The Regular Meeting of the Board of Commissioners met in the Commission Meeting
Room, City -County Building, on Monday, September 21, 1981, at four o'clock p.m.
There were present:
Mayor Merle A. Hodges, Chairman presiding

CITIZEN FORUM
Donna Godsey, 420 Venus, asked the Commission what Mr. Warmack is going
to do about the drainage for South Salina if he gets to build the mall?
AWARDS - PROCLAMATIONS
(4.1) The Mayor proclaimed the Week of September 27 through October 3, 1981 -
"AMATEUR RADIO WEEK". The proclamation was sponsored by the Central Kansas
Amateur Radio Club, but no one was present to read the proclamation.
(4.2) The Mayor proclaimed Wednesday, September 23, 1981 - "NATIONAL R.S.V.P.
DAY". The proclamation was read by Clara Carlson, RSVP Volunteer.
(4.3) The Mayor proclaimed September 19 through 27, 1981 - "ARTS BLITZ'. The
proclamation was read by renowned humorist and lecturer, Mark Twain.

DEVELOPMENT BUSINESS

ADMINISTRATION
(8.1) Request by the Salina Area Chamber of Commerce, the Homebuilders'
4ssociation of Salina, and the Salina Board of Realtors, that the City Commission
repeal Resolution 3113 and 3119 regarding the installation of general improvements
in undeveloped properties within the City. [Tabled for one week at the August 17,
1981 meeting, tabled two weeks at the August 24, 1981 meeting, tabled one week at
the September 14, 1981 meeting.]

the item be removed from the table for consideration. Aye: (4). Nay: (0).

81-258 Moved by Commissioner Burgess, seconded by Commissioner Graves, that
Resolution Number 81-3558, repealing Resolutions 3113 and 3119 pertaining to the
policy of the Board of Commissioners regarding the installation of general
improvements in undeveloped property within the City, be adopted and that staff
be instructed to prepare guidelines to include the requirement that all taxes be
current on all property owned by the petitioner. Aye: (4). Nay: (0). Motion
adopted.
Flavel Simcox, President of the Salina Area Chamber of Commerce thanked
the City Commission for its action.
(8.2) Resolution Number 81-3562 relating to benefits obtainable by cities
under the program for federal aid on highway construction. (Authorizes the Mayor
and City Clerk to execute Supplement No. 1 to agreement 72-80 between the City
and the Kansas Department of Transportation concerning the bike path program.)

Resolution Number 81-3562, relating to benefits obtainable by cities under the

(8.3) Second Reading Ordinance Number 81-8869, providing for the rezoning of
Lots 175, 177, 179 and 181 on 5th Street and Lots 180, 182 and 184 on 4th Street,
Original Townsite to District "C-4", requested in Z81-11, filed by the Salina
Journal.

Ordinance Number 81-8869, providing for the amendment of Ordinance Number 8526,
the same being Chapter 36 of the Salina Code, and the Zoning District Map therein
and thereby adopted and providing for the rezoning of certain property within the
City and prescribing the proper uses thereof, be adopted. Aye: Burgess, Graves,
Roth, Hodges (4). Nay: (0). Motion adopted.
(8.4) Second Reading Ordinance Number 81-8876, ordering the condemnation and
appropriation of certain land in Saline County, Kansas, for construction of a
fire station in Key Acres Addition.

Ordinance Number 81-8876, ordering the condemnation and appropriation of certain
land in Saline County, Kansas, for construction of a fire station, all as
authorized by K.S.A. 13-1023, and amendments thereto, and pursuant to the Eminent
Domain Procedure Act, K.S.A. Chapter 26, and amendments thereto, as the same
relates to condemnation by cities and further pursuant to Resolution Number 81-
3560, of the City of Salina, Kansas, be adopted. Aye: Burgess, Graves, Roth,
Hodges (4). Nay: (0). Commissioner Duckers absent. Motion adopted.
(8.5) Second Reading Ordinance Number 81-8877, providing for the rezoning of
Lot 1, Block 1, Frisbie Acres Addition to "P.D.D", requested in PDD 81-3, filed
by Robert Frisbie,

Ordinance Number 81-8877, providing for the amendment of Ordinance Number 8526,
the same being Chapter 36 of the Salina Code and the Zoning District Map therein
and thereby adopted and providing for the proper uses thereof. Aye: Burgess,

(8.6) Resolution Number 81-3563, establishing an Emergency Preparedness
Organization between the City of Salina, Kansas, and the County of Saline,
Kansas. [Adding the definition of hazardous material to the present resolution)

Resolution Number 81-3563, establishing an Emergency Preparedness Organization
between the City of Salina, Kansas, and the County of Saline, Kansas; establishing
a Salina -Saline County Emergency Preparedness Board, providing for the manner of
appointment thereof and defining the powers and duties of said board; creating
the position of coordinator of the Salina -Saline Emergency Preparedness Department
and defining the duties thereof; providing for the Emergency Preparedness Board
budget and expenditures; and repealing the provisions of Resolution Number 3245,
be adopted. Aye: Burgess, Graves, Roth, Hodges (4). Nay: (0). Motion adopted.
(8.7) First Reading Ordinance Number 81-8878, authorizing the issuance of
$400,000 Industrial Revenue Bonds for Morrison Grain Company, Inc.
81-265 Moved by Commissioner Graves, seconded by Commissioner Burgess that
Ordinance Number 81-8878, authorizing the City of Salina, Kansas, to purchase and
acquire certain real estate located within three miles of the corporate limits of
the City and to construct on said real estate and adjoining leasehold interests,
certain railroad track sidings, tracks, ties, switches, grading and related
improvements, for the enlargement and improvement of grain storage and handling
warehouses, including the acquisition of the site (consisting of certain real
estate and leasehold interests), necessary site preparation, structures, easements
rights-of-way and appurtenances necessary and convenient for the acquisition and
construction thereof, to be leased to Morrison Grain Company, Inc., of Salina,
Kansas; authorizing and directing the issuance of $400,000 principal amount of
Salina, Kansas, Morrison Grain Company, Inc. Revenue Bonds of 1981 of said City
for the purpose of providing funds for the purchase, acquisition, construction,
enlargement and improvement of said property and the improvements constructed and
to be constructed thereon, to be used for agricultural and commercial facilities
to be leased to Morrison Grain Company, Inc.; and prescribing the form and
authorizing the execution of a lease between the City and Morrison Grain Company,
Inc., be introduced for first reading. Aye: (4). Nay: (0). Motion adopted.
