The Regular Meeting of the Board of Commissioners met in the Commission(
Room, City -County Building, on Monday, February 27, 1978, at four o'clock P.M.
The Mayor asked everyone to stand for the opening ceremony.

THE MAYOR PROCLAIMED the Week of February 19 through 25, 1978 - "ENGINEE
WEEK'. The proclamation was read by Gerald Memming, Smoky Valley Chapter of the
Kansas Engineering Society.

Graves to refer all bids to staff for analysis and a report back next week.

A PUBLIC HEARING was held on the annexation of Mayfair Addition,
ordered by Resolution Number 3349.
Mr. Rawlings reviewed the Service Extension Plan adopted by the City
Commission on November 21, 1977.
No protests, written or oral, were filed.
The Mayor declared the public hearing closed.
A motion was made by Commissioner Weisgerber, seconded by Commissioner
Geis to introduce an ordinance for first reading annexing the remainder of
Mayfair Addition. Ayes: (5). Nays: (0). Motion carried.

Simpson to approve the assessments and to introduce the assessment ordinance for

THE CITY ENGINEER filed a feasibility report for sanitary sewer improve
in Eastridge Addition, as requested in Petition Number 3673 filed by Richard
Barlow. A motion was made by Commissioner Geis, seconded by Commissioner Simpson
to accept the feasibility report as filed. Ayes: (5). Nays: (0). Motion
carried.
THE CITY ENGINEER filed a feasibility report for street and utility
improvements for certain lots in Country Club Estates Addition Number 3, as
requested in Petition Number 3675 filed by Roy Presley. A motion was made by
Commissioner Weisgerber, seconded by Commissioner Graves to accept the feasibility
report as filed. Ayes: (5). Nays: (0). Motion carried.
THE CITY ENGINEER filed a feasibility report for street and utility
improvements in Country Club Heights Addition Number 5, as requested in Petition
Number 3676 filed by Dr. Norman Harris. A motion was made by Commissioner
Weisgerber, seconded by Commissioner Simpson to accept the feasibility report as
filed. Ayes: (5). Nays: (0). Motion carried.
Commissioner Simpson asked for a status report on the drainage problem
in Country Club Heights Addition # 5.
Mr. Boyer reported he met with the property owners who were protesting
the drainage in this area, and are in essence in agreement with what should be
done, and that he will meet next week with Dr. Harris and Mr. Williams to work
out the plans.
THE CITY ENGINEER filed a feasibility report for street and utility
improvements for property adjoining Westchester Avenue between Ohio Street and
Westbend Road, as requested in Petition Number 3677 filed by Pat Bolen. A
motion was made by Commissioner Simpson, seconded by Commissioner Graves to
accept the feasibility report as filed. Ayes: (5)• Nays: (0). Motion carried.
A REQUEST was received from Wilson and Company to extend the due date
for the South Salina Drainage Study from April 14, 1978 to June 16, 1978 due to
the addition of the South 4th Street and slough area to the scope of the study.
A motion was made by Commissioner Graves, seconded by Commissioner Simpson to
approve the request and extend the due date of the South Salina Drainage Study to
June 16, 1978. Ayes: (5). Nays: (0). Motion carried.
Mr. George Etherington was present concerning the drainage study for
the area East of Ohio, west of the flood dike, south of Crawford and north of
Cloud Street.
The Commissioners reported this report will be considered at the
meeting March 6, 1978.

A LETTER was received from the City Planning Commission recommending
the approval of Zoning Application 77-24, filed by Development Consultants, Inc.
for the rezoning of the West 135 feet of Lot 8, Lot 9 except the north 10 feet
of the East 30 feet, and all of Lot 10, Block 7, Oakdale Addition to "R-3
(Multiple Family Residential). A motion was made by Commissioner Weisgerber,
seconded by Commissioner Geis to accept the recommendation of the City Planning
Commission and approve Zoning Application 77-24, and to introduce the rezoning
ordinance for first reading. Ayes: (5). Nays: (0). Motion carried.

A LETTER was received from the City Planning Commission recommending
the approval of the final plat of Cook Addition, as requested in Petition Number
3663 which was filed by Bob and Beverly Cook. A motion was made by Commissioner
Weisgerber, seconded by Commissioner Simpson to accept the recommendation of the
City Planning Commission and approve the final plat of Cook Addition, and to
authorize the Mayor to sign. Ayes: (5). Nays: (0). Motion carried.
A LETTER was received from the City Planning Commission recommending
the approval of the final plat of Meadowlark Acres Addition Number 3, as requested;
in Petition Number 3385, filed by Raymond Haggart. A motion was made by Commissioner
Graves, seconded by Commissioner Geis to accept the recommendation of the City
Planning Commission and approve the final plat of Meadowlark Acres Addition
Number 3, and to authorize the Mayor to sign. Ayes: (5). Nays: (0). Motion
carried.
A LETTER was received from the City Planning Commission recommending
the approval of Petitions 3678 and 3679 filed by John Mize, for amendment to the
County Clerk and City Clerk Certificate, and the Certificate as to Special
Assessments, both in Section V (c), Appendix B of the Salina Code.
A motion was made by Commissioner Graves, seconded by Commissioner
Simpson to accept the recommendation of the City Planning Commission and to
approve Petitions 3678 and 3679, and to introduce an ordinance for first reading,
11amending these certificates.

Commissioner Geis asked what advantage there is to the city to adopt
;,these certificates?
Mr. John Mize explained that it is a matter of convenience to the
developer not to have to pay the last half of the tax assessment before June 20th.1

A LETTER was received from the City Planning Commission recommending
the approval of Zoning Application 77-20A, filed by James Ward for the rezoning
of Lot 3, Block 1, Tolle Subdivision from "RS" to "R-2/P.D.D." (Multiple Family
Residential - Planned Development District). (Tabled by the City Commission on
November 21, 1977).
A motion was made by Commissioner Simpson, seconded by Commissioner
Geis to remove the matter from the table. Ayes: (5). Nays: (0). Motion carried

"C-3" to "1-2" (Light Industrial). A motion was made by Commissioner Graves,
seconded by Commissioner Geis to accept the recommendation of the City Planning
Commission and deny Zoning Application 77-26. Ayes: (5)• Nays: (0). Motion
carried.
A LETTER was received from the City Planning Commission recommending
the approval of Zoning Application 78-1, filed by Leonard and Lorieta Loy for
the rezoning of the West 210 feet of the South 65 feet of Lot 2, Block 1, Tolle
Subdivision from "R -S" to "R -l" (Single Family Residential). A motion was made
by Commissioner Simpson, seconded by Commissioner Weisgerber to accept the
recommendation of the City Planning Commission and approve Zoning Application
78-1, and to introduce the rezoning ordinance for first reading. Ayes: (5)•

to "R-2" (Multiple Family Residential). A motion was made by Commissioner

A LETTER was received from the Citizens' Advisory Committee recommendin(
that the Emergency Program be made available city wide, with strict adherence to
the definition of "Emergency" - an immediate threat to the health or safety of
the occupants of the home. A motion was made by Commissioner Simpson, seconded
by Commissioner Graves to accept the recommendation of the Citizens' Advisory
Committee and make the Emergency Program available city-wide. Ayes: (5)• Nays:

PUBLIC AGENDA
PETITION NUMBER 3681 was filed by Pepsi Cola Bottling Company by Larry
Weber for the vacation of the north -south alley between Decatur and West Lincoln
Street and also vacate North 8th Street between Decatur and West Lincoln. A
motion was made by Commissioner Geis, seconded by Commissioner Graves to refer
the petition to Engineering and Planning for a recommendation. Ayes: (5)•
Nays: (0). Motion carried.
PETITION NUMBER 3682 was filed by Limbo, Inc., by Kent Berkley, Pres.,
for the approval of the plat of Western Hills Subdivision. A motion was made by
Commissioner Simpson, seconded by Commissioner Geis to refer the petition to the
City Planning Commission for a recommendation. Ayes: (5). Nays: (0). Motion
carried.
PETITION NUMBER 3683 was filed by Dr. Daniel King for the vacation of
an existing frontage road on the west side of Ohio Street between Cloud Street
and Schippel Drive, in exchange for widening the existing right-of-way of Ohio
Street from thirty-five feet (35') to fifty feet (509 and restricting all
access on the west side of Ohio Street between Cloud Street and Schippel Drive
to the locations shown on Exhibit "B". The existing right-of-way conditions
along Cloud Street and Ohio Street are shown on Exhibit "A". A motion was made
by Commissioner Graves, seconded by Commissioner Weisgerber to refer the petition
to Engineering and Planning. Ayes: (5). Nays: (0). Motion carried.
PETITION NUMBER 3684 was filed by G s K, Inc. for paving, water and
sanitary sewer to serve Lots 16 to 22, Block 8, Replat of Lot 22, Block 3, and
Lot 9, Block 6, Dow Addition. A motion was made by Commissioner Weisgerber,
seconded by Commissioner Geis to refer the petition to the City Engineer for a
report. Ayes: (5). Nays: (0). Motion carried.

A CEREAL MALT BEVERAGE License Application was filed by American
Angler of Salina, Inc., 102 North Broadway. (New application). The City Clerk
reported the applicant has paid the required fee, and the application has been
I approved by the Health Department, Zoning Officer and Police Department. A
i motion was made by Commissioner Geis, seconded by Commissioner Simpson to approve
!� the license application and authorize the City Clerk to issue the license.

COMMISSION AGENDA
"DISCUSS THE ALTERNATIVES FOR STRUCTURING THE ORDINANCE DEALING WITH
THE BICENTENNIAL CENTER GOVERNING BODY". (Tabled from the February 6th meeting -
Sponsored by Mayor Duckers).
A motion was made by Commissioner Geis, seconded by Commissioner
Simpson to remove the matter from the table for consideration. Ayes: (5).
Nays: (0). Motion carried.
Mr. Bengtson reviewed the latest version of the ordinance establishing
a semi -autonomous governing body for the Bicentennial Center.
Commissioner Graves asked that Section 11 be amended to read: "Dissolution:
The authority may be dissolved at any time by the City by adoption of an appropriate
ordinance effecting a dissolution thereof."
Mr. Bengtson suggested that Section 9 be amended to read: "Finances:
All funds received by the City Clerk from the Saline County Treasurer, or other
sources, as provided for in the budget shall be paid over to the Treasurer of
the Authority when received in an amount not exceeding that budgeted by the said
commission for such purposes. The Authority shall have the exclusive control of
the expenditure of all money paid to the credit of its treasurer for the operation
of the center and the treasurer shall receive and pay the money under the control
of said Authority as ordered by it."
A motion was made by Commissioner Graves, seconded by Commissioner
Simpson to introduce an ordinance for first reading establishing the Bicentennial
Center Authority; providing for the appointment of its members; and defining
their duties and responsibilities, enacting Article VIII of Chapter 2 of the
Salina Code. Ayes: (5). Nays: (0). Motion carried.

Commissioner Geis asked for a status report on the Hay Report.

Mr. Harris reported the consultant is out of the country, but will be
in Salina about the middle of March to make the formal presentation.
Project. Commissioner Simpson asked about the status of the Crawford Street
Mr. Boyer reported the federal government is presently making certain
determinations on the strength of the application, and the Kansas Department of
Transportation is studying the environmental aspect of the project, and they
should be ready, by the end of March, to determine the dates for right-of-way
hearings and environmental impact hearings.
Commissioner Simpson asked if the staff has received approval on the
amended 3rd year CD application?
Mr. Rawlings replied that he expects to hear in the next week.
Mr. Olson offered to call Mr. Kilbride tomorrow to point out that the
Commission has deadlines on the wage determinations for Carver Center, the ball
diamonds and other projects.

Commissioner Geis asked that the ordinance creating a Park Advisory
Board be placed on the agenda for March 6, 1978.
A motion was made by Commissioner Simpson, seconded by Commissioner
Graves to recess into executive session to discuss a matter of litigation.

The Commissioners recessed at 5:22 P.M. and reconvened at 6:28 P.M.
A motion was made by Commissioner Simpson, seconded by Commissioner
Graves to request a meeting with the County Commissioners to discuss joint
concerns relating to subdivision regulations and platting requirements within
the 3 mile limit of Salina, and the possibility of creating a metropolitan
planning commission. Ayes: (5)• Nays: (0). Motion carried.
A MOTION was made by Commissioner Graves, seconded by Commissioner
Weisgerber that the Regular Meeting of the Board of Commissioners be adjourned.
