The Regular Meeting of the Board of Commissioners met in the City Commission Meeting Room, City -County Building, on Monday, February 2, 1981, at four o'clock p.m. There were present: Mayor Dan S. Geis, Chairman presiding Commissioner Keith G. Duckers Commissioner Karen M. Graves Commissioner Merle A. Hodges Commissioner Jack Weisgerber comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the !-leek of February 8 through 14, 1981 - "VOCATIONAL EDUCATION WEEK'. The proclamation was read by Kevin Meyer, a diesel mechanic student at Salina Area Vocational Technical School. None Commissioner Hodges left the meeting at 4:05 p.m. on an emergency. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME CONSENT AGENDA (6.1) Approve the minutes of the Regular Meeting January 26, 1981. (6.2) Authorize the Mayor to sign an agreement for water service outside the city limits with Camp Webster. (6.3) Cereal malt beverage license application, filed by Nora M. Lykins, d/b/a Edge Inn. (Transfer of location from 311 East Pacific to 600 North Santa Fe Avenue)' 81-28 Moved by Commissioner Duckers, seconded by Commissioner Weisgerber, that all items on the consent agenda be approved. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission to approve the final plat of the Replat of Blocks 11, 12 and part of 10 and 14, Mayfair Addition. 81-29 Moved by Commissioner Graves, seconded by Commissioner Duckers that the recommendation of the City Planning Commission be accepted and the final plat of the Replat of Blocks 11, 12, and part of 10 and 14, Mayfair Addition be approved, and that the Mayor be authorized to sign the final plat. Aye: (4). Nay: (0). Motion adopted. 2 (7.2) Recommendation from the City Planning Commission to adopt the Service Extension Plan for Annexation Application 81-1 and set April 6, 1981 for a public hearing on the annexation of Marymount Road Tract #1. 81-30 Moved by Commissioner Duckers, seconded by Commissioner Graves that the Service Extension Plan for Annexation Application 81-1, Marymount Road Tract #1, be adopted and that Resolution Number 81-3530, setting the date (of April 6, 1981) for a public hearing for the consideration of annexing certain property to the City of Salina, Kansas, be adopted. Aye: (4). Nay: (0). Motion adopted. (7.3) Recommendation from the City Planning Commission to adopt the Service Extension Plan for Annexation Application 81-2 and set April 6, 1981 for a public hearing on the annexation of Marymount Road Tract #2. 81-31 Moved by Commissioner Weisgerber, seconded by Commissioner Duckers that the Service Extension Plan for Annexation Application 81-2, Marymount Road Tract #2, be adopted and that Resolution Number 81-3531, setting the date (of April 6, 1981) for a public hearing for the consideration of annexing certain property to the City of Salina, Kansas, be adopted. Aye: (4). Nay: (0). Motion adopted. ADMINISTRATION (8.1) Second Reading Ordinance Number 81-8835 - prohibiting the sounding of a train whistle, air horn, or any similar noise -making warning devices at the railroad crossing directly east of Fifth Street on Iron Avenue in the City of Salina, Kansas, enacting Section 22-256 and 22-257 of the Salina Code. Charles Kephart, Salina Community Theatre, said the patrons of the Community Theatre will be very happy not having to hear a train whistle in the middle of a show. 81-32 Moved by Commissioner Duckers, seconded by Commissioner Graves that Section 22-257 be deleted from the proposed ordinance, and that "appropriate signs shall be installed on Iron Avenue and Ash Street to inform motorists that warning signals will not be sounded by train locomotives at these crossings" be added to Section 22-256. Aye: (4). Nay: (0). Motion adopted. 81-33 Moved by Commissioner Duckers, seconded by Commissioner Graves that Ordinance Number 81-8835, prohibiting the sounding of a train whistle, air horn, or any similar noise -making warning devices at the railroad crossings directly east of Fifth Street on Iron Avenue and Ash Street in the City of Salina, Kansas, enacting Section 22-256 of the Salina Code, be adopted as amended. (8.2) Resolution Number 81-3532 - determining the advisability of water main and sanitary sewer improvements, estimating the cost thereof, defining the boundaries of the improvement district, method of assessment, and apportioning the cost between the improvement district and the city -at -large. (Mayfair Addition - Engineering Project 81-674) 81-34 Moved by Commissioner Graves, seconded by Commissioner Duckers that Resolution Number 81-3532, determining the advisability of water main and sanitary sewer improvements, estimating the cost thereof, defining the boundaries of the improvement district, method of assessment, and apportioning the cost between the improvement district and the City -at -large, be adopted. Aye: (5). Nay: (0). Motion adopted. (8.3) Consideration of revision of water rates. Jerry May, Wilson S Company, gave an overview of the water rate study for the City Commission explaining the reason for a rate increase. The report also recommends bi-monthly billing to customers instead of monthly. E. H. Hagen, 2001 Ruskin Road, asked about the reserves and the interest from the reserve accounts. He was told the reserves are set by the bond ordinance and the interest is left in the reserve accounts. 226 John Dennis, 1106 Oak Circle, asked when the present bond issue expires, and if we were planning another bond issue in the near future. He was told the present bonds expire in 2007 and no bond issue is being planned. If an emergency situation would arise, we would probably need a bond issue. 81-35 Moved by Commissioner Duckers, seconded by Commissioner Weisgerber, that Resolution Number 81-3533, providing for the rates, fees or charges for the use and services rendered by the Combined Water and Sewerage Department of the City of Salina, Kansas, be adopted. Aye: (4). Nay: (0). Motion adopted. (8.4) First Reading Ordinance Number 81-8836 - providing that the Board of Commissioners shall, by resolution, periodically determine the rates, fees and charges for the use and services rendered by the Combined Water and Sewerage Department; amending Sections 35-54, 35-55, and 35-58 of the Salina Code, and repealing the existing sections. 81-36 Moved by Commissioner Duckers, seconded by Commissioner Graves that Ordinance Number 81-8836, providing that the Board of Commissioners shall, by resolution, periodically determine the rates, fees and charges for the use and services rendered by the Combined Water and Sewerage Department; amending Sections 35-54, 35-55, and 35-58 of the Salina Code and repealing the existing sections, be introduced for first reading.
