10-20-1980 Minutescommission CITY OF SALINA, KANSAS Action # REGULAR MEETING OF THE BOARD OF COMMISSIONERS OCTOBER 20, 1980 4:00 P.M. The Regular Meeting of the Board of Commissioners met in the City Commission Meeting Room, City -County Building, on Monday, October 20, 1980, at four o'clock P.M. There were present: Mayor Dan S. Geis, Chairman presiding Commissioner Roy W. Allen Commissioner Keith G. Duckers Commissioner Karen M. Graves Commissioner Merle A. Hodges comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None CITIZEN FORUM None AWARDS - PROCLAMATIONS The Mayor presented City Service Awards to 17 city employees with 10 and 25 years of service. The Mayor proclaimed the Week of October 19 through 25, 1980 - "NATIONAL BUSINESS WOMEN'S WEEK'. There was no representative present to read the proclamation. None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting October 6, 1980. (6.2) Set the date of November 3, 1980 for public hearing on the proposed special assessments for street and utility improvements in Meyer and Platten Additions. [Engineering Project 79-6551• (6.3) Resolution Number 80-3507 designating the official depositories for all monies of the City of Salina, Kansas, and directing the City Treasurer to deposit all monies received by him therein. (6.4) Resolution Number 80-3508 requesting the Kansas Congressional Delegatic to support the State and Local Fiscal Assistance Act, commonly "General Revenue Sharing". referred to as (6.5) Resolution Number 80-3509 pertaining to appointments to the Salina Citizens' Advisory Committee; amending Section 4 of Resolution Number 3441 and repealing the existing section. (6.6) Recommendation from the City Planning Commission that the City Commissi pass a motion requesting that the Saline County Commissioners vacate Blocks 2, 3, 4, 5, 6, of Magnolia Addition. 80-270 Moved by Commissioner Hodges, seconded by Commissioner Graves that all items on the consent agenda be approved. Aye: (5). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission to deny Zoning Application 80-14, filed by V. F. and Dorothy Lundberg, for the rezoning of property located at the northeast corner of Cloud and Ohio Streets, in the Southwest Quarter of Section 29-14-2. John Mize, Attorney for Virg Lundberg, requested the application be returned to the City Planning Commission for its reconsideration. 80-271 Moved by Commissioner Allen, seconded by Commissioner Hodges, that Zoning Application 80-14 be referred back to the City Planning Commission for its reconsideration, at the request of the petitioner. ADMINISTRATION (8.1) First Reading Ordinance 80-8814 - providing for the adoption of rules and regulations for refuse collection and operation of the sanitary landfill; providing the method of establishing service charges for refuse collection and sanitary landfill use; amending Section 31-17 and repealing the existing Section and Section 31-22 of the Salina Code. 80-272 Moved by Commissioner Allen, seconded by Commissioner Duckers that Ordinance Number 80-8814, providing for the adoption of rules and regulations for refuse collection and operation of the sanitary landfill; providing the method of establishing service charges for refuse collection and sanitary landfill use; amending Section 31-17 and repealing the existing Section and Section 31-22 of the Salina Code, be introduced for first reading. Jim Roets, a private refuse hauler, asked about the cost to the city using incinerators as compared to landfill pits. He was told it is cost prohibiti and impossible to meet the Environmental Protection Agency regulations. He thinks he should be able to use the alleys for his customers pickups. Randy Holm, 848 Custer, expressed his concern about the $1.00 fee increase, the closing of the alleys to truck traffic for private haulers, and that elderly and handicapped people would have trouble pushing the carts to the curb. Joe Keeling, wants the City Commission to try one truck and one route for three months to see how it works. He is concerned that elderly people wouldn't be able to push the carts to the curb. He was told that any elderly or handicappled person who could not wheel the cart to the curb could make a request to the City and we would do it for them as long as necessary. Mrs. Dreher said she has a long gravel driveway and there is no way she could push a cart to the street. Ruth Ascher, League of Women Voters, likes the idea of the containers, and feels it would be great for the Salina citizens. Jim Foley, asked if the city had considered letting the hauling out to private haulers. The Commission said they had considered it, but that is as far as it went. Minor Harris, private refuse hauler, is against cutting off the use of alleys for refuse collection. He thinks the city should keep the present system. He is also against the scales at the landfill. Marilyn Urion, likes the idea of the new system but is against no pick up from the alleys. She feels by doing this will cause traffic problems on some streets. Rosetta Ogborn, is against closing the alleys to private haulers, she feels it will hurt their business. 80-273 Moved by Commissioner Allen, seconded by Commissioner Hodges, that action on this ordinance be postponed for two weeks. Aye: Allen, Hodges (2). Nay: Duckers, Graves, Geis (3). Motion defeated. The Mayor called for a vote on the pending motion 80-272. Aye: Duckers, Graves, Geis, Hodges (4). Nay: Allen (1). Motion adopted. (8.2) Resolution Number 80-3510 - determining that is to the best interests of the City and its inhabitants to provide for the disposition of refuse as provided for in the Act by purchasing refuse containers and equipment, modifying vehicles for the collection of containers, purchasing landfill scales and excavating landfill pits at an estimated cost of $900,000, and providing that for the purpose of paying the cost of the facility, the governing body shall issue general obligation bonds not to exceed $900,000. 80-274 Moved by Commissioner Duckers, seconded by Commissioner Graves, that Resolution Number 80-3510, determining that it is to the best interests of the City and its inhabitants to provide for the disposition of refuse as provided for in the Act by purchasing refuse containers and equipment, modifying vehicles for the collection of containers, purchasing landfill scales and excavating landfill pits at an estimated cost of $900,000, and providing that for the purpose of paying the cost of the facility, the governing body shall issue general obligation bonds not to exceed $900,000, be adopted. (8.3) First Reading Ordinance 80-8815 - prohibiting truck traffic on unimpr alleys within the City, enacting Section 22-123 of the Salina Code. 80-27511 The Mayor declared the ordinance died for lack of a motion. (8.4) First Reading Ordinance Number 80-8816 - prohibiting the storage of refuse and refuse containers on the public right-of-way and providing exceptions thereto; enacting Section 31-24 and 31-25 of the Salina Code. 80-276 Moved by Commissioner Graves, seconded by Commissioner Duckers, that Ordinance Number 80-8816, prohibiting the storage of refuse and refuse containers on the public right-of-way and providing exceptions thereto; enacting Sections 31-24 and 31-25 of the Salina Code, be adopted. (8.5) Resolution Number 80-3511 - Establishing the service fees to be charged for residential refuse collection service. 80-277 Moved by Commissioner Duckers, seconded by Commissioner Allen that Resolution Number 80-3511, establishing the service fees to be charged for residential refuse collection service, be amended by changing Section 2 (1) to $5.00 minimum per call, and ''for each employee assigned to the call'' be deleted from Section 2 (2), and adopted as amended. Aye: (5). Nay: (0). Motion adopted. (8.6) Resolution Number 80-3512 - Establishing the fees to be charged users of the City of Salina Solid Waste Disposal Area; repealing Resolution Number 3338. 80-278 Moved by Commissioner Hodges, seconded by Commissioner Graves that Resolution Number 80-3512, establishing the fees to be charged users of the City of Salina Solid Waste Disposal Area; repealing Resolution Number 3338, be adopted. Aye: (5). Nay: (0). Motion adopted. OTHER BUSINESS The Mayor, with the approval of the City Commission, made the following appointment: Grievance Committee Dennis McMurray, appointed to succeed Rev.
