06-23-1980 Minutes153 Commission Action # CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS JUNE 23, 1980 4:00 P.M. The Regular Meeting of the Board of Commissioners met in the City Commission Meeting Room, City -County Building, on Monday, June 23, 1980, at four o'clock P.M. There were present: Mayor Dan S. Geis, Chairman presiding Commissioner Roy W. Allen Commissioner Keith G. Duckers Commissioner Karen M. Graves Commissioner Merle A. Hodges comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None CITIZEN FORUM None AWARDS - PROCLAMATIONS None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) City Manager holds a public hearing on the proposed use of Revenue Sharing Funds for the 12th Entitlement Period. Wanda Macy asked for $10,000 for the Salina Coalition for Prevention o Child Abuse. There were no other requests. The City Manager declared the public hearing closed. CONSENT AGENDA (6.1) Approve the minutes of the Regular Meeting June 16, 1980. (6.2) Cereal Malt Beverage license applications filed by: (A) M. Gary Talley, for the Brown Mackie College, College Park (Convenience Store), 112 Hays Court. (New application) (B) Carole Anderson, d/b/a E1 Zarpe, 1035 East Pacific. (New application) (6.3) Recommendation from the City Engineer to approve Petition Number 3787, filed by Joan Bermudez, Kennedy School PTA Safety Chairman, for construction of sidewalks along the north side of Otto Avenue between Tulane Avenue and Ninth Street. (6.4) Resolution Number 80-3493 - determining the necessity of and directing that owner or owners of certain lots construct, in compliance with plans and specifications of the City Engineer, a sidewalk, abutting said lots within 30 days of the adoption and publication hereof and providing that in the event the owner or owners fail to do so, that the City of Salina shall proceed to construct, or cause to be constructed, said sidewalk and that the total cost thereof shall be assessed against such lot or lots on which such sidewalk shall abut as other special assessments. 1 1, 5) 4 (6.5) Resolution Number 80-3494 - determining the advisability of certain curbing, guttering, paving, grading, storm sewer pipe and inlet improvements, estimating the cost thereof, defining the boundaries of the improvement district, method of assessment, and apportioning the cost between the improvement district and the city -at -large. [Engineering Project 80-6591 (6.8) Petition Number 3788 - filed by Niles Hauser for an additional break in the restructed access along the north right of way line of West Crawford Street to allow safer access to Lot 2, Block 1, Hocking Addition. (6.9) Report on bids received June 19, 1980 for improvements to the heating and air conditioning system at Fire Station #1. [Engineering Project 80-6641 (6.10) Staff requests a two week extension to report on a request by Maure Weigle, 1015 East Ellsworth, that the speed limit be reduced on Ohio Street from 40 MPH to 30 MPH between Wayne and Greeley Avenues. (6.11) Request from Keith Rawlings, Community Development, for the City Commission to authorize the Mayor to sign a letter appointing a local coordinator for the North Central Regional Planning Commission Weatherization Program. (6.12) Recommendation from the Director of Community Services, that Architectural Services Plus be selected for architectural services for remodeling the Salina Municipal Swimming Pool. 80-174 Moved by Commissioner Duckers, seconded by Commissioner Allen that Item 2A, and Item 12 be removed from the consent agenda, and that all other items on the consent agenda be approved. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission to approve Zoning Application 80-8, filed by the City Planning Commission to amend 14 sections of the zoning ordinance. 80-175 Moved by Commissioner Graves, seconded by Commissioner Hodges that Ordinance Number 80-8796, providing for the amendment of Sections 36-600(1), 36- 600(2), 36-601(1), 36-601(2), 36-602(1), 36-602(2), 36-603(1), 36-603(2), 36- 604(1), 36-604(2), 36-604A(1), 36-604A(2), 36-605(1), 36-605(2), the same being Chapter 36 of the Salina Code, and repealing the existing sections, be introduced for first reading. (7.2) Recommendation from the City Planning Commission to approve Application UR80-2, filed by Kansas Power and Light Company, for approval of an amended development plan on Lots 1 and 2, Block 9, Northeast Industrial Park. 80-176 Moved by Commissioner Duckers, seconded by Commissioner Hodges that the recommendation of the City Planning Commission be accepted and that Application UR80-2, filed by Kansas Power and Light Company, for approval of an amended development plan on Lots 1 and 2, Block 9, Northeast Industrial Park, be approved. (7.3) Recommendation from the City Planning Commission for approval of Zoning Application 80-9, filed by the City Planning Commission for amendment to Section 36-808(2)(a) and (d) and Section 36-809(2)(b) of the Flood Plain District Regulations concerning minimum building elevations. 80-177 Moved by Commissioner Hodges, seconded by Commissioner Allen that the recommendation of the City Planning Commission be accepted and that Zoning Application 80-9 be approved and that Ordinance Number 80-8797, providing for the amendment of Section 36-808(2) and 36-809(2) of the Salina Code, and repealing the existing sections, be introduced for first reading. Application 80-3, filed by Les Appleby for the rezoning of Lot 12, Upper Mill Heights Addition Number 2. 80-178 Moved by Commissioner Allen, seconded by Commissioner Graves that the recommendation of the City Planning Commission be accepted and that P.D.D. Application 80-3, filed by Les Appleby for the rezoning of Lot 12, Upper Mill Heights Addition Number 2 be approved and that Ordinance Number 80-8798, providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be introduced for first reading. Ivy Marsh, Smoky Hill Audubon Society, wants the property reserved for 70-180 Moved by Commissioner Graves, seconded by Commissioner Hodges that the recommendation of the City Manager be accepted, and that the old airport land be retained. Harrison, City Clerk George Etherington, 443 Aullwood, quoted figures on park land in Salina from the Land Use Plan now being prepared and asked the Commission to table its decision until the Commissioners have had a chance to read the new plan. Entriken, Bill Burrows, 1912 South Fourth; George Toland, 908 Highland; Robert 1315 Pershing, want the City to retain this property. This type of facility is needed and we are fortunate to have it.
