nays: (0). Commissioner Weisgerber absent. Carried. The Mayor approved the Resolution and it is numbered! 3354• THE CITY ENGINEER reported on Petition Number 3680 filed by Rev. N. Rene Colaw for the Nazarene Church, and recommended the street right-of-way on the north side and on the east side of Nazarene Addition be vacated. A motion was made by Commissioner Graves, seconded by Commissioner Geis to accept the recommendation of the City Engineer to vacate the street right-of-way, and to introduce the ordinance for first reading. Ayes: (4). Nays: (0). Motion carried. Ordinance Passed: PUBLIC AGENDA Number: PETITION NUMBER 3685 was filed by George Etherington for A. B. Seelye Company, Inc. for curbing, guttering, paving Seitz Drive from Applewood Lane to Glen Avenue, Village Lane from Georgetown Road to Seitz Drive, and water and sanitary sewer services for certain lots in the Replat of Blocks 4, 10, 11, 12, Georgetown Addition. A motion was made by Commissioner Graves, seconded by Commissioner Simpson to refer the petition to the City Engineer for a report. Ayes: (4). Nays: (0). Motion carried. _ PETITION NUMBER 3686 was filed by Mid Continent Enterprises, Ltd, by W. C. Chaffee for curbing, guttering, paving Georgetown Road from Village Lane to Crawford, and Fairdale Road from Village Lane to Crawford. CEREAL MALT BEVERAGE license applications filed by Manpower, Inc. of Wichita, d/b/a Champlin Service Station, for the following locations: 1041 East Iron Avenue, 1103 East Crawford, 204 South Broadway. The City Clerk reported the applicant has paid the required fee and the applications have been approved by the Health Department, Zoning Officer and the Police Department. A motion was made by Commissioner Geis, seconded by Commissioner Simpson to approve the license applications and authorize the City Clerk to issue the licenses. Ayes: (4). Nays: (0). Motion carried. SURETY ON BAIL BOND license applications were filed by: Jack Kindlesparger, d/b/a B & K Bonding, 101 North Estates Drive. Stephen M. Klingzell, agent for B & K Bonding. Eric Kindlesparger, agent for B & K Bonding. The City Clerk reported the applicants have paid the required fee and have been fingerprinted by the Police Department, and that Jack Kindlesparger has the proper certification of appraisal on file. A motion was made by Commissioner Simpson, seconded by Commissioner Graves to approve the license applications and authorize the City Clerk to issue the licenses. Ayes: (4). Nays: (0). Motion carried. A TREE TRIMMING License application was filed by Ron Burt, d/b/a Burt Tree Service, Culver, Kansas. The City Clerk reported the applicant has paid the required fee and has the proper bond and certificate of public liability on file. A motion was made by Commissioner Graves, seconded by Commissioner Geis to approve the license application and authorize the City Clerk to issue the license. Ayes: (4). Nays: (0). Motion carried. COMMISSION AGENDA CONSIDERATION OF AN ORDINANCE ESTABLISHING A PARK ADVISORY BOARD. (Sponsored by Commissioner Geis) A motion was made by Commissioner Geis, seconded by Commissioner Graves to complete Section 2 to read, ''The Park Advisory Board shall consist of 9 members ...", and to introduce the ordinance for first reading. Ayes: (4). Nays: (0). Motion carried. Motion carried. The Commissioners recessed at 4:43 P.M. and reconvened at 5:40 P.M.
