The Regular Meeting of the Board of Commissioners met in the City Commission Meeting Room, City -County Building, on Monday, July 7, 1980, at four o'clock P.M. There were present: Mayor Dan S. Geis, Chairman presiding Commissioner Keith G. Duckers Commissioner Karen M. Graves Commissioner Merle A. Hodges comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: Commissioner Roy W. Allen CITIZEN FORUM Lee Lorenz, 1945 Rolling Hills Circle is against any increase in tax for 1981. He feels it is okay to increase the water and sanitation fees, but people need to get along without many of the governmental services they are now getting. AWARDS - PROCLAMATIONS The Mayor presented a plaque of appreciation to past board member Tom Runyan, Recreation Commission. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing on the proposed assessments for street resurfacing in Fox Run Addition. [Engineering Project 80-6591 A public hearing was held on the proposed assessments for street resurfacing improvements authorized in Resolution Number 80-3474, passed by the Board of Commissioners on the 14th day of January, 1980. There were no protests, written or oral, filed. 80-182 Moved by Commissioner Duckers, seconded by Commissioner Hodges, that Ordinance Number 80-8799, levying special assessments on lots, pieces and parcels of ground in the City of Salina, Kansas, for the purpose of paying a portion of the cost of: Three inch asphaltic concrete overlay applied to all existing streets in Fox Run Addition to the City of Salina, Kansas; Removal and replacement of all areas of existing pavement that show structural deterioration; Removal and replacement of defective concrete curb and gutter; Crack sealing of existing pavement in Fox Run Addition, be introduced for first reading. (6.4) Report on bids received June 26, 1980 for the sale of property at 630 Park Place. (6.5) Report on bids received June 26, 1980, for the sale of property at 406 Putnam. (6.6) Resolution Number 80-3496 - authorizing and ordering certain curbing, guttering, paving, grading, storm sewer pipe and inlet improvements, ordering preparation of plans and specifications, and the estimate of costs. [Westbend and Edison Streets, Engineering Project 80-6631 (6.7) Resolution Number 80-3497 - authorizing certain public officials to issue Uniform Violation Summons upon observation of violations of the Salina Code. 80-183II Moved by Commissioner Graves, seconded by Commissioner Duckers that all items on the Consent Agenda be approved. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission to approve the final plat of the Replat of Blocks 3, 4, 5, 6, and 8, Lakewood Addition, requested in Application P80-lA, filed by Dick Johnson. 80-184 Moved by Commissioner Hodges, seconded by Commissioner Duckers that the recommendation of the City Planning Commission be accepted and the Mayor be authorized to sign the final plat. (Planned Development District Application 80-3, filed by Les Appleby for the rezoning of Lot 12, Upper Mill Heights Addition Number 2) 80-187 Moved by Commissioner Duckers, seconded by Commissioner Hodges that Ordinance Number 80-8798, providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be adopted. (Zoning application 80-8, filed by the City Planning Commission) 80-185 Moved by Commissioner Graves, seconded by Commissioner Hodges that Ordinance Number 80-8796, providing for the amendment of Sections 36-600(1), 36-600(2), 36-601(1), 36-601(2), 36-602(1), 36-602(2), 36-603(1), 36-603(2), 36-604(1), 36-604(2), 36-604A(l), 36-604A(2), 36-605(1), and 36-605(2), the same being Chapter 36 of the Salina Code, and repealing the existing sections, be adopted. (8.5) Recommendation from Don Jolley, Director of Community Services, concerning a contract for architectural services for the remodeling of the Salina Municipal Swimming Pool. Mr. Jolley recommended a contract be awarded to Architectural Services Plus for plans and specifications for remodeling of the Salina Municipal Swimming Pool. 80-189 Moved by Commissioner Duckers, seconded by Commissioner Graves, that the recommendation of the Director of Community Services be accepted and a contrac be awarded to Architectural Services Plus for plans and specifications for the remodeling of the Salina Municipal Swimming Pool. (8.6) Staff report on a request from Freeda Steyer and Willis Mercer to allow parking on Marymount Road during certain hours of the day. 80-190 Moved by Commissioner Hodges, seconded by Commissioner Graves that the staff recommendation on parking on Marymount Road be accepted and the request for parking on Marymount Road be denied. Aye: Duckers, Graves, Hodges (3). Nay: Geis (1). Motion adopted. Commissioner Graves asked to have the consideration of increasing the speed limit on Marymount Road from Iron Avenue to Crawford Street from 30 MPH to 40 MPH, placed on the agenda next week. (8.7) Staff report on a request by Maure Weigle, 1015 East Ellsworth, to reduce the speed limit on Ohio Street from Wayne Avenue to Greeley Avenue from 40 MPH to 30 MPH. 80-191 Moved by Commissioner Duckers, seconded by Commissioner Graves to accept the staff recommendation and deny the request to reduce the speed limit from 40 MPH to 30 MPH on Ohio Street from Wayne Avenue to Greeley Avenue. Maure Weigle, 1015 East Ellsworth; Karen Olson, 1011 East Ellsworth; George Pryor, 1018 Manor Road; Loren Robertson, 809 South Ohio; Jim Torrey, 1006 East Ellsworth; Jack Copeland, 1019 Millwood Drive; John Loftus, 1016 East Ellsworth, all spoke in favor of reducing the speed limit from 40 MPH to 30 MPH on Ohio Street from Wayne Avenue to Greeley Avenue. They also asked for a push button stop light for the school crossing at Ellsworth instead of the slow to 20 20 MPH flashing light that is there now. Mayor Geis called for a vote on the pending motion: Aye: Graves (1). Nay: Duckers, Hodges, Geis (3). Motion defeated. 80-192 Moved by Commissioner Duckers, seconded by Commissioner Hodges that the speed limit on Ohio Street, from Wayne Avenue to Greeley Avenue be reduced from 40 MPH to 30 MPH for one year, at which time it will be reviewed, and that Resolution Number 80-3498, providing for a speed limit of 30 MPH on Ohio Street from Wayne Avenue to its intersection with Greeley Avenue, be adopted.
