The Regular Meeting of the Board of Commissioners met in the City Commission Meeting Room, City -County Building, on Monday, December 22, 1980, at four o'clock p.m. There were present: Mayor Dan S. Geis, Chairman presiding Commissioner Keith G. Duckers Commissioner Karen M. Graves Commissioner Merle A. Hodges comprising a quorum of the board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: Commissioner Roy W. Allen None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor presented a plaque of appreciation to past board member Bob Diehl, member of the Convention and Tourism Committee. (4.2) Resolution Number 80-3524 - expressing gratitude and appreciation to Othello Meadows, Water Plant Operator, from August 10, 1970 to December 31, 1980. 80-332 Moved by Commissioner Hodges, seconded by Commissioner Graves that Resolution Number 80-3524, expressing gratitude and appreciation for services rendered by Othello Meadows as Water Plant Operator, from August 10, 1970 to December 31, 1980, be adopted. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Resolution Number 80-3525 - a resolution of intent to issue $200,000 Industrial Revenue Bonds for the Salina Board of Trade, Inc. There were no protests, written or oral, filed. 80-333 Moved by Commissioner Graves, seconded by Commissioner Hodges that Resolution Number 80-3525, a resolution of intent to issue $200,000 Industrial Revenue Bonds for the Salina Board of Trade, Inc., be adopted. Aye: (4). Nay: (0). Motion adopted. CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting December 15, 1980. (6.2) Approve a list of Cereal Malt Beverage license applications. 17 renewal and 2 new applications. (6.3) Report on bids received December 18, 1980 for police vehicles. (6.4) Petition Number 3800 filed by Natalie Hanson and Daniel J. Hanson, Sr. for the vacation of the East 10 feet of the north -south easement adjacent to Lot 6, Block 1, Platten Subdivision. 211 (6.5) Petition Number 3801 filed by Nancy Jones, Safety Chairman of Coronado School, for a sidewalk to be extended from Coronado School south to Gail Drive along the east side of Ray Avenue. (6.6) Resolution Number 80-3526 - Establishing a "special street machinery and equipment fund" and transferring money from the street fund into said account. (6.7) Resolution Number 80-3527 - Extending the Interlocal Agreement dated January 2, 1980, establishing a Department of Community Services, for one year to December 31, 1981. 80-334 Moved by Commissioner Duckers, seconded by Commissioner Hodges that all items on the consent agenda be approved. DEVELOPMENT BUSINESS (7.1) Reconsideration of the recommendation from the City Planning Commission on Zoning Application 80-14, (Postponed from the December 8, 1980 meeting) Z80-14 was filed by Leo Eisenberg and Company for the rezoning of a tract of land in the Southwest Quarter of Section 19, Township 14 South, Range 3 West) A letter was received from John Mize, Attorney for the petitioner, requesting that action on this application be postponed until January 5, 1981. 80-335 Moved by Commissioner Duckers, seconded by Commissioner Graves that action on on Zoning Application 80-14 until be postponed until January 5, 1981, at the request of the applicant. ADMINISTRATION (8.1) Second Reading Ordinance Number 80-8827 - Appropriating money from the various funds to pay payrolls and claims against the City of Salina, Saline County, Kansas, for the calendar year of 1981. 80-336 Moved by Commissioner Hodges, seconded by Commissioner Graves that Ordinance Number 80-8827, appropriating money from the various funds to pay payrolls and claims against the City of Salina, Saline County, Kansas, for the calendar year of 1981, be adopted. Aye: Duckers, Graves, Hodges, Geis (4). Nay: (0). Commissioner Allen absent. Motion adopted. (8.2) Second Reading Ordinance Number 80-8828 - Adopting, by reference, "Subdivision Regulations of the City of Salina, Kansas", as the rules and regulations governing the subdivision of land in the City of Salina, Kansas, and repealing Ordinance Number 6751. Joe Mendicina, 1981 President of the Salina Board of Realtors, said the board is against sidewalks and underground utilities in the lower price houses which are usually purchased by young couples for their first house. This increases the cost by $1,200 to $1,500 per house. Vern Weiss, President elect of the Homebuilders Association, said if the City Commission votes these regulations in, (sidewalks and underground utilities) it would be voting against the wishes of the people who elected the Commissioners. Bob Haworth, Realtor, said the underground utilities for a lot 80 x 120 feet would cost about $770.00. Chuck Stover, Realtor, who is developing the Meyer Addition, stated the underground utilities did cost $770.00 per lot. Mary Ash, 725 Wood, agrees that the sidewalks and underground utilities need to be delayed because of the high cost. 80-337 Moved by Commissioner Hodges, seconded by Commissioner Duckers that Section 3.7-1 (sidewalk requirement) be deleted from the Subdivision Regulations of Salina, Kansas. Aye: (2). Nay: (2). No Action. 212 80-338 Moved by Commissioner Hodges, seconded by Commissioner Duckers that Section 3.8-1 (underground utilities requirement) be deleted from the Subdivision Regulations of Salina, Kansas. Aye: (4). Nay: (0). Motion adopted. 80-339 Moved by Commissioner Hodges, seconded by Commissioner Duckers that Ordinance Number 80-8828, adopting, by reference, "Subdivision Regulations of the City of Salina, Kansas", (as amended by Commission Action 80-338) as the rules and regulations governing the subdivision of land in the City of Salina, Kansas, and repealing Ordinance 6751, be adopted. Aye: Duckers, Graves, Hodges, Geis (4). Nay: (0). Commissioner Allen absent. Motion adopted. (8.3) Amended application filed by James R. Ward, President of Kansas Agri Fuels, Inc. for the issuance of $3,100,000.00 Industrial Revenue Bonds. 80-340 Moved by Commissioner Duckers, seconded by Commissioner Hodges to recess into executive session for 15 minutes to discuss the possible issuance of Industrial Revenue Bonds. Aye: (4). Nay: (0). Motion adopted. The Commission recessed at 4:51 p.m. and reconvened at 5:07 p.m. 80-341 Moved by Commissioner Duckers, seconded by Commissioner Hodges that the City Clerk be instructed to publish a notice of intent to issue $3,100,000 Industrial Revenue Bonds for Kansas Agri Fuels, Inc., and set the hearing date of January 5, 1981.
