The Regular Meeting of the Board of Commissioners met in the City Commission Meeting Room, City -County Building on Monday, December 15, 1980, at four o'clock p.m. There were present: Mayor Dan S. Geis, Chairman presiding Commissioner Roy W. Allen Commissioner Keith G. Duckers Commissioner Karen M. Graves Commissioner Merle A. Hodges comprising a quorum of the board, also present: D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: L. 0. Bengtson, City Attorney None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) Mr. Dewain Bottger, Agency Manager for Farm Bureau Insurance Company, presented a "Sniffer" to the City of Salina and Saline County, to be used in arson investigation. (4.2) The Mayor presented 2 plaques of appreciation to past board and commission member Marlene Moore, as a member of the Library Board and Citizens Advisory Committee. None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME CONSENT AGENDA (6.1) Approve the minutes of the Regular Meeting December 8, 1980. (6.2) Approve a list of 80 1981 cereal malt beverage license applications. (6.3) City Engineer files plans and specifications for water and sewer main improvements in Eastridge Addition. Set January 8, 1981 as the date to receive bids. [Engineering Project 80-6711 (6.4) Resolution Number 80-3523 - adopting the Job Classification and Salary Schedule for City Employees, created pursuant to Section 2-61 of the Salina Code and repealing Resolution Number 3468 and all previous resolutions, motions or actions in conflict therewith. (6.5) Authorize the Mayor to sign an amendment to a contract with Howard Baker for signal light synchronization. (6.6) Authorize the City Manager to sign an agreement with American Recycling, for salvage of certain metal at the City of Salina landfill. 80-323 Moved by Commissioner Duckers, seconded by Commissioner Allen that all items on the consent agenda be approved. None DEVELOPMENT BUSINESS ADMINISTRATION go - (8.1) Second Reading Ordinance Number 80-8824 - levying special assessments to pay a portion of the cost of street and storm sewer improvements in Surveyor's Plat 52. (Engineering Project 80-663) 80-324 Moved by Commissioner Hodges, seconded by Commissioner Graves that Ordinance Number 80-8824, levying special assessments on lots, pieces and parcels of ground in the City of Salina, Kansas, for the purpose of paying a portion of the cost of street and storm sewer improvements in Surveyor's Plat 52, be adopted. (8.2) Second Reading Ordinance Number 80-8825 - Amending Section 36-907(2) of the Salina Code, and repealing the existing section, and enacting Section 36-907(2)A of the Salina Code. 80-325 Moved by Commissioner Graves, seconded by Commissioner Allen that Ordinance Number 80-8825, providing for the amendment of Section 36-907(2) of the Salina Code, and repealing the existing section, and enacting Section 36-907(2)A of the Salina Code, be adopted. (8.4) First Reading Ordinance Number 80-8827 - appropriating money from the various funds to pay payrolls and claims against the City of Salina, Saline County, Kansas, for the calendar year of 1981. 80-327 Moved by Commissioner Duckers, seconded by Commissioner Hodges that Ordinance Number 80-8827, appropriating money from the various funds to pay payrolls and claims against the City of Salina, Saline County, Kansas, for the calendar year of 1981, be introduced for first reading. (8.5) First Reading Ordinance Number 80-8828 - adopting, by reference, "Subdivision Regulations of the City of Salina, Kansas". 80-328 Moved by Commissioner Graves, seconded by Commissioner Hodges that Ordinance Number 80-8828, adopting, by reference "Subdivision Regulations of the City of Salina, Kansas" as the rules and regulations governing the subdivision of land in the City of Salina, Kansas, and repealing Ordinance Number 6751, be introduced for first reading. Ron Barta, 611 East Iron Avenue, Attorney for the Home Builders Association was concerned about the fencing requirement and that the City Planning Commission could determine a hazard to exist in certain areas of new developments and could require the developers to install fences. He wanted to know the City Planning Commission's definition of a hazard. He also felt the sidewalks required in the regulations should be stricken because state law allows for the installatio of sidewalks by petition. George Etherington, Realtor, 443 Aullwood, stated the cost of sidewalks on a corner lot would be $2,000 and homes should have the option of construction. Also that underground utilities would add $600 or $700 additional cost to each lot. -2 0 Gary McCausland, Realtor, said people buying homes don't want the additional cost of sidewalks. Bill Chaffee, Realtor, 2131 Fairdale, said developers have no control over the cost of underground utilities, and that one firm or company sets the price. Pat Morgan, Kansas Power and Light, stated all rates are based on overhead service and that the additional cost for underground service is the actual cost. He said no cost studies have determined that underground service requires less maintenance than overhead service. The Mayor called for a vote on Commission Action 80-328. Aye: (5). Nay: (0). (8.6) Request from the Salina Board of Trade, Inc. for the issuance of $200,000 Industrial Revenue Bonds. 80-329 Moved by Commissioner Duckers, seconded by Commissioner Allen to recess into executive session for 20 minutes to discuss the possible issuance of Industrial Revenue Bonds. Aye: (5). Nay: (0). Motion adopted. The Commission recessed at 5:10 p.m. and reconvened at 5:30 p.m. 80-330 Moved by Commissioner Duckers, seconded by Commissioner Hodges that the City Clerk be instructed to publish a notice of intent to issue $200,000 Industrial Revenue Bonds, and set the hearing date of December 22, 1980. OTHER BUSINESS The Mayor, with the approval of the City Commission made the following appointments: Jack Weisgerber, to fill the term of City Commissioner vacated by Roy Allen from January 1 to April 20, 1981. Museum Commission Rufus L. Nye, City Manager Roy W. Allen, County Commissioner Dan Geis, City Commissioner Mary Skelley, Saline County Historical Society Steve Burr, Member at large Beulah Smith, Member at large Library Board Lavern M. Myers, appointed to succeed Marlene Moore to April 30, 1981. Roy Allen said this is his last meeting as City Commissioner and he wanted to say he has enjoyed working with the other four commissioners. As County Commissioner he hopes to be working with them in the future in a different way. 80-331 Moved by Commissioner Hodges, seconded by Commissioner Allen that the Regular Meeting of the Board of Commissioners be adjourned.
