09-28-1981 Minutes302 Commission Action # CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS SEPTEMBER 28, 1981 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, September 28, 1981, at four o'clock p.m. There were present: Mayor Merle A. Hodges, Chairman presiding Commissioner John F. Burgess Commissioner Keith G. Duckers Commissioner Karen M. Graves Commissioner Charles B. Roth comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None CITIZEN FORUM None AWARDS - PROCLAMATIONS (4.1) The week of September 26, 1981 through October 4, 1981 - "I CARE WEEK". The proclamation was read by Nancy Roderick, President of the Citizens Coalition of Alcohol and Drug Abuse. None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME CONSENT (6.1) Approve the Minutes of the Regular Meeting September 21, 1981. (6.2) Request by Appleby and Marsh, Architects and Engineers, for a driveway variance at the northeast corner of the intersection of Marietta Avenue and Broadway. (6.3) Cereal Malt Beverage license application filed by Maryann Bray Bird, d/b/a Bargain Barn, 301 North 9th Street (New application). 81-26711 Moved by Commissioner Burgess, seconded by Commissioner Roth that all items on the Consent Agenda be approved. DEVELOPMENT BUSINESS None 303 ADMINISTRATION (8.1) Second Reading Ordinance Number 81-8878 - authorizing the issuance of $400,000 Industrial Revenue Bonds for Morrison Grain Company, Inc. 81-268 Moved by Commissioner Roth, seconded by Commissioner Graves, that Ordinance Number 81-8878, an ordinance authorizing the City of Salina, Kansas, to purchase and acquire certain real estate located within three miles of the corporate limits of the City and to construct on said real estate and adjoining leasehold interests certain railroad track sidings, tracks, ties, switches, grading and related improvements, for the enlargement and improvement of grain storage and handling warehouses, including the acquisition of the site (consisting of certain real estate and leasehold interests), necessary site preparation, structures, easements, rights-of-way and appurtenances necessary and convenient for the acquisition and construction thereof, to be leased to Morrison Grain Company, Inc., of Salina, Kansas; authorizing and directing the issuance of $400,000.00 principal amount of Salina, Kansas, Morrison Grain Company, Inc. Revenue Bonds of 1981 of said city for the purpose of providing funds for the purchase, acquisition, construction, enlargement and improvement of said property and the improvements constructed and to be constructed thereon, to be used for agricultural and commercial facilities to be leased to Morrison Grain Company, Inc.; and prescribing the form and authorizing the execution of a lease between the City and Morrison Grain Company, Inc., be adopted. (8.3) Request by Steve Shogren, President of United Securities, Inc. that the City Commission adopt a Bond Purchase, Cooperation Agreements, resolution authorizing the Mayor to sign other such agreements, and to introduce the bond ordinance authorizing Single Family Mortgage Revenue Bonds, for first reading. 81-270 Moved by Commissioner Duckers, seconded by Commissioner Roth that Resolution Number 81-8864, authorizing and approving the forms of certain document and agreements to be executed and delivered for and on behalf of the City of Salina in connection with implementation jointly and in cooperation with Seward County, Kansas, of a single family mortgage loan program and issuance of Seward County Kansas and City of Salina, Kansas Single Family Mortgage Revenue Bonds (Multiple originators and servicers) 1981 Series A, in the aggregate principal amount of $60,000,000, be adopted. Aye: (5). Nay: (0). Motion adopted. 81-271 Moved by Commissioner Graves, seconded by Commissioner Burgess that Ordinance Number 81-8879, an ordinance authorizing and providing for the implementation of a single family mortgage loan program; authorizing the execution and delivery of an indenture of trust, dated as of October 1, 1981, by and between Seward County, Kansas and the City of Salina, Kansas, jointly as issuer and continental Illinois National Bank and Trust Company of Chicago, as trustee; authorizing the issuance, authentication and delivery of Seward County, Kansas and City of Salina, Kansas, Single Family Mortgage Revenue Bonds (multiple originators and servicers) 1981 Series A, in the aggregate principal amount of $60,000,000; and authorizing the officers and employees of the city to execute certain agreements and other documents and instruments necessary or desirable to provide for implementation of said single family mortgage loan program and the issuance and delivery of said 1981 series A Bonds, be introduced for first reading Aye: (5). (8.2) Request by the Salina Area Chamber of Commerce that the City remove the 2 hour and shorter term parking meters on the streets and allow 2 hour "free parking" to be effective November 27, 1981. Flavel Simcox, President of the Salina Area Chamber of Commerce, requested the removal of all two hour and shorter term on -street parking meters to be effective November 27, 1981. Bernard Jilka, President of the Greater Downtown Salina Association, showed the Commission a repainted parking meter set on an oak block, which could be auctioned off for $25 to $100 each. Nancy Roderick, supported the downtown merchants. 81-269 Moved by Commissioner Graves, seconded by Commissioner Ducker$ that the request of the Salina Area Chamber of Commerce be tabled until October 19, 1981. Harrison, City Clerk 1 F� WAIVER AND CONSENT TO HOLD A SPECIAL MEETING OF THE BOARD OF COMMISSIONERS We, the undersigned, being the duly elected, qualified and acting Commissioners of the City of Salina, Kansas, and constituting a majority of the Board of Commissioners of the City of Salina, Kansas, do hereby waive notice and consent to the holding of a special meeting of the Board of Commissioners on the 29th day of September, 1981, at 8:00 A.M. for the purpose of adopting Ordinance Number 81-8879 and authorizing the Mayor to sign an application for exemption pursuant to Section 359-f(2) of the General Business Law of the State of New York from the Provisions of Sections 352-e, 352-f and 352-h of said General Business Law.
