The Regular Meeting of the Board of Commissioners met in the City Commission Meeting Room, City -County Building, on Monday, July 14, 1980, at four o'clock P.M. There were present: Mayor Dan S. Geis, Chairman presiding Commissioner Roy W. Allen Commissioner Keith G. Duckers Commissioner Karen M. Graves Commissioner Merle A. Hodges comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None CITIZEN FORUM None AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed Friday, July 18, 1980 - "USA DAY" (United Salinan's Auction Day) to help the people of Grand Island, Nebraska. The proclamation was read by Judy McCrae. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the minutes of the Regular Meeting July 7, 1980. (7.2) City Engineer files Plans and Specifications for Engineering Project 80-663 for street improvements on Westbend and Edison Streets. Set July 31, 1980 as the date to receive bids. (7.3) Cereal malt beverage license application filed by Ruth Alley, d/b/a El Matador, 1409 West Crawford. (New application) 80-194 Moved by Commissioner Graves, seconded by Commissioner Hodges that all items on the consent agenda be approved. Aye: (5). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission to approve Zoning Application 80-10. [Rezoning of the Rocket Drive-in, 1650 West Crawford from RS to C-6 (Heavy Commercial). The application was filed by Development Consultants, Inc.] 80-195 Moved by Commissioner Duckzrs, seconded by Commissioner Allen that the recommendation of the City Planning Commission be accepted and that Zoning Application 80-10 be approved subject to platting, and that Ordinance Number 80- 8800, providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be introduced for first reading. Aye: (5). Nay: (0). Motion adopted. 161 ADMINISTRATION (8.1) Second Reading Ordinance Number 80-8799 - levying special assessments on certain lots and pieces of property to pay the cost of asphaltic concrete overlay of streets in Fox Run Addition. [Engineering Project 80-6591 80-196 Moved by Commissioner Hodges, seconded by Commissioner Allen that Ordinance Number 80-8799, levying special assessments on certain lots and pieces of property to pay the cost of Three Inch (3") asphaltic concrete overlay applied to all existing streets in Fox Run Addition to the City of Salina, Kansas; removal and replacement of all areas of existing pavement that show structural deterioration; removal and replacement of defective concrete curb and gutter; crack sealing of existing pavement, be adopted. Aye: Allen, Duckers, Graves, Hodges, Geis (5). Nay: (0). Motion adopted. (8.2) Consideration of increasing the speed limit from 30 MPH to 40 MPH on Marymount Road from Iron Avenue to Crawford Street. 80-197 Moved by Commissioner Allen, seconded by Commissioner Graves to postpone action on Marymount Road, and consider the Marymount Road and Ohio Street speed limits on July 28, 1980. Aye: Allen, Graves (2). Nay: Duckers, Hodges, Geis (3). Motion defeated. (8.3) Presentation of the Proposed 1981 Budget and set the date of August 4, 1980 at 4:00 P.M. for the public hearing. 80-198 Moved by Commissioner Hodges, seconded by Commissioner Duckers to approve the proposed budget for publication and set August 4, 1980 at 4:00 P.M. for the public hearing. Aye: (5). Nay: (0). Motion adopted. (8.4) Request by Fred Trump, Chairman of the Museum and Artifacts Committee of the Saline County Historical Society that the city establish a Museum Commission. Mr. Trump asked to delay action on this request until August 18, 1980. 80-199 Moved by Commissioner Allen, seconded by Commissioner Duckers that action on this request be postponed until August 18, 1980 at the request of Mr. Trump. Aye: (5). Nay: (0). Motion adopted. (8.5) First Reading Ordinance Number 80-8801 - defining a hobby breeder and requiring the obtaining of an annual license therefor; amending Section 8-1(11) of the Salina Code and repealing the existing section. 80-200 Moved by Commissioner Duckers that Ordinance Number 80-8801, defining a hobby breeder and requiring the obtaining of an annual license therefor; amending Section 8-1(11) of the Salina Code and repealing the existing section, be introdu for first reading. Motion died for lack of a second. 80-201 Moved by Commissioner Allen, seconded by Commissioner Graves that Ordinance Number 80-8801 be amended to require anyone wanting a hobby breeder license to get the approval of the adjacent property owners and anyone having a hobby breeder license now would be exempted from this requirement, and that the ordinance, as amended, be introduced for first reading. Aye: (5). Nay: (0). Motion adopted. (8.6) Application by James R. Ward, President of the issuance of Industrial Revenue Bonds. Kansas Agri Fuels, Inc. for 80-202 Moved by Commissioner Graves, seconded by Commissioner Allen that the Commission recess into executive session to discuss the possible issuance of Industrial Revenue Bonds, for 20 minutes.
