02-09-1981 Minutes227 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS FEBRUARY 9, 1981 4:00 P.M. The Regular Meeting of the Board of Commissioners met in the City Commission Meeting Room, City -County Building, on Monday, February 9, 1981, at four o'clock p.m. There were present: Mayor Dan S. Geis, Chairman presiding Commissioner Keith G. Duckers Commissioner Karen M. Graves Commissioner Merle A. Hodges Commissioner Jack Weisgerber comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None CITIZEN FORUM Mrs. Patricia Fiedler, 1816 Roberts, complained about the sewer backing up into their basement. She and others on Roberts Street want the city to keep their line clean, if it means cleaning it every day. AWARDS - PROCLAMATIONS (4.1) The Mayor presented plaques of appreciation to past members of the Trustees of the Municipal Band: Glen Van Cleef, Dr. Robert Cooper, and Allen Webber. (4.2) The Mayor proclaimed the week of February 22 - 28, 1981 - "ENGINEERS WEEK". The proclamation was read by Maurice Bowersox, President of the Smoky Valley Chapter of the Kansas Engineering Society. (4.3) The Mayor proclaimed the week of February 8 - 14, 1981 - "LIFE UNDERWRITERS' WEEK". The proclamation was read by Doug Ramsey. (4.4) The Mayor proclaimed Sunday, February 15, 1981 - "NATIONAL JUNIOR CATHOLIC DAUGHTERS OF THE AMERICAS DAY". The proclamation was read by Ruth Brouddus. (4.5) The Mayor proclaimed the Week of February 10 - 16, 1981 - "BLACK HISTORY WEEK". The proclamation was read by Maryland Parker. (4.6) The Mayor proclaimed the Week of February 8 - 14, 1981 - "UNITED STATES JAYCETTE WEEK". The proclamation was read by Carol Bourbina, President of the Salina Jaycee Jaynes. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None 228 CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting February 2, 1981. (6.2) Set the date of February 26, 1981 to receive bids on portable refuse containers and hydraulic lifting and dumping mechanisms. (6.3) Set the date of February 26, 1981 to receive bids on two custom fire trucks. (6.4) Resolution Number 81-3534 - authorizing and ordering certain water and sewer improvements, ordering preparation of plans and specifications, and the estimate of costs. (Mayfair Addition - Engineering Project 81-674) (6.5) Set the date of March 5, 1981 to receive bids for the irrigation system at the Bicentennial Center. (6.6) Petition Number 3803 - filed by Linda Baalman and Gene R. Engberg, for the vacation of the utility easement on the north side of Lot 19, Block 7, Replat of Edgemere Addition. (6.7) Cereal malt beverage license application filed by Clayton L. Terry, d/b/a Terry's Service Center, 313 West Ash. (New application). (6.8) Tree trimming and treating license application filed by Paul Handlin and Fred Handlin, d/b/a Handlin & Son Tree Service, 832 North 7th Street. 81-38 Moved by Commissioner Hodges, seconded by Commissioner Duckers that all items on the consent agenda be approved. DEVELOPMENT BUSINESS None ADMINISTRATION (8.1) Second Reading Ordinance Number 81-8836 - providing that the Board of Commissioners shall, by resolution, periodically determine the rates, fees and charges for the use and services rendered by the combined Water and Sewerage Department; amending Sections 35-54, 35-55, and 35-58 of the Salina Code and repealing the existing sections. 81-39 Moved by Commissioner Hodges, seconded by Commissioner Graves that Ordinance Number 81-8836, providing that the Board of Commissioners shall, by resolution, periodically determine the rates, fees and charges for the use and services rendered by the combined Water and Sewerage Department; amending Sections 35-54, 35-55, and 35-58 of the Salina Code and repealing the existing sections, be adopted. (8.2) City Clerk reported on bids received for $900,000 General Obligation Bonds, Series S-226; $280,000 General Obligation Bonds, Series F-227; and $836,000 Internal Improvement Bonds, Series P-228, received at 2:00 P.M. 81-40 Moved by Commissioner Graves, seconded by Commissioner Duckers that the City Clerk's recommendation be accepted and the contracts be awarded to Stern Brothers & Company, for a total interest cost to the of $697,837.50. (8.3) First Reading Ordinance Number 81-8837, authorizing and directing the issuance, sale and delivery of $900,000 principal amount of General Obligation Bonds, Series S-226, of the City of Salina, Kansas, for the purpose of providing funds to pay the cost of purchasing refuse containers, purchasing landfill scales and excavating landfill pits; prescribing the form and details of said bonds; and providing for the levy and collection of the necessary taxes for the purpose of paying the principal of and interest on said bonds as the same become due. 22J 81-41 Moved by Commissioner Duckers, seconded by Commissioner Hodges that Ordinance Number 81-8837, authorizing and directing the issuance, sale and deliver of $900,000 principal amount of General Obligation Bonds, Series S-226, of the City of Salina, Kansas, for the purpose of providing funds to pay the cost of purchasing refuse containers, purchasing landfill scales and excavating landfill pits; prescribing the form and details of said bonds; and providing for the levy and collection of the necessary taxes for the purpose of paying the principal of and interest on said bonds as the same become due, be introduced for first reading. (8.4) First Reading Ordinance Number 81-8838, authorizing and directing the issuance, sale and delivery of $280,000 principal amount of General Obligation Bonds, Series F-227, of the City of Salina, Kansas, for the purpose of providing funds to pay the cost of purchasing two 1,500 GPM custom fire trucks to be used by the City of Salina Fire Department; prescribing the form and details of said bonds; and providing for the levy and collection of the necessary taxes for the purpose of paying the principal of and interest on said bonds as the same become due. 81-42 Moved by Commissioner Duckers, seconded by Commissioner Weisgerber that Ordinance Number 81-8838, authorizing and directing the issuance, sale and delivery of $280,000 principal amount of General Obligation Bonds, Series F-227, of the City of Salina, Kansas, for the purpose of providing funds to pay the cost of purchasing two 1,500 GPM custom fire trucks to be used by the City of Salina Fire Department; prescribing the form and details of said bonds; and providing for the levy and collection of the necessary taxes for the purpose of paying the principal of and interest on said bonds as the same become due, be introduced for first reading. (8.5) First Reading Ordinance Number 81-8839, authorizing and directing the issuance, sale and delivery of $836,000 principal amount of Internal Improvement Bonds, Series 1-228, of the City of Salina, Kansas, for the purpose of providing funds to pay the cost of construction of storm sewers, water mains, sanitary sewers and street improvements; prescribing the form and details of said bonds; and providing for the levy and collection of the necessary assessments and taxes for the purpose of paying the principal of and interest on said bonds as the same become due. 81-43 Moved by Commissioner Hodges, seconded by Commissioner Duckers that Ordinance Number 81-8839, authorizing and directing the issuance, sale and delivery of $836,000 principal amount of Internal Improvement Bonds, Series P-228, of the City of Salina, Kansas, for the purpose of providing funds to pay the cost of construction of storm sewers, water mains, sanitary sewers, and street improvements; prescribing the form and details of said bonds; and providing for the levy and collection of the necessary assessments and taxes for the purpose of paying the principal of and interest on said bonds as the same become due, be introduced for first reading. (8.6) Second Reading Ordinance Number 81-8834 - providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, (Northeast corner of Ohio and Claflin, requested in Zoning Application 80-14) The Commissioners asked John Mize, attorney for the applicant, why they were requesting the rezoning ordinance to be adopted before the area is platted. Mr. Mize told the Commission it takes 90 to 120 days to plat, and there will be some new commissioners on the commission at that time, and he thought it would be easier to have the ordinance approved for second reading and hold up on the publication.
