01-09-1978 Minutes1 1 City of Salina, Kansas Regular Meeting of the Board of Commissioners January 9, 1978 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City -County Building, on Monday, January 9, 1978, at four o'clock P.M. The Mayor asked everyone to stand for the opening ceremony. There were present: Mayor Keith G. Duckers, Chairman presiding Commissioner Dan S. Geis Commissioner Karen M. Graves Commissioner Gerald F. Simpson Commissioner Jack Weisgerber comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None The Minutes of the Regular Meeting December 19, 1977, and the Special Meeting December 23, 1977, were approved as printed. THE MAYOR PROCLAIMED Sunday, January 15, 1978 - "DR. MARTIN LUTHER KING, JR., COMMEMORATION DAY". The proclamation was read by Rev. J. E. Jones. THE MAYOR PROCLAIMED the Week of January 15 through 21, 1978 - "NATIONA JAYCEE WEEK". The proclamation was read by John Oswald. THE MAYOR PROCLAIMED January 13 and 14, 1978 - "SPECIAL V.F.W. AUY,ILIAR DAYS". The proclamation was read by Mrs. Ralph Priddy, Assistant Guard, 6th District. STAFF AGENDA THE ARCHITECT reported on bids received for the construction of the Centennial Park Neighborhood Center, and recommended contracts be awarded to Western Construction for general construction, Lucas Plumbing and Heating Company for the mechanical, Electrical Equipment Company for the electrical, and to Brann's Warehouse for the carpeting. A motion was made by Commissioner Weisgerbe seconded by Commissioner Simpson to accept the architect's recormendation and authorize the Mayor to sign the contracts with Western Construction, Lucas Plumbing and Heating, Electrical Equipment Company and Branns Warehouse for the construction of the Centennial Park Neighborhood Center. Ayes: (5). Nays: (0). Motion carried. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof." IZ77-2 filed by Sunset Plaza, Inc. for the rezoning of Lots I through 14, Block 1, Westbend Addition from "RS" to "R-2".] A motion was made by Commissioner Graves, seconded by Commissioner Weisgerber to adopt the ordinance as read and the following vote was had: Ayes: Graves, Simpson, Weisgerber, Geis, Duckers (5). Nays: (0). Carried. The Mayor approved the Ordinance and it is numbered 8613. The ordinance was introduced for first reading June 13, 1977• 32 A LETTER was received from the City Planning Commission recommending that the segment of Roach Street between Elmhurst Boulevard and Westchester Drive be changed to Westbend Avenue to correspond with the street name in Westbend Addition. A motion was made by Commissioner Geis, seconded by Commissioner Simpson to accept the recommendation of the City Planning Commission and to introduce an ordinance for first reading to change the name of Roach Street in Riverdale Addition to Westbend Avenue. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof." [Z77-19 filed by Development Consultants, Inc., for the rezoning of Lot 183, 5th Street, Original Townsite, from "R-3" to "C-3".] A motion was made by Commissioner Simpson, seconded by Commissioner Geis to adopt the ordinance as read and the following vote was had: Ayes: Graves, Simpson, Weisgerber, Geis, Duckers (5). Nays: (0). Carried. The Mayor approved the Ordinance and it is numbered 8614. The Ordinance was introduced for first reading December 12, 1977. A LETTER was received from the City Planning Commission recommending the approval of the final plat of Grain Belt Subdivision, as requested in Petition Number 3668 which was filed by D. L. Sampson. A motion was made by Commissioner Weisgerber, seconded by Commissioner Graves to accept the recommendation of the City Planning Commission and approve the final plat of Grain Belt Subdivision and to authorize the Mayor to sign. Ayes: (5). Nays: (0). Motion carried. A LETTER was received from the City Planning Commission granting a six month extension to the January 10, 1978 deadline for subdividing the property contained in Petition Number 3385 and Rezoning Ordinance Number 8536. The new and final deadline for completion of all aspects of platting of this property is now July 10, 1978. (Meadowlark Acres Addition Number 3) A motion was made by Commissioner Simpson, seconded by Commissioner Geis to receive the letter from the City Planning Commission. Ayes: (5). Nays: (0). Motion carried. A MOTION was made by Commissioner Simpson, seconded by Commissioner Geis to set the date of January 23, 1978 as the date to receive bids for 3 Police Department vehicles, and to instruct the City Clerk to advertise for bids. Ayes: (5). Nays: (0). Motion carried. A MOTION was made by Commissioner Geis, seconded by Commissioner Graves to introduce an ordinance for first reading defining the Ward and Precincts of the City of Salina, Kansas; amending Chapter 11 of the Salina Code, and repealing said original Chapter. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: THE CITY CLERK reported the assessment rolls are ready for the following improvements, to -wit: (Engineering Project 77-617) Curbing, guttering, paving and grading ESTATES DRIVE, from the north line of Lot 1, Block 1, to the south line of Lot 5, Block 1, Country Club Estates Addition Number 3. Curbing, guttering, paving and grading DEBORAH DRIVE from Estates Drive to the east line of Lot 5, Block 2, Country Club Estates Addition Number 3. Curbing, guttering, paving and grading DOUGLAS DRIVE from Deborah Drive to the north line of Lot 1, Block 3, Country Club Estates Addition Number 3. Motion carried. ; i PUBLIC AGENDA PETITION NUMBER 3674 was filed by Jimmie Dale Andrew, for the vacation of the South 5' of a 20' utility easement on Lot 12, Block 6, Georgetown Addition. A motion was made by Commissioner Simpson, seconded by Commissioner Geis to refer the petition to the City Engineer for a recommendation. Ayes: (5). Nays: (0). Motion carried. following: CEREAL MALT BEVERAGE License Applications for 1978 were filed by the Drive. Larry Abker, d/b/a Interstate House Service Station, 120 East Diamond Trey, Inc., d/b/a Sandpiper Club, 261 South Broadway. William J. Warhurst, d/b/a Will's Texaco, 407 West Diamond Drive. John F. Rasdall, Jr., d/b/a Broadway Plaza Texaco, 700 South Broadway. Ronald L. Cairns and Roberta S. Kaufman, d/b/a Westside Market, 1700 West Crawford. The City Clerk reported the applicants have paid the required fee and the license applications have been approved by the Health Department, Zoning Officer and the Police Department. A motion was made by Commissioner Simpson, seconded by Commissioner Graves to approve the license applications and to authorize the City Clerk to issue the licenses. Ayes: (5). Nays: (0). Motion carried. COMMISSION AGENDA The Mayor asked the Commission to recess into executive session to discuss the acquisition of land and appointments to boards and commissions. A motion was made by Commissioner Simpson, seconded by commissioner Weisgerber to recess into executive session. Ayes: (5). Nays: (0). Motion carried. The Commissioners recessed at 4:28 P.M. and reconvened at 6:28 P.M. 34 A MOTION was made by Commissioner Weisgerber, seconded by Commissioner l Geis to authorize the Mayor to sign a lease with the Salina Airport Authority for the use of the area located south of Bailey Road and west of Scanlan Avenue for adult baseball facilities. Ayes: (5). Nays: (0). Motion carried. A MOTION was made by Commissioner Graves, seconded by Commissioner Simpson that the Regular Meeting of the Board of Commissioners be adjourned. Ayes: (5).
