APRIL 6, 1981
4:00 P.M.
The Regular Meeting of the Board of Commissioners met in the Commission Meeting
Room, City -County Building, on Monday, April 6, 1981, at four o'clock p.m.
comprising a quorum of the Board, also present:
L. 0. Bengtson, City Attorney
D. L. Harrison, City Clerk
Rufus L. Nye, City Manager

CITIZEN FORUM
Virgil Lundberg, owner of the building at 5th and Iron and just west of
the building which burned a couple of weeks ago, said the city has barricaded the
sidewalk and the alley, but he needs access to the east wall of his building. He
said the owner of the burned property will not give him right of entry as yet. He
said he knows the city has given 60 days notice to demolish the building, but
this is too long. He said some cities do it in three days when there is a
dangerous structure. He was told the city is doing all it can under the law.
Annette Townsend asked when the Neighborhood Center fees would be on
the agenda again.
81-75 Moved by Commissioner Duckers, seconded by Commissioner Hodges that the
Neighborhood Centers fees be considered under Other Business on today's agenda.
Aye: (5). Nay: (0). Motion adopted.
AWARDS - PROCLAMATIONS
(4.1) The Mayor presented a plaque of appreciation to past Salina Arts
Commission member Barbara Jarvis.
(4.2) The Mayor proclaimed Saturday, April 11, 1981 - "EDUCATIONAL AWARENESS
DAY". The proclamation was read by Juanita Faelber, Past President of NEA -Salina
and Convention Coordinator.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
(5.1) Public Hearing required by Resolution Number 81-3530 for the annexation
of Marymount Tract #1, Annexation Application 81-1.
There were no protests, written or oral, filed.
The Mayor declared the public hearing closed.
81-76 Moved by Commissioner Duckers, seconded by Commissioner Hodges that
Marymount Tract #1 be annexed in accordance with the Service Extension Plan
approved February 2, 1981 and on file with the City Clerk and that Ordinance
Number 81-8844, annexing certain land to the City of Salina, Kansas, in conformity
with the provisions of K.S.A. 12-519 to 12-526, inclusive, be introduced for
first reading. Aye: (5). Nay: (0). Motion adopted.

Marymount Tract #2 be annexed in accordance with the Service Extension Plan

Number 81-8845, annexing certain land to the City of Salina, Kansas, in
conformity with the provisions of K.S.A. 12-519 to 12-526, inclusive, be

CONSENT
(6.1) Approve the Minutes of the Regular Meeting March 23, 1981.
(6.2) Authorize the Mayor to sign an agreement with the Central Kansas
Foundation for Alcohol and Chemical Dependency, Inc., for services during 1981,
as recommended by the Alcohol Fund Advisory Committee.
(6.3) Report from the City Engineer on Petition Number 3805, filed by Dale
Goter for the removal of the stop sign on the east side of South Fourth Street
just south of the intersection of South Fourth and South Street.

DEVELOPMENT BUSINESS

ADMINISTRATION
(8.1) Second Reading Ordinance Number 81-8843 - providing for the vacation of
a portion of Scanlan Avenue between Schilling Road and Jumper Road in the
Schilling Subdivision to the City of Salina, Saline County, Kansas.
81-79 Moved by Commissioner Duckers, seconded by Commissioner Weisgerber that
Ordinance Number 81-8843, providing for the vacation of a portion of Scanlan
Avenue between Schilling Road and Jumper Road in the Schilling Subdivision to the
City of Salina, Saline County, Kansas, be adopted. Aye: Duckers, Hodges,
Weisgerber (3). Nay: Graves, Geis (2). Motion adopted.
(8.2) Consider a parking ban in the recessed area in front of Sears Center.
(Postponed until April 6, 1981 at the March 16, 1981 meeting.
The Police Department recommendation was to take no action at this
time.
81-80 Moved by Commissioner Duckers, seconded by Commissioner Hodges that the
recommendation of the Police Chief be accepted and the proposed parking ban in
front of Sears Center be tabled indefinitely. Aye: (5). Nay: (0). Motion
adopted.
(8.3) Report from the City Engineer on Petition Number 3806, filed by Mrs.
Carolyn Lundgrin, Safety Chairman of Meadowlark Ridge School, for the installation
of a curb sidewalk on the west side of Fairdale Road from Crawford Avenue to
Brookwood Lane and from Northwood Lane to Overhill Road.
Elly Drown, 156 Seitz Drive, opposes the construction of sidewalk on
vacant lots.
Phil Herzig, 2243 Edgehill Drive, said stop signs are needed at some
intersections. He suggested sidewalks on each side of the street.
Carolyn Lundgrin, 2330 Edgehill, Safety Chairman of the Meadowlark
Ridge School, and Dan Bratton, 2218 Melrose Lane, said sidewalks are needed for
the safety of the children.
81-81 1 Moved by Commissioner Graves, seconded by Commissioner Hodges that
Petition Number 3806 be approved and the construction of the sidewalk be
authorized. Aye: (5). Nay: (0). Motion adopted.
OTHER BUSINESS
(9.1) Consider a recommendation for the Citizen's Advisory Committee concerni
the recent Neighborhood Center fee controversy.
81-82II Moved by Commissioner Duckers, seconded by Commissioner Weisgerber that
the recommendation of the Citizens' Advisory Committee be rejected.
Annette Townsend, 360 North Columbia, said all recreation facilities
were free a year or so ago, but now that the Recreation Commission took over the
centers they want a fee.
Dean Boone, 430 West Crawford, Chairman of the CAC sub -committee stated
the sub -committee didn't feel the Recreation Commission needed the $5.00 per hour
fee from a budget standpoint. We could never identify a need based on monetary
support of those facilities.
Bonita Pedersen, 369 North Columbia, feels the City is discriminating
against some individuals who might want to use the centers and have to pay a fee.
John Dennis, 1106 Oak Circle, said the City does not charge a user fee
for all the facilities now being used by the people.
Phil Weaver, 936 South 5th, Chairman of the Citizens Advisory Committee
referred to Petition Number 3804 which was filed with signatures of more than a
thousand people who think the centers should be free.
Charles Roth, 201 West Wilson, suggested a charge be levied only for
reservations. If the centers are vacant when someone wanted to use them, they
would be free.
Vi Justus, President of the League of Women Voters, supports the
Recreation Commission's present fee structure.
81-83 Moved by Mayor Geis, seconded by Commissioner Weisgerber, that the
motion on the floor be amended to provide that the Neighborhood Center fee
schedule be amended to provide that a daily fee not to exceed $20.00, except
for commercial activities for which there shall be no limit on a per diem basis.
Aye: (5). Nay: (0). Motion adopted.
The Mayor called for a vote on Commission Action #81-82. Aye: Duckers,
Graves, Hodges, Weisgerber (4). Nay: Geis (_1). Motion adopted.
The Mayor, with the approval of the City Commission made the following
appointments:
