The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, July 20, 1981, at four o'clock p.m. There were present: Mayor Merle A. Hodges, Chairman presiding Commissioner John F. Burgess Commissioner Keith G. Duckers Commissioner Karen M. Graves Commissioner Charles B. Roth comprising a quorum of the Board, also present: D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: L. 0. Bengtson, City Attorney CITIZEN FORUM Steven Brubaker thanked Mayor Hodges for presenting Kenny Rogers with a plaque. He said this is a good idea. AWARDS - PROCLAMATIONS None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing on the possible issuance of $400,000 Industrial Revenue Bonds for Morrison Grain Company, Inc. There were no protests, written or oral, filed and the Mayor declared the public hearing closed. 81-183 Moved by Commissioner Graves, seconded by Commissioner Burgess that Resolution Number 81-3552, a resolution of intent to issue $400,000 Industrial Revenue Bonds for Morrison Grain Company, Inc., be adopted. Aye: (5). Nay: (0). Motion adopted. CONSENT (6.1) Approve the Minutes of the Regular Meeting July 13, 1981. (6.2) Petition Number 3814, filed by Dean Watthers for the vacation of the North 20 feet of Grand Avenue, adjacent to Lots 21, 22, 23, 24, 25, Block 9, Pacific Addition. (6.3) Cereal Malt Beverage license application filed by George C. Etherington, d/b/a Mr. G's Market, 1605 Schilling (toad. (New application). (6.4) Resolution Number 81-3553, determining the advisability of water main improvements, estimating the cost thereof, defining the boundaries of the improvem nt district, method of assessment, and apportioning the cost between the improvement district and the City -at -large. [Water main on Coronado Street.] (6.5) Petition Number 3815, filed by Lee 0. Haworth, for the vacation of Post Oak Lane lying east of Carolina Drive; the vacation of Redbud Court; the vacation of certain utility easements in Blocks 3 and 8, Twin Oaks 11 Subdivision. 278 (6.6) City Engineer files plans and specifications for slurry seal improvement (Engineering Project 81-680). Motion adopted DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Zoning Application 81-11, filed by Robert Smalley, for the rezoning of part of Lot 10, Replat of the East Half of Block 10, Riker Addition from District "R -l" (Single-family Residenti 1) to District "C-1" (Restricted Business District) be denied. A letter from the applicant's attorney, requested the application be referred back to the Planning Commission for its reconsideration. 81-185 Moved by Commissioner Duckers, seconded by Commissioner Burgess that Zoning Application 81-I1 be referred back to the City Planning Commission for its reconsideration, at the request of the applicant's attorney. Aye: (4). Nay: (0). Commissioner Graves abstained. Motion adopted. (7.2) Recommendation from the City Planning Commission that Zoning Application 81-12, filed by Development Consultants, Inc., for the rezoning of Lot 5, Block 3; the East 64' of Lot 2 and Lot 7 less the West 1 foot; and all of Lots 3, 4, 5, and 6, Block 4, Countryside Addition from District "R-1" (Single-family residentia ) to "11-2.5" (Multiple -family residential), be denied. 81-186 Moved by Commissioner Graves, seconded by Commissioner Roth, that the recommendation of the City Planning Commission be accepted and that Zoning Application 81-12 be denied. Aye: (5). Nay: (0). Motion adopted. ADMINISTRATION (8.1) Recommendation from the City Planning Commission that Ordinance Number 81-8860, providing for the rezoning of Wallerius Addition Number Two, from Distric "A-1" (Agricultural District) to "C-5" (Service Commercial District), requested in Zoning Application 79-10, filed by Patrick Wallerius, be introduced for second reading. [Ordinance was introduced for first reading on April 30, 1979.1 81-187 Moved by Commissioner Duckers, seconded by Commissioner Roth that Ordinance Number 81-8860, providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be adopted. Aye: Burgess, Duckers, Graves, Roth, Hodges (5). Nay: (0). Motion adopted. (8.2) City Engineer reports on Petition Number 3812, filed by residents of Salina for 4 -way stop signs at Marymount Road and Iron Avenue. The City Engineer recommended that Petition Number 3812, be denied on the basis of data obtained from the traffic study of this intersection. Frank Norton, and others who reside in the area, said there is a need for 4 -way stop signs to slow the traffic entering the Country Club area. Speeding is a problem coming into the Country Club area and has caused several accidents. G. N. Waddell, 106 Overhill, said he has seen many serious accidents in this area, and there is a great need for 4 -way stop signs at this intersection. 81-188 Moved by Commissioner Duckers, seconded by Commissioner Burgess, that the recommendation of staff be denied, and that Petition Number 3812 be approved, and that staff be directed to erect 4 -way stop signs at Marymount Road and Iron Avenue. 81-189 Moved by Commissioner Roth, seconded by Commissioner Duckers that action on Petition Number 3812 be tabled for one week. Aye: (5). Nay: (0). Motion adopted. (8.3) Presentation of the Proposed 1982 Budget, including Revenue Sharing, and set the date of August 3, 1981 at 4:00 P.M. for a public hearing. [Postponed for one week at the July 13, 1981 meeting.] 81-190 Moved by Commissioner Roth, seconded by Commissioner Graves that the Proposed 1982 Budget, as amended by City Manager's Memorandum 81-6, dated July 17, 1981, be approved for publication, and that the date of August 3, 1981, be set for a public hearing. Aye: (5). Nay: (0). Motion adopted. OTHER BUSINESS 81-191 Moved by Commissioner Burgess, seconded by Commissioner Duckers to recess into Executive Session for not to exceed 2 hours, to discuss a personnel matter. Aye: (5). Nay: (0). Motion adopted. The Commission recessed at 4:30 P.M. and reconvened at 5:45 P.M. 81-192 Moved by Commissioner Duckers, seconded by Commissioner Graves, that the Regular Meeting of the Board of Commissioners be adjourned.
