The Regular Meeting of the Board of Commissioners met in the Commission Meeting
Room, City -County Building, on Monday, August 24, 1981, at four o'clock p.m.
There were present:

CITIZEN FORUM
AWARDS - PROCLAMATIONS
(4.1) Resolution Number 81-3559, expressing gratitude and appreciation to
William George Kauer for serving as an employee of the City of Salina Flood Works
Department from May 1, 1963 to August 31, 1981.
(4.2) The Mayor proclaimed the Week of September 1 through 7, 1981 - "NATIONAL
BOWLING WEEK". The proclamation was read by Paula Fitzpatrick, President of
Salina Women's Bowling Association.

PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
CONSENT AGENDA
(6.1) Approve the Minutes of the Regular Meeting August 17, 1981.
(6.2) City Engineer files plans and specifications for Engineering Project
81-684, for street and storm sewer improvements on West Diamond Drive. (Set
September 10, 1981 to receive bids).
(6.3) Cereal Malt Beverage license application filed by ShowBiz Pizza Place,
Inc., d/b/a ShowBiz Pizza Place, 2559 Market Place, Michael Lee Gore, Manager.
(New application)
(6.4) Authorize the City Manager to sign a project agreement between the
Kansas State Historical Society and the City of Salina and a contract between the
City of Salina and Restoration Associates of Kansas City, Missouri.
(6.5) Resolution Number 81-3560, determining it necessary to appropriate
private property for the use of the City of Salina, Kansas, for the purpose of
constructing a fire station in south Salina and authorizing and directing the
City Engineer to make a survey and description of the land necessary for such
purposes.

(7.1) Recommendation from the City Planning Commission that Zoning Application
81-16, filed by the City Planning Commission to amend Section 36-402 of the
Salina Code to allow wind energy conversion systems (wind generators) as a
permitted accessory use in all zoning districts with certain restrictions.
81-229 Moved by Commissioner Duckers, seconded by Commissioner Graves that the
recommendation of the City Planning Commission be approved and that Ordinance
Number 81-8874, allowing wind energy conversion systems (wind generators) as a
permitted accessory use in all zoning districts under certain restrictions,
amending Section 36-402(l) of the Salina Code and repealing the existing section,

Ordinance Number 81-8875, defining a wind energy conversion system; amending

ADMINISTRATION
(8.1) Second Reading Ordinance Number 81-8868 - providing for the amendment
of Zoning Ordinance 8526, to rezone the East 150 feet of Lot 10, Block 10, Riker
Addition to the City of Salina, Kansas. [Zoning Application 81-11, filed by
Robert Smalley.]
(8.1a) Petition Number 3818 was filed by Property owners within 200 feet of
the property proposed to be rezoned, protesting the rezoning.

action on Ordinance Number 81-8868 be postponed until September 14, 1981. Aye:

(8.2) Second Reading Ordinance Number 81-8870 - amending Section 401(x)2 of
the Uniform Plumbing Code, enacting Section 9-205.3 of the Salina Code.

(8.3) Second Reading Ordinance Number 81-8871 - amending Section 503(a)2 of
the Uniform Plumbing Code, enacting Section 9-205.4 of the Salina Code.

(8.4) Second Reading Ordinance Number 81-8872 - providing for the amendment
of Zoning Ordinance 8526, to rezone Lots 13 and 15, Block 5, Hutchinson Addition
to the City of Salina, Kansas. [P.D.D. 81-2, filed by Roger and Charlotte Savage.
81-234 Moved by Commissioner Roth, seconded by Commissioner Graves that
Ordinance Number 81-8872, providing for the amendment of Ordinance Number 8526,
the same being Chapter 36 of the Salina Code, and the Zoning District Map therein
and thereby adopted and providing for the rezoning of certain property within the
city and prescribing the proper uses thereof, be adopted. Aye: Duckers, Graves,
Roth, Hodges (4). Nay: (0). Commissioner Burgess absent. Motion adopted.
(8.5) Second Reading Ordinance Number 81-8873 - regulating noise from motor
vehicles in the City of Salina, Kansas.
81-235 Moved by Commissioner Graves, seconded by Commissioner Duckers that
Ordinance Number 81-8873, regulating noise from motor vehicles in the City of
Salina, Kansas, enacting Sections 22-123 to 22-131.1 of the Salina Code, be
adopted. Aye: Duckers, Graves, Roth, Hodges (4). Nay: (0). Commissioner
Burgess absent. Motion adopted.

(8.6) Request from the Salina Area Chamber of Commerce, the Homebuilders'
Association of Salina, and the Salina Board of Realtors, that the City Commission
repeal Resolutions 3113 and 3119 regarding the installation of general
improvements in undeveloped properties within the City. [Tabled for one week at
the August 17, 1981 meeting.]

consideration of the request be tabled until September 14, 1981. Aye: (4). Nay:

(8.7) Request from United Securities, Inc. to discuss development of a Single
Family Mortgage Bond issue for the City of Salina.
Steve Shogren, United Securities, Inc., wants permission to issue 75 to
80 million dollars in Single Family Mortgage Bonds. This would be a combined
issue marketed as Seward County - City of Salina. The City of Salina has an
allocation of 50 million and Seward County has an allocation of 30 million,
which expires December 31, 1981 and the local lendors have indicated they want
approximately 10 million for loans. Sedgwick County wants the balance of the
City of Salina and Seward County allocation.
The Commission gave tentative approval to the bond issue which the City
Attorney is to check the legitimacy of this type of issue for the City of Salina.
(8.8) Request for $250,000 Industrial Revenue Bonds, filed by Wilbur
Construction Company.

Commission recess into executive session to discuss the possible issuance of
Industrial Revenue Bonds, for not to exceed 20 minutes. Aye: (4). Nay: (0).
Motion adopted.
The Commission recessed at 4:32 p.m. and reconvened at 4:39 p.m.
81-239 Moved by Commissioner Graves, seconded by Commissioner Duckers that
the City Clerk be instructed to publish a notice of intention to issue $250,000
Industrial Revenue Bonds for Roy M. and Virginia S. Wilbur, setting September 14,
1981 at 4:00 p.m. for public hearing. Aye: (4). Nay: (0). Motion adopted.
81-240 Moved by Commissioner Roth, seconded by Commissioner Graves that the
Regular Meeting of the Board of Commissioners be adjourned. Aye: (4). Nay: (0).
Motion adopted. The meeting adjourned at 4:40 p.m.
