10-05-1981 Minutes306 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS OCTOBER 5, 1981 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, October 5, 1981, at four o'clock p.m. There were present: Acting Mayor Karen M. Graves, Chairman presiding Commissioner John F. Burgess Commissioner Charles B. Roth comprising a quorum of the Board, also present: Rufus L. Nye, City Manager Jacqueline Shiever, Acting City Clerk Absent: Mayor Merle A. Hodges Commissioner Keith G. Duckers D. L. Harrison, City Clerk L. 0. Bengtson, City Attorney None CITIZEN FORUM AWARDS AND PROCLAMATIONS (4.1) The Mayor proclaimed the week of October 4 through 10, 1981 - "FIRE PREVENTION WEEK". The proclamation was read by Fire Inspector Scott. (4.2) The Mayor proclaimed the week of October 10 through 17, 1981 - "PRISONE OF CONSCIENCE WEEK". The proclamation was read by Gerald Gillespie, Salina Group Leader of Amnesty International. (4.3) The Mayor proclaimed Saturday, October 10, 1981 - "KNIGHTS OF COLUMBUS TOOTSIE ROLL DAY". The proclamation was read by Bob Hinnenkamp, Past Grand Knight of the Knights of Columbus. (4.4) The Mayor proclaimed the Week of October 10 through 17, 1981 - "FREEDOM WEEK". None DEVELOPMENT BUSINESS ADMINISTRATION (8.1) First Reading Ordinance Number 81-8880 - levying special assessments against certain property to pay the cost of constructing certain sidewalks on Fairdale Road and Ray Avenue. (Engineering Project 81-683) 81-277 Moved by Commissioner Roth, seconded by Commissioner Burgess that Ordinance Number 81-8880, levying special assessments against certain property to pay the cost of constructing certain sidewalks on Fairdale Road and Ray Avenue, be introduced for first reading. Aye: (3). Nay: (0). Motion adopted. (8.2) Resolution Number 81-3564 - establishing certain charges for the operation of and sale of lots in the Gypsum Hill Cemetery, amending Resolution Number 80-3492 and repealing the existing resolution. 81-278 Moved by Commissioner Burgess, seconded by Commissioner Roth that Resolution Number 81-3564 be tabled until the City Manager, at his discretion, brings it back to the Commission with more information on current practices in other private and public cemeteries in Kansas. (8.3) First Reading Ordinance Number 81-8881 - providing that the Board of Commissioners shall establish, by Resolution, license fees, permit fees and user type fees. 81-279 Moved by Commissioner Roth, seconded by Commissioner Burgess that Ordinance Number 81-8881, providing that the Board of Commissioners shall establish, by Resolution, such license fees, permit fees and other user type fees or charges as will adequately compensate the City for its services rendered; providing for an annual review of the same by the City Manager; and repealing all existing fees in conflict with those established pursuant to this ordinance, be introduced for first reading, and that the license fees be rounded to the next even figure in the required resolution. (8.4) First Reading Ordinance Number 81-8882 - providing for the fees and charges regarding applications for amendments of the Zoning Ordinances or services to be rendered by the Planning Department in connection with the administration of the Zoning Ordinances of the City. 81-280 Moved by Commissioner Burgess, seconded by Commissioner Roth, that Ordinance Number 81-8882, providing for the fees and charges regarding application for amendments of the Zoning Ordinances or services to be rendered by the Planning Department in connection with the administration of the Zoning Ordinances of the City, be introduced for first reading. John Mize, Attorney objected to the variable fee structure, and thinks the fees should be a fixed rate. Staff members explained the proposed fee structure. Acting Mayor Graves called for a vote on Motion 81-280. Aye: (3). Nay: (0). Motion adopted. 308 (8.5) Authorize the City Manager to sign a contract with Planning Development Services, Inc. to perform a Historic Preservation Study for Salina. The item died for lack of a motion and second. Acting Mayor Graves asked staff to explain the study to the new commissioners. Keith Rawlings, City Planner, explained that the Commission authorized a contract in August, that the original company is unable to perform the study, so the other bidders were reconsidered. 81-281 Moved by Commissioner Burgess, seconded by Commissioner Roth that the City Manager be authorized to sign a contract with Planning Development Services, Inc. to perform a Historic Preservation Study for Salina. (8.6) Request by Salina Southeast Development Company for $3,000,000 Industrial Revenue Bonds. 81-282 Moved by Commissioner Roth, seconded by Commissioner Burgess that the Commission recess into executive session for 15 minutes to consider the possible issuance of Industrial Revenue Bonds. Aye: (3). Nay: (0). Motion adopted. The Commission recessed at 4:43 p.m. and reconvened at 5:00 p.m. 81-283 Moved by Commissioner Roth, seconded by Commissioner Burgess that the City Clerk be instructed to publish a notice of intention to issue $3,000,000 Industrial Revenue Bonds for Salina Southeast Development Company, setting Monday, October 19, 1981 at 4:00 p.m. for the public hearing.
